The Will of Peter BaddeauIn the name of God amen. Peter Baddeau [sic] of the Town of Carmel County of Putnam State of New York in perfect health and of sound mind(3) and memory except common infirmities of old age and not knowing how soon I may be deprived of these blessings and which it hath pleased God to favor me and considering the uncertainty of Life think it proper to write in health to dispose of the little property which I now possess in the manner as following. First I will that my lawful debts and funeral charges be paid within a convenient time after my decease and I give and bequeath to my beloved wife Elizabeth one hundred and twenty five dollars and also two beds and beding [sic] likewise two siting [sic] chairs. Likewise two chests, a brass ladle and shainen [sic] and water pot and saddle and bridle lume and tackling(1). Likewise a can and use for her property to dispose of at her good pleasure with the rise of all my Real Estate during the natural life and widowhood and thirdly the remainder of my property to be sold to the best advantage by my Executors hereafter named and the money arising therefrom when collected to be equally divided amongst my several children. VIZ. Peter Isaac John Elias Jacob William Isaiah and Catherine Magdalane Heroy and one equal share to the heirs of my son James Baddeau [sic] deceased. Equally divided amongst them forthly after the decease or second marriage of my wife Elizabeth. The remainder of my Estate to be sold by my Executors and the money divided in the manner the same proportion as above directed that this which [ I ] acknowledge to be my Last Will and Testament may be fulfilled or executed agreeable to my mind as made known above. I do hereby nominate and appoint my three sons: Isaac, Jacob, William Badeau my legal Executives to the same in witness here of I have set my hand and seal this eighteenth day of October one thousand and eight hundred and eleven signed sealed and delivered in presence of "resin" presence of the Testor. Signed sealed and acknowledged Peter Baddeau [sic] In the presence of Gedney Secor Lewis Curry Allan Secor Be it remembered that on the thirteenth day of September in one thousand and eight hundred and sixteen personally appeared before me Jacob Linet, Surrogate of the county, Allen Secor who on his own declared that he did see Peter Baddeau sign and seal the annexed written instrument reportedly to be the will of the said Peter Baddeau bearing the date eighteenth day of October one thousand and eight hundred and eleven and heard him publish and declare the same as and for his Last Will and Testament that at the time thereof he the said Peter Baddeau [sic] was of sound dishasing [disposing] (2) mind and memory to the best of the knowledge and belief of him the said Allen Secor and that Gedney Secor Lewis Curry and this despondent severally subscribed the will and witness thereto in the Testors presence. "Being of sound and dishasing mind and memory and being desirous to settle worldly affairs while I have strength to do…" http://millennium.fortunecity.com/sherwood/553/price/tsprice_will.html (3)"Being of sound and disposing mind and memory" — A disposing memory is understood to be one which is capable of recalling to the testator's own view all his estate and all the persons who naturally and properly would partake under his disposition of it.
