LAST WILL AND TESTAMENT OF ADAM OLIVER I Adam Oliver of Summit in the county of Schoharie do make, ordain and constitute this my last will and testament and first I give and bequeath to my wife Elenor all my estate both real and personal of every description during her natural life to remain in her possession without inventory until her decease after that, to be divided between my children in manner following, to Andrew W. Oliver and William Oliver, to Sarah Oliver, Betsey Oliver and Caty Oliver, the boys to have double the amount to the girls, except my debts to be paid and the legacy to be paid to Sara which was willed to her by Frederick Unger and also I give and bequeath to Frederick Snook my wife's youngest son one wright in the old homestead to him and his heirs forever and I give and bequeath to my wife's son John Snook one share as above on condition that he relenquish his claim on my estate of fifty dollars as an heir of Conrad Snook and my will is that three of my wife's children come in equal shares with my girls in the division of my estate and do make ordain and constitute John Snook and my son Andrew W. Oliver the soul executors of this my Last Will and testament. In witness whereof I have her unto set my hand and seal the tenth Day of January 1826. Chauncey State of New York Schoharie county ss: Be it remembered that on the twenty ninth day of July in the year of our Lord one thousand eight hundred twenty six personally appeared before William Mann Surrogate of the county of Schoharie aforesaid John A. Chauncy and Calvin Brookings two of the subscribing witnesses to the will of Adam Oliver late of the town of Summit in the said county, deceased, who being duly sworn, declared that they did see the said Adam Oliver deceased seal and execute the instrument hereunto annexed, and impressed with the seal of office of the said Surrogate, which said instrument purports to be the Last will and testament of the said Adam Oliver deceased bearing date the tenth day of January in the year of our Lord one thousand eight hundred and twenty six, that they heard him the said Adam Oliver publish and declare the same as and for his last will and testament, that at the time thereof he the said Adam Oliver was of sound disposing mind and memorry, to the best knowledge and belief of them the said deponents and that they together with Russell R. Chauncey the other witness to the said will did verbally subscribe their names thereto as witness in the presence of the testator and of each other. In testimony whereof, the said Surrogate hath hereunto set his hand and affixed his seal of office this twenty ninth day of July in the year of our Lord one thousand eight hundred and twenty six. Know It that at the town of Schoharie in the county of Schoharie on the twenty ninth day of July in the year of our Lord one thousand eight hundred and twenty six before me William Mann Esquire, Surrogate of our said county the Last Will and Testament of Adam Oliver deceased a copy whereof is hereunto annexed was proved and is now approved and allowed of by us and the said deceased having whilst he lived and at the time of his death goods, chattels or credits, within this state by means where of the proving and registering the said will and granting administration of all and singular the said goods, chattels and credits, and also the crediting, allowing and final discharging the account thereof doth belong unto us: The administration of all and singular the said goods, chattels and credits of the said deceased and any way concerning his will is granted unto John Snook and Andrew W. Oliver in the said Will named they being first duly sworn will and faithfully to administer the same and to make and exhibit a true and perfect inventory of all and singular the said goods, chattels and credits, and also to enter a just and true account thereof when thereunto required. In testimony whereof we have caused the seal of office of our said Surrogate to be hereunto affixed. William Mann Esquire Surrogate of said county of Schoharie aforesaid.
