Be it remembered that heretofor to wit, on the 9th day of July A.D. 1849, Freeman HANCOCK, executor named in the last will and testament of Jacob SPRINGSTED, late of Granby, deceased appeared in open court before O.H. WHITNEY, County Judge of the County of Oswego and made application to have the said last will and testament proved, which relates to real and personal estate and on such application the county judge did ascertain by satisfactory evidence who were the widow, heirs and next of kin of the said belated & their respective residences. And some of them appearing to be minors having no guardian. A special guardian to take care of them was duly appointed by an order interest for that purpose by said judge. And said judge did thereupon issue a citation in due form of law directing to same widow & heirs & next of kin & special guardian by their respective relationship and respective residences, requiring them to appear in court before said Judge at the Fulton House in Fulton on the 7th day of August then next, to attend the probate of said will. And afterwards to wit, on the said 7th day of August, satisfactory evidence by affidavit was made to said judge of the service of said citation. And on that day no one appeared to oppose such privileges were therefore held afterwards, that the said judge too the proof of the said will, hereinafter set forth and adjudged the said will as valid & established as a will of real & personal estate and the proofs thereof to be sufficient, which said will and proofs are as follows. That is to say:

Know all men by these presence that I, Jacob SPRINGSTED of the town of Granby in the county of Oswego and state of New York, farmer, considering the uncertainty of this life and being of sound mind and memory, do make declare and publish this my last will and testament.

I give and bequeath unto my beloved wife Charlotte in lieu of her right of …… the use, improvement and income of our equal undivided half of my dwelling house and one equal undivided third of the barn, also the use of one equal undivided third of my farm during her natural life. And my household furniture, excepting the following articles, to wit: the … cherry table, two featherbeds and pillows and ….. and all the books. I also give and bequeath to her one half of all the poultry, on red gearling steer, one cow called the dairy cow, five pigs and … & two lambs.

Second. I give and bequeath to my son Warren W. SPRINGSTED, one equal undivided half of my dwelling house, one equal undivided third of the barn and other out houses, and one equal undivided third of my farm. I also give and bequeath onto him the cherry table above mentioned, one featherbed, pillows and bedstead (his name is marked on it) and by his mother, and one equal half of the books and one said pig.

Third. I give and bequeath to my son Freeman H. SPRINGSTED one equal undivided third of my farm, on equal undivided third of the barn and other out houses and one featherbed, pillows and bedstead, his name being marked on the bed by his mother and one equal half of the books and two ewes and one lamb. And I give and bequeath to him the residue of my personal estate after the debts are paid.

Fourth. I give and bequeath to my sons Warren W. and Freeman H., the residue of my real estate after the death of my wife.

Fifth. I give and bequeath to my wife Charlotte, one equal undivided half of the hog now fattening in the pen and I give and bequeath to my son Warren W. the other equal half of said hog.

Sixth. I do nominate and appoint Freeman HANCOCK & James D. LASHER to be executors of this my last will and testament.

In testimony whereof, I hereunto set my hand and seal and publish and declare this to be my last will and testament in presence of the witnesses named below this tenth day of June in the year of our Lord, one thousand eight hundred and forty nine.

Signed, sealed, declared and established by the said Jacob SPRINGSTED as & for his last will and testament in presence of us who at his request in his presence and in the presence of each other have subscribed our names as witnesses hereto.

In the matter of proving the last will and testament of Jacob SPRINGSTED, deceased.

Oswego County, ss:

Freeman HANCOCK of the town of Granby in said county being duly sworn and examined before Orla H. WHITNEY, county judge of Oswego county, doth depose and say that he received the instrument in witness bearing the date of the tenth day of June 1849, purporting to be the last will and testament of Jacob SPRINGSTED, deceased from the said Jacob SPRINGSTED immediately after he executed the same. That the said instrument remained in the said custody of this deponent until he brought the same to the office of the County Judge of aforesaid, where he deposited the same for probate, except that deponent handed the same to James D. LASHIER to carry to Fulton. And that the same was subscribed by deponent a few days thereafter. And that whilst the said instrument remained in the custody of this deponent or in the possession of the said James D. LASHIER, the same was in no respects altered or changed and further this deponent says not.
