Parents of James R. Smith
The parents of James R. Smith are not known.However, based on census records and maps, his father may have been John Smith.The 1820 Census shows a John Smith living in The Town of Richland, only 5 households from William Marsden. This William Marsden was the father of Rhoda and showed the presence of a female in the same age range as Rhoda.John Smith's family showed 2 males in the age range of James, 10 and under 16.While there are other Smith families in the general area, none is close and none has a male in the correct age bracket except 3 families several pages away.The heads of those households are Ezekiel, William, and Luther, none of whose names appear in the family of James and Rhoda (nor does John, for that matter).In the nearby Town of New Haven there is Soloman Smith Jr. with 3 males of the correct age group, but again there is the distance factor.
Inviting to the conclusion that the John near William Marsden is the father of James, is the fact that they are living in the Hamlet of Texas where Rhoda was born.Further, the later census records show James and Rhoda on their farm in the same vicinity, which leads to the inference that James took over the family homestead from his father.A map from 1854 shows 3 Marsden familieson the same road with J R Smith.The census confirms that J R is James R.The 1855 Census shows them 4 households away from William and Sarah Marsden, Rhoda's parents (NY Census, Town of Mexico, p 434).One might speculate that John was one of the sons of Solomon Smith in New Haven who had a son named John R. who died in October, 1823, near the Village of New Haven.
However, there are too many of this common name to have confidence that James R. could not have come from another Smith family, and the matter must be left for further verification.There are numerous Smiths in this part of Oswego County, and no other Smith has been found whose parents were born in the same place as James R's parents, which is said to be Massachusetts and Canada.
In reviewing the literature of the area, the nearby Town of New Haven has the early Smith family that might be a candidate for the parents of James R. Smith.The following sections are from the HISTORY OF OSWEGO COUNTY, published by L. H. Everts & Co. (Philadelphia, 1877).Note the use of the middle intial "R" for the son John, who could have moved the short distance to Texas and established the farm near the Marsdens.This John could have been the father of James R. NEW HAVEN.
THIS town was formed from Mexico as part of Oneida county, April 2, 1813, being the
ninth in age of the towns of Oswego County.The town as first formed corresponded
exactly to the old survey-township of Vera Cruz, the nineteenth township of Scriba's
patent.This, in addition to the present town of New Haven, had a tract half a mile wide
running along the lake-shore through to Richland. The reason for this curious
arrangement on the part of Mr. Scriba is not positively known, but was doubtless due to a
desire to dispose of Mexico, while retaining the harbor at the mouth of Salmon creek,
where he meant to build the city of Vera Cruz.In May, 1836, the strip in question,
comprising five lots, was annexed to Mexico, since which time New Haven has remained
at its present size.
The town borders on the lake, and in area is the smallest in the county, being five miles
cast and west, by five and three-fourths north and south.The surface is rolling, but
generally smooth and well improved, there being only about twenty-five acres of
non-resident land.
EARLY SETTLERS.
The first permanent settler of the town was Solomon Smith, who located on lot 47,
and built the first log house in town, near where David Russell now resides.He also put
up, in 1812, the first frame building, which is Mr. Russell's house, or a part of it. Soon
after the house was inclosed a dance was held in it, called a " house-warming," when a
grand time was had, Colonel Sherman Hosmer, now ninety years old, living in Mexico,
-being one of the party.Mr. Smith died in the town of which he was the first resident,
November 28, 1824, aged seventy-five.He had several sons, one of whom, John 11.,
was killed at the raising of Orris Hart's ashery, just east of the village, in October, 1823.
This ashery was a framed one; another had been built of logs some time before.
Another son of Mr. Smith was Jesse, who lived a long time in town, and died but a few
years since, over eighty years of age.The next settlers after Mr. Smith were Gardner
Wyman and Eleuzer Snow, who came from Eaton, Madison county, in 1804.__________________________________________________________________________
Sometime after 1860, James and Rhoda moved to the Town of Parish
near to the farm owned by William McCollum.Their children married.A
map in 1889 shows the location of the McCollum farm (by then owned by
son in law Hosea Pickens) and the nearby farm of Cynthia's brother, Charles
Husted.
James R. Smith left a will dated October 26, 1889, less than two
months before his death.He appointed E D Edick as executor/trustee
with the direction to sell his property, both real and personal, and to pay
all the proceeds, after debts and expenses, to his son, George W.Smith.
Noprovision was made for any of his other children, who were listed in the
petition for probate with their addresses.
The personal estate was inventoried with a total value of $113.93
and included such items as cash in his pocketbook of 2.02; augar and
chisels 1.15; old harness 2.00; fork & crowbar 7.15; one mare 58.00;
old bugey 8.00; and sleigh 10.50.The farm was not mentioned nor was
any other real estate.
The PULASKI DEMOCRAT, Vol 40, No. 17, Dec 19, 1889 reported
his death as follows:
"James R. Smith of this town was found dead in an outhouse on his
premises last Friday moring.That morning he was well as usual and ate a
hearty breakfast.He went out to take care of his horse ....Coroner Babcock
was summoned and empaneled a jury.Doctors Harter and Todd held a post
mortem and found he had died of (a heart attack) and the jury brought in a
verdict accordingly.He was 81 years of age and the father of Alfred Smith
(goes on to mention his life sentence without mention of any of his other
children).
There was no death certificate filed for James, apparently an oversight
after the coroner's proceeding.This was unfortunate as it should have given
the names of his parents.

