Will of Howland Sherman 

In the name of God amen I Howland Shearman of the town of Summit in the count of Schoharie and the state of New York being of sound and disposing mind and memory do hereby make, publish and declare my last will and testament in manner following.

FIRST

I order and direct my executors herein after named pay all my just debts and funeral charges as soon after my decease as maybe.

SECOND

I give and bequeath to my son Samuel R Shearman the use, rents and occupation during his lifetime of all that piece or parcel of land supposed to be fifty acres be the same more or less situated in the town of Summit in the county of Schoharie and state of New York. It being the same land on which the said Samuel R Shearman now lives and occupies. Said land lying in the southeast corner of the farm I bought of Amos Rider in the year 1835, bounded as follows, north and west on lands of Humphrey Witbeck, south on lands of Edward V Wharton, east partly on lands of John Warners son and partly on lands of Jonah and Enos Westover and at the decease of the said Samuel R Shearman I give and bequeath the afore said lands to the lawful children of this said Samuel R Shearman to be divided equally, share and share between them. I also give and bequeath unto the said Samuel R Shearman all and singular my wearing apparel together with my Blacksmith tools. To Howland the son of Samuel R Shearman I give my gun.

THIRD

I give and bequeath to my daughter Ann Shearman all her wearing apparel, beds and bedding furniture and plate consisting of silver table and teaspoons.

FOURTH

I give and bequeath unto my daughter Isabel Belinda wife of Humphrey Witbeck all and singular her wearing apparel, beds and bedding.

FIFTH

I do hereby order and direct authorize and empower my executors herein named to sell and dispose of all the rest and residue of my estate real and personal and upon the sale of each and every portion of my real estate to execute and deliver to the purchaser or purchasers good and sufficient deeds or conveyances as I could in my life time give or do.

SIXTH

After the sale of the residue of my estate real and personal I hereby order and direct my executors herein after named as soon as may be to make equal distributions of the residue of the sale of my real and personal estate between all my daughters, have and have alike as follows to wit; to my daughter Ann one share to my daughter Isabel Belinda wife of Humphrey Witbeck one share, to my daughter Delana wife of Reuben Baker one share, to my daughter Ruth wife of Jacob Baker one share, to my daughter Sylpha wife of Eleazer Osborn one share, to my daughter Jane Ann wife of Stephen Osborn one share, to my daughter Althena wife of Aaron Garrison one share, to my daughter Perlina wife of Hiram Warner one share, to my daughter Betsy wife of Quartus Markham one share.

SEVENTH

I do hereby nominate and appoint my son in law John I Van Epps also my son in law Humphrey Witbeck and my daughter Ann Shearman Executors to this my last will and testament and do hereby expressly revoke all and every former will by me, made in witness where of I -------set my name and seal this seventh day of February in the year of our lord one thousand eight hundred and forty two.
