Last Will and Testament of Michael Hallenbeck Dec'd.

In the name of God Amen, I Michael Hollenbeck of the town of Broome in the county of Schoharie and State of New York being weak in body but of sound and perfect mind and memory blessed by almighty God for the same, do make and publish this my last will and testament in manner and form following (that is to say

First is my will that all my debts and funeral expenses be paid out of my personal estate.

Item. I give and bequeath unto my daughter Clarrisa Ellis the wife of Peter Ellis one certain yoke of oxen which the said Peter has now in his posesion - and also I do hereby direct my executors herein after named to give up to the said peter Ellis one certain note of fifteen dollars which note and oxen I do hereby declare to be in full of all legacy due from me to my said daughter Clarrisa Ellis.

Item. I give and bequeath unto Jacob Hollenbeck the son of my brother Jacob Hollenbeck decd one certain musket or gun which gun is now in the posesion of the said Jacob Hollenbeck.

Item. I give and bequeath unto my brother Ephraim Hollenbeck my best great coat and vest.

Item. I give and bequeath unto Catharine Hallenbeck the wife of my brother John Hallenbeck all the remaining part of my personal estate.

Lastly I do hereby nominate and appoint my nephew David Frayer and my friend John B. Drake my executor hereby revoking all former testament by me made. In witnes whereof I have hereunto set my hand and seal this 5th day of February A.D. 1828.

Signed sealed published and declared by the above named Michael Hollenbeck to be his last will and testament in the presence of us who have hereunto subscribed our names as witneses in presence of the testator and each other.

State of New York Schoharie County. Be it remembered that on the nineteenth day of January in the year of our Lord one thousand eight hundred and twenty nine personally appeared before me William Mann Surrogate of the county of Schoharie aforesaid Gideon Hollenbeck one of the subscribing witneses to the will of Michael Hollenbeck late of the town of Broome in the said county declared who being duly sworn declared that he did see the said Michael Hollenbeck deceased seal and excecute the instrument hereunto ann-- and impresed with the seal of office of the said Surrogate which said instrument purports to be the last will and testament of the said Michael Hollenbeck deceased bearing date the fifth day of February in the year of our Lord one thousand eight hundred and twenty eight that he heard him the said Michael publish and declare the same as and for his last will and testament and that at the time thereof he the said Michael was of sound disposing mind and memory to the best knowledge and belief of him the said Gideon and that he together with Eliza Jane Hollenbeck and Nicholas Hollenbeck the other witneses to the said will did severally subscribe their names thereto as witneses in the presence of the testator and of each other and that some time in the month of March last the said Michael Hollenbeck died. In testimony whereof the said Surrogate hath hereunto set his hand and affaced his seal of office this nineteenth day of January in the year of our Lord one thousand eight hundred and twenty nine.

Letters Testamentary

The people of the state of New York by the Grace of God Free and Independent. To all to whom these presents shall come or may concur send greeting . know ye that at the town of Schoharie in the county of Schoharie on the nineteenth day of January in the year of our Lord one thousand eight hundred and twenty nine before me William Mann Esquire Surrogate of our said county the last will and testament of Michael Hollenbeck deceased (a copy whereof is hereunto annesced) was proved and is now approved and allowed of by us; and the said deceased having whilst he lived and at the time of his death goods, chattels or credits, within this state by means whereof the proving and registering the said will and granting administration of all and singular the same goods, chattels and credits and also the auditing allowing and final discharging the account thereof doth belong unto us the administration of all and singular the goods, chattels, and credits of the said deceased and any way concerning his will is granted unto David Frayer in the said will named he being first duly sworn will and faithfully to administer the same and to make and exhibit a true and perfect inventory of all and singular the said goods chattels and credits and also to under a just and true account thereof when thence unto required - In testimony whereof we have caused the seal of office of our said Surrogate to be hereunto affixed. Witnes William Mann Esquire Surrogate of the said county at Schoharie aforesaid, the nineteenth day of january in the year of our Lord one thousand eight hundred and twenty nine and of our independence the fifty third year.

Schoharie County: Be it also remembered that on the nineteenth of January in the year of our Lord one thousand eight hundred and twenty nine appeared before me the said Surrogate David Frayer Executor in the aforesaid will named and was duly sworn to the faithfull performance and execution thereof by taking the usual oath in that case provided.