Alfred R. Smith, great great uncle of compiler, was sentenced to a term of life imprisonment for second degree murder in Cuyahoga County in March 1887. Correspondence with the Archives/Library Division of the Ohio Historical Soc. yielded copies of the prison records and the fact of his having completed his sentence by dying in prison.The records revealed that he was a widower and listed his father and siblings, noting that his mother had died before he was sentenced.He was temperate, common school education, 5' 9", gray eyes, lt brown hair slightly gray mixed, and a fair complexion.No details of the crime were listed, but his "general appearance, marks, scars, etc." were quite suggestive: "Forehead high and straight Brows straight and approach

OHIO PENITENTIARY REGISTER OF PRISONERS AND INDEX, Vol 14, Dec 1886 -Feb 1889 (from Archives & Library Division, Ohio Historical Society, Columbus OH).
Entries from the Court of Common Pleas of Cuyahoga County show that Alfred was charged and tried before a jury of 12 men for Murder first degree, but the jury acquitted him of first degree and found him guilty of second degree.
Although the jury panel was called and the trial date was set on Jan 3rd, it was not until Jan 22nd that the court found that Alfred had no lawyer, "nor means or ability to procure counsel."Two lawyers were appointed and the jury selection for murder 1st began 5 days later.His appointed counselexhausted the 1st jury panel in the process of selection. The trial ran from Feb 4 to 17, 1887.
He was sentenced on March 29th, 1887, "at hard labor for and during the remainder of his natural life, and that he pay the costs of this prosecution. It is no part of this sentence that (he) be kept for any period of time in solitary confinement . . "
Research inquiries have failed to identify the victim of his crime nor any other details.However, Cuyahoga Coroner files show that an Althadine Smith, age 36, died 1-31-1886, and was murdered.The fact that Alfred was admitted to prison as a widower leads one to speculate that Althadine may have been his wife whom he killed.Requests for further information have not yielded the answer, but review of earlier research did.The Town Historian for Mexico, Os Co, sent a letter dated Oct 1995 in which she wrote: "From E. Simpson's Fact File Cards, Smith, Alfred R. married Aethadine Fish, on Dec 7 1865."Based on this, it is most reasonable to conclude that Aethadine was the wife of our Alfred, and most likely the victim of the crime for which he was convicted in Ohio.The census records give the spelling of her name as Althadine Fisk.
The book, History of Oswego County, New York, p. 276, lists Alfred R. Smith as having served in the 184th Infantry, enlisting September 1864, and the 1865 Census schedule of military personnel lists him as being a private in the 12 th NY Regiment. Althadine: Althadine is found in the typwritten index for the 1855 Town of Mexico Census.Her parents are found with her sister, age 1, in the 1850 Census, living 5 households from Alfred R. Smith and his parents.There is a W. Fisk shown in the Hamlet of Texas, not far from the same family.

They lived in New Haven in 1865 (Census Index p. 13). Perry: Identity of ____ Marsh as a second husband is from the listing of step children in Emily's obituary. His given name is from his death record by telephone call to Mexico Town Clerk, where informant was Emily Marsh.

