Modern lot divisions of
Gerrard's Island. I know this isn't a historical document, but in
the light of ongoing events regarding taxes etc., I'm putting it here
for reference of anyone interested. North-south alignment is
estimated.
This is Henry McKenzie's petition for ownership of 45
acres on the island, reflected by lot 40028318 on the above map.
This petition was executed in 1895 and both that lot and the one for
William were already carved out as they still apparently are today.

of Gerrard's Island, Spry Bay
In the County of Halifax
Fisherman
Humbly Sheweth
that he is desirous of obtaining by purchase
45 acres of Crown Lands, situate as follows
on the eastern side of Gerrard's Island
and being the lot surveyed by James
F. Anderson on the 24. of Feby. 1871
In the County of Halifax
at the price of $20.00
That the said land is partially improved
and at present occupied by petitioner.
And as in duty

VICTORIA, by the
Grace of God, of the United Kingdom of Great Britain and
Ireland, Queen, Defender of the Faith.
To all to whom
these Presents shall come, Greeting:
KNOW YE, that We,
of our Special Grace, certain knowledge and mere motion have given and
granted, and do by these presents, for Us, Our Heirs and Successors,
in consideration of the sum of
twenty
dollars
to Us paid, give
and grant unto Henry McKenzie of Gerrard's Island,
Spry Bay, the County of Halifax, fisherman
a Lot of Land, containing 45
acres
situate, lying, and being in the county of Halifax
and bounded as follows: Between the western shore
of Spry Harbour
at a long granite rock lying at a south east angle
of 45 acres occupied by William B. McKenzie in the dist.
of Spry Bay thence running South sixty five degrees thirty
minutes west eleven chains and ninety links thence
south seventy-six degrees thirty minutes west four
chains thence south eleven degrees east forty chains
to a spruce tree standing on the shore thence northerly
by the shore at high water mark crossing a beach
connecting the lot under description with the point
marked to on the annexed plan to the place of beginning.

Public Road, which said lot is particularly marked
and described in the annexed plan; together with all hereditaments and
appurtenances whatever thereunto belonging or in anywise appertaining;
TO HAVE and to HOLD said Lot of Land and all and singular the premises
hereby granted, with their appurtenances, unto the said

Heirs and Assigns
forever, yielding and paying for same, to Us, Our Heirs and
Successors, one Peppercorn of yearly rent on the 25th day of March in
each year, or so soon thereafter as the same shall be lawfully
demanded; and WE do hereby SAVE and RESERVE to US, Our Heirs and
Successors, all singular the Mines of Gold, Silver, Coal, Iron, Tin,
Copper, Lead and Precious Stones and all beds and seams of Gold,
Silver, Coal, Iron, Tin, Copper, Lead and Precious Stones, in our
under the said Land, with full liberty at all times to search and dig
for, and carry away the same, and for that purpose to enter upon the
said Land, or any part thereof; and further reserving to Us, Our
Heirs, and Successors, the right of opening and completing any Road or
Roads through the same that may be found necessary to be made.
And further reserving all the rights, interests, claims, privileges,
easements, possessions and other liberties heretofore granted, leased
or licensed or hereafter to be granted, leased or licensed or in any
other manner conveyed, or intended so to be, to any and every person,
company or body corporate, their Successors, Executors, Administrators
or Assigns, in, to, upon, of, appertaining to, or in respect of all or
every Mining area, so heretofore granted, leased or licensed, or
hereafter to be granted, leased or licensed, for the purposes of
enabling such grantees, lessees, or licensees to dig up, search for,
win, and take all and singular the said minerals above reserved, under
and by virtue of the Statute of this Province, made, enacted,
consolidated, and now in force, touching and relating to the Mines and
Minerals thereof; and under and by virtue of all rules and regulations
now made, and which shall or may be hereafter made and published in
respect of the same, and under and in accordance with the covenants,
conditions, agreements, promises and stipulations in the said grants,
leases or licenses, made, contained and expressed; and further
reserving all rights, privileges, and easements heretofore granted by
Us, or lawfully acquired in, to, or upon the said Lands and premises.
Given under the
Great Seal of our said Province of Nova Scotia. Witness our
trusty and well beloved His Honor Malachy Bowes Daly, Esquire,
Lieutenant-Governor of Nova Scotia this fourth day
of September
in the fifty ninth year of our Reign, and in
the year of our Lord One Thousand Eight Hundred and Ninety-Five
