The Last & Testament Will of Samuel Horton, dated May 18, 1863

     I, Samuel Horton, of the town of Carmel, Putnam County and State of New York, mindful of the uncertainties of human life, do make publish and declare, this my last will and testiment (sic), in manner following:

      First: After the payment of my just debts and funeral expenses, I give, devise and bequeath to my daughter, Elizabeth Augusta Horton, two good beds and bedding, one good cow and the sum of Eight Hundred and fifty ($850.00 ) Dollars.

      Second: I give and devise and bequeath to my daughter Julia Lounsberry, wife of James Lounsberry, the sum of five hundred and fifty $550.00 dollars.

      Third: I give devise and bequeath to my daughter, Mary Horton, the sum of four hundred and fifty ($450.00) dollars

      Fourth: I give and devise and bequeath to my daughter, Sarah Ann Bray, wife of Thomas Bray, the sum of five hundred and fifty ($550.00) dollars.

      Fifth: I give and devise and bequeath to my daughter, Eliza Jane Baily, wife of Ira Baily, the sum of five hundred and fifty ($550.00) dollars.

      Sixth: I give and devise and bequeath to my daughter, Susan Ann Heroy, wife of Charles Heroy, the sum of five hundred and fifty ($550.00) dollars.

      Seventh: I give and devise and bequeath to my son, Gilbert Horton, the sum of Seven hundred ($700.00) dollars.

      Eighth: After the above legacies are paid, all the rest, residue and remainder of all my estates, both real and personal, I give devise and bequeath to my sons, John L Horton, William Henry Horton, and Jackson Horton, to be equally divided between them and their heirs, share and share alike

      Ninth: I hereby appoint James D. Little, and my son, William Henry Horton, the executors of this my last will and testiment (sic), and hereby authorize and empower them, the said James D. Little and William Henry Horton, to compound, compromise and settle any claim or demand and which may be against or in favor of my said estate.

      In testimony whereof, I have hereunto set my hand and seal this 18th day of May in the year of our Lord one thousand eight hundred and sixty three.

Signed, published and declared by the said testator to be his last will and testiment (sic) in the presence of us who have signed our names at his request as witnesses in his presence, and in presence of each other.
