Benjamin Seaman, of East Fishkill, Dutchess County, New York, last will and testament, 9 June 1860 [died 14 June 1860 per other docs in box 4986], gives all real and personal estate to executors Sutton Seaman and John Z. Homan. He directs the executors to give certain portions of this estate to wife Emiline and children Selina, Walter, Mary Elizabeth, Anna Frances and youngest child Ella Lorraine[?] all children unmarried and under the age of 21.Executors: Father Sutton Seaman and brother-in-law John Z. Homan.

Transcription:

In the name of God amen: I Benjamin Seaman of the town of East Fishkill in the County of Dutchess and State of New York being of sound mind and memory do make publish and declare this my last will and testament in manner following, that is to say. I give and devise all my real and personal estate of whatsoever nature or kind to Sutton Seaman and John Z. Homan the executors of this my last will and testament hereinafter nominated and appointed in trust for the payment of my just debts and for the purposes hereinafter mentioned or specified with power to sell and dispose of the same at public auction or at private sale at such time or times and upon such terms and in such manner as to them shall seem meet. And I do hereby direct that my executors hereinafter appointed shall after paying my just debts put the balance to use and apply the income & principal or so much as my be needed thereof from time to time to the support of my family & to the education and to give to my son Walter the sum of One Hundred dollars when he shall arrive at the age of twenty one years and that whatever property may be remaining when my youngest child Ella L arrives at the age of twenty one years be then applied or as much thereof as needed to the support of my wife Emiline and at her decease the balance be equally divided among my children Selina, Walter, Mary Elizabeth, Ella L. and Anna Frances, or if it be the choice of my wife Emiline when the aforesaid Ella Lorr-ine[?] at the age of Twenty one years my executors may divide the aforesaid property between my wife Emiline & my children above named according to their respective shares or right by legal distribution. And I do hereby dispose of & commit the [?] and custody of my children Selina, Walter, Mary Elizabeth, Ella L and Anna Frances and every of them for such time as they or any of them respectively continue unmarried and under the age of twenty one years unto my wife Emiline provided she remains my my [sic] widow, but if she die or marry during the single life and [?] of any of my children aforesaid I hereby dispose of and commit them tuition and custody to my executors hereinafter nominated and appoin-ted And lastly I do hereby nominate and appoint my father Sutton Seaman and my brotherinlaw John Z. Homan to be the executors of my last will and testament In witness whereof, I have hereunto set my hand and seal this ninth day of June in the year of our Lord one thousand eight hundred and sixty [Signature of] Benjamin Seaman

The above instrument consisting of one sheet of paper was at the date thereof signed, sealed, published and declared by the said Benjamin Seaman as and for his last will and testament in presence of us who at his request and in his presence and in the presence of each other have subscribed our names as witnesses thereto.
