This Indenture made the twelfth day of May in the year of our Lord one thousand eight hundred and nineteen Between Thomas Doughty of the town of Beekman in Dutchess County & State of New York of the one part and Ricketson Doughty of said Beekman of the other part Whereas Cyrus Benjamin & Rhoda his wife & Cyrus Gage & Mahala his wife of Fishkill in said Dutchess County did by a certain Indenture of Mortgage dated the first day of May in the year of our Lord one thousand eight hundred and seventeen for the consideration of the sum of one thousand dollars bargain and sell unto the said Thomas Doughty and to his heirs and assigns forever All that certain tract of land formerly owned by George & Isaac Van Aulst & bought by them of two of the heirs of the said George Van Aulst as assigned to them by the Commissioners & Court for that purpose laying in the town of Fishkill County and State aforesaid bounded and described as follows viz Beginning at a stump in the corner of the lands that Isaac Van Aulst sold to Cornelius I Luyster Also in the line of the Dewitt lands & a corner between the said Isaac Van Aulst & the said Benjamin & Gage thence along the line of said Isaac Van Aulst south eighty seven degrees east twenty nine chains & twenty links to the highway thence along the same north one degree & thirty minutes west six chains and twenty six links then north eighty degrees west twenty two chains & fifty links to the DeWitt line, then South thirty nine degrees west eleven chains & six links to the place of Beginning containing twenty one acres, two roods & sixteen perches of land be the same more or less. Together with all and singular the hereditements and appurtenances thereunto belonging To have and to hold the said granted and bargained premises with the appurtenance unto the said Thomas Doughty his heirs and assigns to the only proper use and behoof of the said Thomas Doughty his heirs and assigns forever. Provided nevertheless and the said Indenture of Mortgage was thereby declared to be upon condition that if the said Cyrus Benjamin & Cyrus Gage their heirs executors or administrators should well and truly pay unto the said Thomas Doughty his executors administrators or assigns the just and full sum of one thousand dollars in one year from the date thereof with interest from the date thereof according to the condition of a certain bond or writing obligatory bearing even date with the said Indenture of mortgage that then and in such case the said Indenture and the said writing obligatory should be void and of no effect And the said Cyrus Benjamin and Cyrus Gage did by the said Indenture for themselves their heirs and assigns agree with the said Thomas Doughty his heirs executors administrators and assigns that in case it should so happen that the said sum of one thousand dollars and the interest for the same should be due and unpaid at the time limited for the payment thereof in the whole or in part thereof that then it should and might be lawful for the said Thomas Doughty his heirs or assigns at any time after default in payment to bargain sell and dispose of the said mortgage premises and the appurtenances at public vendue and out of the monies to arise from the sale thereof to return and keep the said sum of one thousand dollars and the interest or so much thereof as might be due together with the costs and charges of such sale or sales rendering the overplus money if any to the said Cyrus Benjamin & Cyrus Gage their heirs executors administrators or assigns And whereas the said Cyrus Benjamin & Cyrus Gage did not pay to the said Thomas Doughty the said xxx sum money with the interest at the time limited for payment or at any time since and the said Thomas Doughty therefore in pursuance of the authority so given to him as aforesaid and according to the Statute in such case made and provided caused the premises to be advertised and sold at public auction and the same has been struck off to the said Robertson Doughty for the sum of six hundred dollars being the highest sum bid for the same Now therefore this indenture witnesseth that the said Thomas Doughty in pursuance of the power and statute aforesaid and also for and in consideration of the said sum of six hundred dollars to him in hand paid by the said Ricketson Doughty at and before the ensealing and delivery hereof the receipt whereof is hereby acknowledged has granted bargained aliened released and confirmed and by these presents does grant bargain sell alien release and confirm unto the said Ricketson Doughty and to his heirs and assigns forever All the farm piece or parcel of land above mentioned together with the hereditements and appurtenances as the same is described and conveyed by said Indenture of Mortgage and all the estate right title interest claim and demand at law and in equity of him the said Thomas Doughty and also of the said Cyrus Benjamin and Cyrus Gage as far forth as the said Thomas Doughty has power to grant and convey the same of in and to the premises and every part and parcel thereof To have and to hold the said above granted and bargained premises with the appurtenances unto the said Ricketson Doughty his heirs and assigns to the sole and only proper use and behoof of the said Ricketson Doughty his heirs and assigns forever. Dutchess County ss. On the twelfth day of May one thousand eight hundred and nineteen came before me Peter Cantine a Commissioner for taking the proof and acknowledgement of deeds &c. in and for said County the within named Thomas Doughty satisfactorily proven to me by the oath of Isaac T Doughty to be the same person described in and who has executed the within deed and ac-knowledged that he signed sealed and delivered the said Deed for the uses and purposes therein mentioned and having examined the same I find no alterations or interlineations therein all which I certify according to the Statute in such made and provided_ Peter Cantine
