Simeon D. Sencerbox, of East Fishkill, Dutchess County, New York, last will and
testament, 29 December 1857, [d. 3 April 1859], gives all land, real and personal Estate to wife Phebe. Within one year of Phebe's decease, all said Estate to be sold except "wood and cleared land on the [Fishkill] Mountain owned in partnership with Oscar H. Tapping". Proceeds from sale to be divided among children as follows: sons Henry H. [of East Fishkill], five hundred dollars, and land referenced above; John G., [of Brooklyn, L. I.] two hundred dollars; Charles E. [of St. Paul, Minn.], five hundred dollars, and Jarvis W. [of Shakopee, Scott Co., Minn.] five hundred dollars. Daughters: Maria Antoinett [of East Fishkill], fifty dollars, Jane Rogers [wife of Laban, of Beekman], one hundred fifty dollars. The balance of estate to be divided equally between sons Henry H. & John G. and daughters Maria Antoinette, Mary M. Phillips [wife of Wm, of East Fishkill], Catharine Seamen [wife of Joel, of Beekman], Jane Rogers and Susan Brush [wife of Agustus A., of East Fishkill].

Executors: sons Henry H. and John G.
Witnesses: Wm R. Kelly and Benjamin Seaman, both of East Fishkill.

In the name of God Amen. I Simeon D. Sencerbox of the town of East Fishkill County of Dutchess and State of New York do make publish and declare this my last Will & Testament as follows: After all my lawful debts and funeral expenses are paid, I give devise and bequeath to my loving wife Phebe during her natural life the use and occupation of the house and lands I now occupy in the village of Stormville. Also all the land and real Estate I am possessed of situated on and at the foot of the Fishkill Mountain adjoining the lands of Charles Ogden and Benjamin Hopkins, and all the real and personal Estate I am possessed of at the time of my decease, with my clothing household furniture and family books with the power for her to divide said clothing household furniture and family books as she may see fit at or before ["my" x'd out] her decease. Further if my Executors with the Consent of my wife should deem advisable during her lifetime to sell my lands at the foot of the Fishkill Mountain for their full valueation I do hereby authorise them to do so and invest the proceeds thereof upon Bond and mortgage security[?] the interest to be paid to my wife after paying all demands against my Estate After the decease of my wife I direct my Executors to sell all my real and personal property excepting the wood and
cleared land on the Mountain owned in partnership with

Oscar H. Tapping and to divide the proceeds thereof as follows within one year after her decease:
Unto my son Henry H. I give and bequeath the sum of five Hundred dollars, and my undivided half of a wood lot and land upon the Fishkill Mountain owned in partnership with Oscar H. Tappering. Unto my son John G. the sum of two Hundred dollars. Unto my son Charles E. the sum of five [hundred] dollars. Unto my son Jarvis W. the sum of five Hundred dollars provided he pays all notes dues and demands I have against him to my Executors. Unto my daughter Maria Antoinette the sum of fifty dollars. Unto my daughter Jane Rogers the sum of one hundred and fifty dollars. After paying the Legacies mentioned I direct the balance of my property to be divided equally between my sons Henry H. & John G. and my daughters Maria Antoinette, Mary M. Phillips, Catharine Seamen, Jane Rogers and Susan Brush. Likewise, I make, constitute and appoint my sons Henry H. and John G. executors to this my last Will and Testament hereby revoking all other Wills by me made.

In testimony whereof I have hereunto subscribed my name this Twenty ninth day of December in the year One Thousand Eight Hundred and Fifty Seven

The above instrument subscribed by the said Simeon D. Sencerbox was acknowledged by him to be subscribed by him to each of us, and he at the same time declared the instrument so subscribed ["be him" x'd out] to be his last Will & Testament and we at his request have subscribed our names as Witnesses thereto Wm R. Kelly residing in East Fishkill New York Benjamin Seaman residing in East Fishkill New York
