At the Surrogates Court held in and for the county of Onondaga at the Surrogates office in the city of Syracuse on the 26th day of June in the year of our Lord one thousand eight hundred sixty three.

Present, Samuel D. Luce, Surrogate

In the matter of proving the

last will and testament

of

Uriah Fish, deceased.

Onondaga County. ss. Be it remembered that heretofore upon the petition of Lovina Fish, the

executrix named in the last will and testament of Uriah Fish, late of the town of Otisco, in said county, deceased, for that purpose, to the Surrogate of said county, a citation was duly issued in this matter, which citation with the proofs of service thereof was thereafter duly returned to said Surrogate, and which said petition and citation, with the proofs of service thereof are now on file in the office of said Surrogate and therefore the last will and testament of the said Uriah Fish, deceased, with the proofs thereof were produced and are as follows, to wit:

The last Will and testament of Uriah Fish of the Town of Otisco, Onondaga County, State of New York.

I Uriah Fish being of sound mind and memory do make and publish this my last will and testament in manner and form following that is to say first I will and direct that all my just debts and funeral expenses shall be paid. Second I give and bequeath to my daughter Eliza Bishop the sum of one dollar. Third I give and bequeath to my daughter Louisa Wells the sum of one hundred. Fourth I give and bequeath to my sons Davis Fish, John Fish, Samuel Fish and Myndert Fish Each their heirs and assignees the sum of three hundred dollars each within six years after the decease of myself and wife Lovina Fish. Fifth and I do give and bequeath to my wife Lovina Fish the use of all the remainder of my real estate and I do further bequeath to my wife Lovina Fish all my personal property during her natural life to dispose of and do with as she pleases and after her demise do give and bequeath the said remainder of my estate both real and personal to my son Willis Fish and I do hereby appoint my wife Lovina Fish Executrix of this my last will and testament in witness whereof I have herewith set my hand and seal this third day of July one thousand eight hundred and fifty five. Signed sealed and published and declared by the above named Uriah Fish to be his last will and testament in the presence of us and each of us who have herewith subscribed our names as witness in the presence of the testator and at his request.

Onondaga County. ss. Pulaski Fellows of the Town of Onondaga being duly sworn and examined doth dispose and

say that he this deponent was well acquainted with Uriah Fish late of the town of Otisco in the county of Onondaga deceased. That this deponent was present as a witness to and did see he said Uriah Fish subscribe at the end thereof. The instrument was produced and shown to this deponent purposing to be the last will and treatment of the said deceased, bearing date the third day of July in the year of our Lord one thousand and eight hundred and fifty five. That the said testator, at the same time, declared the instrument so subscribed by him to be his last will and treatment. That therefore this deponent and John Davis subscribed their names at the end thereof as witnesses thereto at the request of the testator in his presence; and that the said testator, at the time of executing and publishing the said last will and testament, was of full age, of sound mind and memory, not under restraint, and was in all respects competent to devise real estate and to make a last will and testament.

Onondaga County. ss. John Davis of the Town of Onondaga being duly sworn and examined doth dispose and say that he

this deponent was well acquainted with Uriah Fish late of the town of Otisco in the county of Onondaga deceased. That this deponent was present as a witness to and did see he said Uriah Fish subscribe at the end thereof. The instrument was produced and shown to this deponent purposing to be the last will and treatment of the said deceased, bearing date the third day of July in the year of our Lord one thousand and eight hundred and fifty five. Recorded the preceding last will and testament of Uriah Fish, deceased, as a will of real and personal estate, together with the proofs thereof, taken and had in the court of the Surrogate of the county of Onondaga, which record is hereby signed and certified by me, pursuant to the provisions of the Revised Statutes, this 26 day of June A.D. 1863.
