The Last will and testament of Hilts Burton of the town of Carlisle, Schoharie County, New York.

I, Hilts Burton, considering the uncertainty of this mortal life and being of sound mind and memory, Blessed be the name Almighty God for the same, do make and publish this my last will and testament in manner and form following, that is to say,

First, I give, bequeath and devise to my beloved wife Mary M. Burton all and singular my real and personal property and estate together with all the appurtenances thereunto belonging to have and to hold the same forever subject to the provisions hereinafter contained:

Condition first She shall have the above bequests only so long as she shall be and remain my widow; Second, all my legal debts, funeral expenses executing this will etc. are also to be paid out of my property and estate. Third, my son Willard is to have the opportunity of a common school education out of my property and estate. Fourth, I give to my son Willard the equal one half of all my property and estate to be paid to him, his heirs and assigns when he shall attain to the age of twenty one years, subject also to the above named expenses. Fifth I hereby constitute & appoint my beloved wife Mary M. Burton, Fitch Vandervin? And Jacob Osterhout Executors of this my last will and testament and I hereby authorize and empower my said executors to sell all and singular my personal and real property and estate at public or private sale as in their best discretion may become necessary and proper.

In testimory whereof I have hereunto set my hand and seal this twenty fourth day of February in the year of our Lord one thousand eight hundred and sixth nine.

The above instrument consisting of one sheet was now here subscribed by the said Hilts Burton in the presence of each of us and was at the same time declared by him to be his last will and testament and we at his request and in his presence and in presence of each other sign our names as attesting witnesses.
