WILL OF GIDEON HALLENBECK Schoharie County, NY, Will Book U, Pages 41-43 Last Will and Testament of Gideon Hallenbeck of the Town of Broome County of Schoharie and State of New York I Gideon Hallenbeck considering the uncertainty of the mortal life do make and publish this my last will and testament -- and forms following First: I give and bequeath and give unto my beloved mother Hannah Hallenbeck all my estate both real and personal of which I may - seized, to her use and behalf during her natural life. Second: It is my wish and desire , and hereby will and direct that my beloved sister Eliza Bear shall have a house with her beloved mother and share with her all my P estate to the extent that she may need, during her present widowhood. Third: At the expiration of year after the death of my mother I hereby will and direct that what shall be left of P estate shall be equally divided between my three brothers Peter, Nicholas, and Jacob Hallenbeck, and my above named sister Eliza and my nephew Orlando Hallenbeck son of my brother Jacob, the last named not to be paid to him until he shall become twenty one years of age the same to be kept at interest well secured in the hands of my Executors until that time. Fourth: I hereby will direct that my Executors hereinafter named shall have the entire controll and supervision of my estate to rent, let, sell or dispose there of for my mothers benefit, as they shall desire best under the circumstances as they may arise, to see the same be as of considered; or in any way disposed of by my mother to her - or the loss of any P estate - what is simply necessary for her support and comfort in health and in sickne�s should circumstances arise making it necessary in the judgement of my Executors to sell my real estate they may do so and give title for the same. Fifth: I hereby appoint and constitute my sister Eliza J Bear named above and my brother in law John Drake my executors to this my last will and testament hereby revoking all former wills by me made. subscribed Israel Drake Renselaerville Albany County N.Y. Schoharie County Surrogate Court. In the matter of proving the last will and testament of Gideon Hallenbeck deceased, Schoharie County LL Israel Drake and and Jane Drake of Renselaerville in the County of Albany being first duly sworn in open Court do depose and say that they are subscribing witne�ses to the last will and testament of Gideon Hallenbeck late of the town of Broome in the County of Schoharie deceased. Deponents further say that the said Gideon Hallenbeck, the said testator did in the presence of these deponents subscribe his name at the end of the instrument which is now shown and exhibited to these deponents and which purports to be the last will and testament of the said Gideon Hallenbeck, and which bears date on the eighth day of march in the year of our Lord one thousand eight hundred and fifty-one. Deponents further say that the said Gideon Hallenbeck the said testator did at the time of subscribing his name as aforesaid, at the end of the said will, declare the said instrument so subscribed, and now exhibited to be his last will and testament, and deponents did thereupon subscribe their names to the said will as attesting witne�ses thereto at the end of the said will at the request of the said testator, and in the presence of each other. Deponents further say that the said time when the said testator subscribed his name to the last will as aforesaid, and at the time of these deponents subscribing their names as attesting witne�ses as aforesaid the said Gideon Hallenbeck was of sound mind, and memory, of full age to execute a will of real estate and was not under any restraint to the knowledge, information, or belief of these deponents, and further these deponents say and subscribed and sworn this 5th day of October 1852.
