The Last Will & Testament of
Joseph Horton

The Original Will of Joseph Horton, deceased, filed 30 October 1820

     I Joseph Horton of Phillips in the County of Putnam & State of New York do this 7th day of October in the year of our Lord 1820, make and subscribe the following to be my Last Will and testament (Viz)
     & 1st I bequeath my soul to God who gave it. & my my (sic) body to be buried at the discretion of my executors hereafter to be mentioned.
     2nd after my debts funeral charges & expenses of setling (sic) my estate are paid, I give unto my beloved wife one third part of my estate during her natural life, & to have the house I now reside in included in her third & the land adjoining.
     3rd I give unto my son Samuel the house & land where he now dwells, together with the saw mill running with the road to the maple tree in a north east direction & from thence North to the old line. Also twenty acres of wood land on the west end of my farm to him and to his heirs and assigns forever, upon this express condition that my son Samuel pay unto my daughters Judah, Sarah, & Polly each fifty pounds making in the whole £150. within two years after my decease with interest after one year.
     4th I give unto Betsy Penny one feather bed and bedding with one good Cow.
     5th I give unto my son Elijah thirty acres of land on the south end of my farm to him & to his heirs and assigns forever.
     6th I give unto my four sons (viz) Joseph, James, William & Stephen, the remainder of my estate not already disposed of to them & to their heirs & assigns forever.
     And I do hereby appoint my Sons William & Stephen executors to this my last will & testament. In witness whereof I have here under my hand & Seal the day & date above mentioned.
