Deed from Lewis Turner & wife to Clark A. Graves

This Indenture made this sixteenth day of January in the year of our Lord one thousand eight hundred and seventy five between Lewis Turner and Sophia Turner his wife of Scriba in the county of Oswego and State of New York of the first part and Clark A. Graves of town county and State aforesaid of the second part.  Witnesseth that the said party of the first part in consideration of the sum of eight hundred dollars to them duly paid hath sold and by these presents do grant and convey to the said party of the second part his heirs and assigns all that tract or parcel of land situate in the town of Scriba aforesaid Township No. 18 of Scriba’s Patent and a part of lot No 79 bounded & described as follows:  Beginning at a stake and stone at the north east corner of said lot No. 79 from thence south 3o 30 min west, 6 chains 33 links to the center of a stone wall in the east line of said lot thence north 86o 30 min west 12 chains 80 links to a stake thence north 3o east 6 chains 40 links to a stake standing in the north line of said lot thensce south 86o 30’min, east 12 chains 64 links to the place of beginning containing eight and eight one hundreths acres of land.  It is agreed and understood that the party of the second part his heirs and assigns shall make and maintain a good and sufficient fence on the west bounds of the above described piece of land during the natural life of the party of the first part.  The party of the first part agrees to pay the party of the second part 50 cents for each rod of said fence to extend from the southwest corner one half the whole length of said west line with the appurtenances and all the estate title and interest therein of the said party of the first part.  And the said Lewis Turner and Sophia Turner parties of the first part doth hereby covenant and agree to and with the said party of the second part his heirs and assigns that the premises thus conveyed in the quiet and peaceable possession of the said party of the second part his heirs and assigns they will forever Warrant and Defend against any person whomsoever lawfully claiming the same or any part thereof.  In witness whereof the parties ofthe first part hath hereunto set their hands and seals the day and year first above written

Sealed and delivered in presence of Clark A. Graves

State of New York Oswego County  ss.  On this 16th day of January in the year one thousand eight hundred and seventy-four before me the subscriber personally appeared Lewis Turner and Sophia his wife to me known to be same persons described in and who executed the within instrument and severally acknowledged that they executed the same and the said Sophia Turner on a private examination by me apart from her said husband acknowledged that she executed the same freely and without any fear or compulsion of her said husband.

For Value received and other valuable consideration I Rebecca Ann Turner formerly Rebeca (sic) Ann Bachelor heir at law of Rebecca Quackenboss do hereby sell assign and transfer all over to Eliza Caroline Bachelder (sic) all my right title,  any interest to and in the will made and executed by said Rebecca Quackenboss on the eleventh day of June, Eighteen hundred and thirty,  a copy of which is hereunto attached and authorize and impower the said Eliza Caroline Batchhelder or her heirs or assigns in any name or otherwise to claim demand receive and enjoy all the avails and advantages derivable from or secured to me by virtue of the bequests to me made and secured to me in said will to have and hold the same to her own proper use and benefit provided and this assignment is on the express condition that the said Eliza Caroline Batcheldor (sic)is out to have the benefit or any of the advantages of this assignment until the decease of William L. Batcheldor (sic) and it is further agreed that if a certain agreement made between the town of Scriba of the first part and Silcia (?) Churches of the same place at the second part made the 7th day of March 1863 for the _____________ of said William F. Batcheldon (sic) then this assignment is absolute other wise null and void.  Witness my hand and seal thisday of March 1863.

Oswego County }ss     On this 14th day of March 1863 before me personally appended Rebecca Ann Turner known to me to be the same person who made and executed the above assignment and acknowledged that she executed executed the same .

NOTE:  It would appear that the spelling of Bachelor, Bachelder, Bacheldon seems to have been variable spellings of the same name.  Jan Turner.