Found among the effects of Flora MacCallum was a 2 1/2" by 4 1/2" piece of lined paper evidencing a loan of $50 by Chas M Smith to F E MacCallum MD which was cosigned by Mrs John Mac Callum and J Mac Callum.Interest was paid and it was marked "Paid in fullC M Smith" on the back.He was listed as from Dempster in his father's estate.
The 1900 Census lists a Charles Smith, b Aug 1840, wife Mary E. born Oct 1845, married 34 years (1866), with Mary the mother of one child, still living.His occupation was listed as a farmer and he owned his property free of mortgage.Both they and their parents were born in NY. (US Census 1900, Twn of Mexico, Oswego Co NY [Heritage Quest CD Rom T623/1143/Part1/179A]).
He served in the Civil War 1862-65 in the12th Calvary, was promoted to Corporal (History of Oswego; 1865 Census). _____________________________________________________________
The National Archives and Record Administration files show that Charles M. Smith applied for and received a pension under "soldier's certificate No. 922811" (Can No 18986, Bundle No 34).The title page of his papers lists his rank as Corpl with service in Co B12 NYCav. The promotion to Corporal occurred on June 30, 1864.His signatures on the various papers received from the NARA compare favorably with the signature on the note found among the papers from the MacCallum estate.
The NARA file contains several items of information, including the fact that Charles, " while on duty at New Bernie, N.C. on or about Fall of 1865 __ 1865, __ was disabled by deafness of both ears."He was treated at the Regimental Hospital.His service was from enrollment on August 29, 1862, to his honorable discharge on July 1, 1865 by reason of close of the war.The pension application was in 1895 when he listed three subsequent disabilities, being reumatism, kidney trouble, and disabled wrist.At that time he lived in Demster.Other papers included affidavits from others that attested to his infirmaties including the fact that his wrist was broken when he was doing carpentry work and fell off a ladder in January 1889.
Charles' personal information was that he 5' 8" with dark eyes and dark complexion.The family information includeda response to a questionaire in early 1915, listing his wife. maiden name not clear, but probably Mary E. Alderich, who was his only wife and who had died 4 years earlier, their marriage, and the single child, Frederick D. Smith of New Haven, Oswego Co NY.
The military records from the NARA show his various pay vouchers, his enlistment form, and cancellation of a desertion charge lodged against him when he did not appear for his final discharge.These records show his voluntary enlistment on August 21, 1862 at Oswego City NY, for aperiod of three years.He was transferred from Co A to Co B on May 20 1863 and was promoted to corporal on May 1, 1864.
The continuing muster rolls for Co. B, 12 Reg't N. Y. Calvary, show him "present" through June 1865, well after the end of the Civil War. Charles M. Smith, as he was always designated on the records, "Appear(ed) on Returns as follows: May 1865 On extraordinary duty on courier lines."Again, this was after the war ended.The next record, "Muster-out Roll" for Charles M. Smith, from Raleigh NC July 19, 1865, under remarks, states as follows: "deserted at Halifax NC,July 1 1865. Due US for one Sabre, Pistol & account ??? complete also carbine sling & swivel stolen Book mark: 3682 a (EB) 74."Another record in the materials states "NOTATION, Book mark: 3682 - a -1874, War Department AGO, Washington Dec 15, 1885. The charge of desertion of July 1, 1865 against this man is removed and he is discharged to date July 1, 1865 under the provisions of the act of Congress, approved July 5,1884. Discharge certificate furnished by War Department Dec 18, 1885. The notation of Jan. 31, 1884 is cancelled."
After the end of the war that many soldiers were either told they could go home and did, or were discharged from a medical facility. In the case of Charles M. Smith, he was a special courier just before the muster out and perhaps he was simply not present for the final call. The NARA did not send any copy of an application that he might have submitted to change charge of desertion so the official basis for the removal is not known.In any event, the supposed desertion was AFTER the war was OVER, and therefore not a desertion in the face of the enemy, and most likely it was an administrative problem that was later corrected. Certainly if there had been a serious problem, he never would have been awarded a pension in a later year. An actual desertion just before honorable discharge simply makes no sense what so ever, and at best was a shabby way to treat one who served honorably in such a horrible strife.

Mary: On the 1854 Map of Mexico there is found a C Aldrich living near Texas, a short distance from the Smiths, and another C Aldrich not far away in New Haven.A review of the 1860 Census for all of Oswego County revealed only one Aldrich family, with all its variant spellings, with a Mary who would have been born about 1845.That family was "G. and Julia Aldrich" from New Haven, and their daughter Mary aged 15.Later census reports give George and Julia as the same family.
