Last Will and Testament of John Dominick, Junior deceased

In the name of God, Amen. I John Dominick Junr. of Schoharie in the county of Schoharie and State of New York being weak in body but of sound and perfect mind and memory, blessed be almighty God for the same, do make and publish this my last will and testament in manner and form following that is to say

First I give and bequeath unto beloved wife Margaret Dominick during her natural life one third part of my dwelling house the (bar room excepted) part she chooses to occupy. Secondly I give and bequeath unto my eldest son John I. Dominick my equal undivided half of a lot land purchased of Eben Lawyer situate in Schoharie in a patent granted to Jacob Sternbergh and others containing twenty five acres of land. Also my equal undivided half of a part of a lot land number thirty four in a patent granted to Jacob Sternbergh and others purchased of Henry Foot containing thirty acres of land, also one other piece of land containing about six acres lying on the north side of what is commonly denominated the township road and being part of lot No. 36 or 37 in a patent granted to Jacob Zimmer and others. Third I give and bequeath unto my second son William Dominick all that part of lot Number fifteen in a patent granted to Jacob Sternbergh and others lying on the south side of the Albany road. Also six acres on the north side of the road in the same lott taking it across the whole of my part of that lott. Also one acre of my seventeen acre lott on the north side of the road being a part of the farm now in [p???pation] of Jacob W. Zimmer on which I am now erecting a barn. Also eight acres of Wood land on the same seventeen acre lot north of the road.

Fourth I give and bequeath unto my third son Peter Dominick all the rest and residue of my freehold estate whatsoever. I also give and bequeath unto my sons William and Peter Dominick all my notes, bonds, book accounts etc. and request them to finish the building now begun for William and to pay all the debts standing against me. Fifth I give and bequeath to my daughter Hannah wife of Paul Settle sixty dollars which I request my son Peter Dominick to pay her within five years after my decease. I give and bequeath to my daughter Sophia Walden wife of Hiram Walden thirty five dollars to be paid within six months from this date. Also sixty dollars to be paid in seven years after my decease. I give and bequeath unto my daughter Marilla thirty five dollars whenever she marries and sixty dollars within nine years after my decease all which I request my son Peter to pay. I also give and bequeath unto my daughters Sophia and Marilla each one cow and two head of young cattle and six sheep at any time when they call for them after marriage. I give and bequeath unto my son Peter all my farming utensils together with all my stock on the farm one horse excepted which I bequeath to my son William. Lastly I hereby nominate constitute and appoint my two youngest sons William Dominick and Peter Dominick executors to this my last will and testament hereby revoking all former wills by me made. In witness whereof I have hereunto set my hand and seal the twelfth day of June in the year of our Lord one thousand eight hundred and twenty two.

Signed sealed published and declared by the above named John Dominick Junr. to be his last will and testament in the presence of us who have hereunto subscribed our names in the presence of the testator.

Be it remembered that on the thirtieth day of Sept. in the year of our Lord one thousand eight hundred and twenty two personally came before me William Mann Surrogate of the County of Schoharie Joseph Hunting and Isaac Barber who being duly sworn declared that they saw John Dominick Jun. sign and publish and declare the aforegoing instrument purporting to be the last will and testament of the said John Dominick Jun. as and for his last will and testament and at the time thereof the said John Dominic Junr. was of sound and disposing mind and memory to the best of their knowledge and belief of them the deponents and that John Schoolcraft together with the deponents subscribed the same as witnesses thereto in the presence of the testator and each other.

To all to whom the presents shall come or may concern. Send Greetings.

Know ye that at the town of Schoharie in the County of Schoharie on the thirtieth day of September in the year of our Lord one thousand eight hundred and twenty two before me William Mann Esquire Surrogate of our Said County the last Will and Testament of John Dominick Junior deceased (a copy whereof is hereunto amended) was proved and is now approved and allowed of by us; and the said deceased having whilst he lived and at the time of his death goods, chattels or credits within this State by means whereof the proving and registering the said will and granting administration of all and singular the said goods chattels and credits and also the auditing, allowing and final discharging the account thereof doth belong unto us: The administration of all and singular the goods Chattels and Credits of the said deceased and any way concerning his will is granted unto William Dominick and Peter Dominick in the said will named they being first duly sworn well and faithfully to administer the same and to make and exhibit a true and perfect inventory of all and singular the said good chattels and credits and also to render a just and true account thereof when thereunto required.

In Testimony whereof we have caused the seal of Office of our said Surrogate to be hereunto affixed. Witness William Mann Esquire Surrogate of the said County at Schoharie aforesaid the thirtieth day of September in the year of our Lord one thousand eight hundred and twenty two and of our independence the forty seventh.
