The Last Will and Testament of Jacob Coons

Schoharie County, NY, Will Book U, Pages 189-191

In the name of God, Amen - I Jacob Coons of the town of Broome in the County of Schoharie and State of New York of the age of sixty years and being of sound mind and memory, do make publish and declare this my last will and testament in manner following that is to say

First - I give and bequeath to my wife Margarit all my real and personal property as long as she lives if she remains my widow, and after the death of my wife Margarit I do further order, that after the death of my wife that my two sons Henry Coons and Albert Coons shall have all the real and personal property that may be left after the death of my said wife, to them their heirs and assigns - said real estate consisting of about seventy five acres known as the homestead lot, and the lot that Albert Coons now resides upon also about eight or ten acres of land on Bayards Paten adjoining William Coons lot and Polly Shadducks lot in the town of Fulton. Said lot known as the Clover lot. I do further order that my Grand daughter Martha Coons shale have one cow when she becomes eighteen years old if she remains with my wife. My wife to control and have management of all the above mentioned property, goods and effects as long as she lives if she remains my widow. If she should get married again, then the property to revert as above directed to my two sons. I do truly constitute nominate and appoint Seymour Somborger my sole executor of this my last will and testament hereby revoking all former wills by me made. In witnefs whereof I have hereunto set my hand and seal this first day of April in the year of our Lord one thousand eight hundred and fifty six.

The above instrument consisting of one sheet was at the date thereof signed sealed published and declared by the said Jacob Coons as and for his last will and testament in presence of us who at his request, and in the presence of each other have subscribed our names as witnefses thereto.

Schoharie County Surrogate Court } In the matter of proving the last will and testament of Jacob Coons late of Broome deceased

Schoharie County fs. Seymour Somborger and John Bresee of the town of Broome in the County of Schoharie being just duly sworn in open court do depose and say that they are subscribing witnefses to the last will and testament of Jacob Coons late of the town of Broome in the County of Schoharie deceased. Deponents further say that the said Jacob Coons the said testator did in the presence of these deponents subscribe his name at the end of the instrument, which is now shown & exhibited to these deponents and which bears date on the first day of April in the year of our Lord one thousand eight hundred and fifty six. Deponents further say that the said Jacob Coons, the said testator, did at the said time of subscribing his name as aforesaid at the end of the said will declare the said instrument so subscribed and now exhibited to be his last will and testament, and deponents did then upon subscribe their names to the said will as attesting witnefses thereto at the end of the said will, at the request, and in the presence of the said testator and of each other, and of the other subscribing witnefs thereto. Deponents further say that at the said time when the said testator subscribed his name to the said last will as aforesaid, and at the time of these deponents subscribing their names as attesting witnefses thereto as aforesaid, the said Jacob Coons was of sound mind and memory, of full age to execute a will of real estate, and was not under any restraint to the knowledge information or belief of these deponents, and further these deponents say not.

I Lyman Sanford, County Judge of said county do hereby certify that the preceding is a true and perfect accord of the last will and testament of Jacob Coons late of the town of Broome, Schoharie County deceased, and of the proofs and examinations taken in relation to the execution and validity there of, at the time the said will was duly proven in open court, pursuant to law, and the same is truly recorded as a will of both real and personal estate.
