THE WILL AND TESTAMENT OF JOHN HERRON, JR

In the name of God Amen I John Herron Junior of the Town of Middleburgh County of Schoharie and State of New York being weak in body but sound and perfect mind and memory and considering the uncertainty of this mortal life & the certainty of death do make and publish this my last will and Testament in manner and form following that is to say � Firstly I give and bequeath unto my beloved wife Betsey Herron my Executrix herein after named the use of one third part real estate in lieu of her Dower during the period of her natural life Also the whole of my personal property accepting what is herein after bequeathed to my son David of every Name & Nature of Notes Dues and Demands as well as chattels upon this condition that she pay all the just debts I shall owe after my decease

Item. I give and bequeath unto my Son David Herron and to his heirs for ever all my read estate in fee and all Deeds Vouchers and Securities relating to the same, together with the whole of my several tools and implements of trade the said real estate to be --- however to the --- estate herein after bequeathed to John Herron and Nancy Herron my natural guardians and parents

Item. it is my will and desire that John Herron and Nancy Herron my parents above named shall and may live on possess and enjoy the lands and tenements whereon the now said for and during the period of their and each of their natural lives without let demand or disturbance by under or from my said son David his heirs or assigns and that this last mentioned bequeath be the condition of the above mentioned bequest to my said son David and further it is my will and desire that after my said son David shall arrive to the age of twenty one years he the said David be permitted to live with my said parents and equally with them to enjoy the said land and premises whereon they now live and to build on the same if he shall think it beneficial and necessary.

Item. I do hereby constitute and appoint my beloved wife Betsey Herron my true and lawful executrix to this my last will and testament not doubting that she will faithfully discharge the duties of the same.

Item. It is my further will and desire that if my said parents shall remove off the said lands and tenements above mentioned to --- that then the estate shall descend to the immediate use of my son David she hereby possesses the --- to the same

County of Schoharie � be it remembered that on the twenty eight day November in the year of our Lord one thousand eight hundred and nine personally appeared before me Storm A Becker Surrogate of the County of Schoharie John Obrien and John Mensch of the County of Schoharie and being duly sworn on their oaths declare that they --- --- each of them John Herron Jun sign & seal the within --- instrument purporting to be the last will of the said John Herron Jr and --- publish and declare the same as and � his last will and testament note at the time thereof he was of sound & disposing mind and memory to the best knowledge of both of them the Deponents saw the other witness � John A Becker to said will subscribe his name as a witness thereto in the testators person
