The last will and testament of George Rivenburgh
  Proved and recorded February 14th 1850, as a will
relating to both real and personal estate.
  The last will and testament of George Rivenburgh of
the town of Rensselaerville in the County of Albany
and state of New York.
  I George Rivenburgh considering the uncertainty of
this mortal life but being of sound mind and memory do
make and publish this my last will and testament in
manner and form following-
  That is to say I give and bequeath to my wife
Elizabeth Rivenburgh one cow, that is to say the
choice of one cow out of all the cows I may have at
the time of my decease. Also all the household
furniture, beds and bedding she brought to my house or
has since purchased with her own money. Also the
privilege of occupying the dwelling house on the
premises on which I now reside and as much of its barn
and other out houses as may be sufficient to store and
secure such crops or produce as may be raised on one
third of said farm.
  Secondly, I give and bequeath to my children Peter
Rivenburgh, Catharine Rivenburgh, Asa Rivenburgh,
James Rivenburgh, and Cornelius Rivenburgh each the
sum of one hundred and ten dollars, to make them equal
with what I have previously given my other children.
  Thirdly, I give and bequeath all the rest and residue
of all my real and personal property of whatever name
or nature after paying all my just debts and the
legacies above mentioned to my children Henry
Rivenburgh, Betsy Benjamin the wife of Henry Benjamin,
Jacob Rivenburgh, George Rivenburgh, William
Rivenburgh, Lanah VerMilya the wife of Livingston
VerMilya, John Rivenburgh, Peter Rivenburgh, Catharine
Rivenburgh, David Rivenburgh, James Rivenburgh and
Cornelius Rivenburgh to be equally divided between
them share and share alike, and I do hereby direct
that all notes of hand book account or other evidences
of debt which I may leave against any of my said
children shall be deducted from their respective
shares whether such notes or other evidences of debt
are out lawed or not. And it is further my will and
desire that my executors here in after named shall
take the money and the avails of the shares as given
above to my five children Peter Rivenburgh, Catharine
Rivenburgh, David Rivenburgh, James Rivenburgh and
Cornelius Rivenburgh and put it at interest with such
security as they may deem sufficient until such time
as they shall respectively arrive to the age of twenty
one years the interest to be paid annually which is
intended for their education and support and if
insufficient the balance to be charged to their
respective shares.
  And I do hereby appoint my son Henry Rivenburgh and
my son-in-law Henry Benjamin Executors of this my last
will and testament. In witness whereof, I have here
unto set my hand and seal this twenty fourth day of
June in the year of our Lord one thousand eight
hundred and forty six.

Signed, sealed, published and declared by this
testator to be his last will and testament in the
presence of the subscribing witnesses who signed the
same at his request, in his presence and in the
presence of each other.

  County of Albany Lewis M. Dayton of Rensseleaerville
in the county of Albany. John S.Huyck of
Rensseleaerville in the county of Albany being first
duly sworn in open court do depose and say and
testify, the deponent saith that he is a subscribing
witness to the instrument now shown to him purporting
to be the last will and testament of George Rivenburgh
of the town of Rensseleaerville in the county of
Albany that the said George Rivenburg did in the
presence of this deponent subscribe his name at the
end of this instrument which is now shown and
exhibited to this deponent as aforesaid, and which
bears date on the 24th day of June in the year of our
Lord one thousand eight hundred and forty six. And
this deponent further saith, that the said George
Rivenburgh the said testator did at the said time of
subscribing his name as aforesaid at the end of the
said will declare the said instrument so subscribed
and now exhibited to be his last will and testament
and this deponent did there upon subscribe his name at
the end of the said will as an attesting witness
thereto, and at the request of the said testator, and
this deponent further saith, that at the said time
when the said testator subscribed his name to the said
last will as aforesaid and at the time of the
deponents subscribing his name as an attesting witness
thereto as aforesaid the said George Rivenburgh was of
sound mind and memory, of full age to execute a will,
was not under any restraint to the knowledge,
information or belief and further these deponents say
not.
  Sworn and subscribed this 14th day of February 1850,
before me

  County of Albany
  Surrogate Court. I Lewis Benedict, Jr. Surrogate of
the county of Albany, do hereby, certify the foregoing
is a true record and copy of the last will and
testament of George Rivenburgh late of the town of
Rensselaerville in the county of Albany deceased,
propounded for probate and brought before me as a will
relating to both real and personal estate with the
proofs and examinations taken in relation thereto.
