LAST WILL AND TESTAMENT OF JOHANNES LAWYER

Lawyer, Johannes, Merchant, of Schoharry, Albany 1 Oct 1765. Probate dated 1 October 1765.

In the Name of god Amen the Tenth Day of March, one thousand Seven hundred And sixty I Johannes Lawyer of Schoharry In the county of Albany Merchant Being in good health of Body and of sound and perfect Mind and Memory praise be given to Almighty god therefore calling unto mind The Mortality of my Body and knowing that it is appointed for all men to Die do make and ordain this My last will and testament that is to say principally and first of all I give and recommend my Soul into The hands of Almighty God that gave it and my Body I Recommend to the Earth to be Buried in Decent Christian Burial at the Descretion of my Executors Nothing Doubting but at the general Resurrection I shall Receive the Same again by the Mighty power of god And as touching Such [personal] Estate where with it hath Pleased God to Bless me in this life I give Demise and dispose of the same [in the follow]ing manner and form.

First I will that [my] debts and funeral charges shall be paid and Discharged

Itim I do give and bequeath unto my Eldest son Johannes Lawyer All my Surveyers Instruments as his fore Right Where with [he] is to be Satisfyed and Make no claim to any of my Estate more then what hereafter is further bequeathed un[to] him.

Itim I Do give and Bequeath unto my Beloved Wife Elizabeth all my Real and Personall Estate of what kind And Nature Soever, [to] to have Enjoy and possess the same and to Receive all the Rents Issues and profitts thereof During the time S[he] Remains my Widow But Not that She Shall or may Dispose or Sell any part of my Real Estate Whatsoever.

Itim I Do give and Bequeath unto my five Children that is to say Johannes Lawyer Jacob fredrick Lawyer Lawrence Lawyer Elizabeth and Sophia Deceased and to heirs and Assigns for Ever after the Decease of my Wife or Remarriage All my Estate Real and Personall of What soever Nature [fragment missing] Here Above given and Bequeathed to be Equally Divided between my Said Children Share and Share A Like the one no more that the other.

Itim I Do give and Bequeath to my Beloved Son Johannes Lawyer his heirs Executors Administrators and Assigns After the Decease or Remarriage of his Mother Elizabeth Lawyer one fifth Part of all my Estate Real And Personal of What Kind or Nature Soever.

Itim I Do give and Bequeath to my Beloved Son Jacob Fredrick Lawyer his heirs Executors Administrators And Assigns After the Decease or Remarriage of his Mother Elizabeth Lawyer one fifth Part of all my Estate Real And Personal of what Kind or Nature Soever.

Itim I Do give and Bequeath to my Beloved Son Lawrence Lawyer his heirs Executors Administrators and Assigns After the Decease or Remarriage of his Mother Elizabeth Lawyer one fifth Part of my Estate Real and Personal of What Kind or Nature Soever.

[Itim I do give and Bequeath to All the] Children born of the Body of [my Daughter Elizabeth Lawyer wife of Marcus Rickert deceased and] Wife of Hendrick Hayns the said Children shall be the true heirs [Executors Administrators and Assigns of the fifth] part of All my Estate Real and Personal of What Kind or Nature Soever and to be [Equally Divided between] them their heirs Executors Administrators or Asigns.

Itim I do also give and Bequeath to All the Children born of the body of my Daughter Sophia Zehe Deceased by the two husbands Jeost Belinger Deceased and Christian Zehe Shall be the true heirs Executors Administrators and Assigns of the fifth part of All My Estate Real and Personal of What Kind or Nature Soever And to be Equally Divided between them their heirs Executors Administrators or Assigns.

And Lastly I Do Nominate Constitute and Appoint My three Sons Johannes Lawyer Jacob Fredrick Lawyer and Lawrence Lawyer All of Schoharry Executors [of] this my Last will and Testament Where of I have here Unto Sett my hand and Seal the Day and Year First Above Writting

County ss. Be it remembered that on the 24 January 1765 personally came and appeared before me John D. Peyster Surrogate of the said county Peter Nicholas Summer Lutheran Minister att Schoharry in the county of Albany in the province of New York and being Duly Sworn on his oath declared that he did see Johan�s Lawyer Sign and Seal the above written Instrument purporting to be the will of the said Johan�s Lawyer bearing the date the 10 Day of March 1760 And heard him publish and declare The same to be and Contain his Last will and testament, That att the time thereof he the said Joha�s Lawyer was of Sound Disposing mind and memory to the best of his knowledge and belief of him the deponent and that his name subscribed to the Said Will [is] of his proper hand Writing Which he subscribed As Witness to ye Said Will in the Testators presents, And Also further Declar�d that he saw Johannes Schaffer & Frans Otto the other Witnesses to Said Will Subscribe their names as witnesses for the [fragment missing].

Be it Remembered that on the first day of October One thousand seven hundred and Sixty five Johannes Lawyer one of the Executors of the within written Will of Johannes Lawyer appeared before me ~ Goldsbrow Ranyar and was duly Sworn to the true Execution and performance of the said Will, by taking the Oath of an Executor, as by Law appointed, before me, [end of document]
