In the name of God amen, I Isaac Vail of the town of Fishkill, county of Dutchess and state of New York, farmer, being weak in body but of sound mind and memory (blessed be God) do this sixth day of July in the year of our Lord one thousand eight hundred and eight make and publish this my last will and testament in the manner following (that is to say):
First I give my negro boy Lewis aged ten years unto my son Joseph Vail and his heirs until the first day of May which will be in the year of our Lord one thousand eight hundred and twenty six, at which time it is my will that he be furnished with two good suits of clothes and be manumitted.
I give unto my son in law William R. VanVoorhis and to his heirs my negro boy Peter aged fifteen years until the first day of May which will be in the year of our Lord one thousand eight hundred and twenty one at which time it is my will that he be furnished with two good suits of clothes and be manumitted.
I give unto my grandson Isaac Vail VanVoorhis the choice of my horses immediately after my decease and the sum of five hundred dollars, to be paid one hundred dollars on the first day of January next and the remaining four hundred dollars when he arrives to the age of twenty one years. And should he die before he so becomes to be of age without lawful issue then it is my will that what ever may remain unpaid of the said five hundred dollars be then paid unto my daughter Rachael VanVoorhis or to her heirs.
I give unto my daughter Rachael, the wife of William R. VanVoorhis aforesaid the sum of five hundred dollars, two hundred and fifty of which to be paid to her or to her heirs on the first day of May which will be in the year of our Lord one thousand eight hundred and twelve and the remaining two hundred and fifty dollars to be paid to her or to her heirs on the first day of May which will be in the year of our Lord one thousand eight hundred and thirteen and all my household furniture which may remain after the death of my wife I give unto John Brookhout my wife's brother or to his heirs the sum of fifty dollars to be paid one year after my decease.
Unto my true and well beloved wife Hester I give the use of all that part of my dwelling house which I now occupy the use of two cows together with their keeping both summer and winter and convenient firewood to be furnished at her door during her remaining my widow. And all my household furniture and if she should need it for her maintenance the sum of thirty five dollars and twelve pounds of wool yearly during her natural life.
And I enjoin on my executor to pay all my lawful debts and funeral charges and to pay and perform all the bequests of this my last will and testament. And all the rest and residue of my goods, chattels and personal estate whatsoever I give unto my son Joseph Vail and to his heirs. And all my lands and tenements whatsoever whereof I shall die seized ? reversion or remainder I give unto my said son Joseph Vail his heirs and assigns forever.
And I make, constitute and ordain my son Joseph Vail, my son in law Will R. VanVoorhis and William Hughson my executors. In witness whereof I the said Isaac Vail have to this my last will and testament set my hand and seal the day and year first above written.

Signed sealed published and declared by the said testator as and for his last will and testament in the presence of us who at his request in his presence and in the presence of each other have subscribed as witnesses hereto our names. Samuel Robinson, Samuel Weed, James Vail.
Dutchess County. Be it remembered, that on the eighteenth day of October one thousand and eight hundred and eight, personally appeared before me James Tallmadge Jun. Surrogate of the said county by James Vail who on his oath declared that he did see Isaac Vail sign and seal the annexed written instrument purporting to be the will of the said Isaac Vail bearing date the sixth day of July one thousand eight hundred and eight and heard him publish and declare the same as and for his last will and testament. That at the time thereof he the said Isaac Vail was of sound disposing mind and memory, to the best of the knowledge and belief of him the deponent. And that this deponent Samuel Robinson and Samuel Weed severally subscribed the will as witnesses thereto in the testators presence. James Tallmadge Jun., Surrogate.
The people of the state of New York, by the grace of God free and independent: To all to whom these presents shall come or may concern send greeting:
Know ye that at Poughkeepsie in Dutchess county, on the eighteenth day of October in the year of our Lord one thousand eight hundred and eight before James Tallmadge Jun Esquire surrogate of our said county the last will and testament of Isaac Vail deceased (a copy whereof is hereunto annexed) was proved and is now approved and allowed of by us and the said deceased having whilst he lived and at the time of his death goods, chattels or credits within this state by means whereof the proving and registering the said will and the granting administration of all and singular the said goods, chattels and credits and also the auditing allowing and final discharging the account thereof doth belong unto us; the administration of all and singular the goods, chattels and credits of the said deceased and any way concerning his will is granted unto Joseph Vail and William Hughson two of the executors in the said will named, they being first duly sworn well and faithfully to administer the same and to make and e4xhibit a true and perfect inventory of all and singular the said goods, chattels and credits and also to render a just and true account thereof when thereunto required. In testimony whereof we have caused the seal of office of our said surrogate to be hereunto affixed. Witness James Tallmadge Jun Esquire surrogate of the said county at Poughkeepsie the eighteenth day of October in the year of our Lord one thousand eight hundred and eight and of our Independence the thirty third.
