At Glasgow the 10th day og November 1853 years IN PRESENCE of Archibald Smith Esquire Commissary Depute of the shire of Lanark APPEARED Sarah Napier Blackie or Nisbet residing at four Steel Street of Glasgow widow of the deceased James Nisbet House Factor residing there who being solemnly sworn and examained DEPONES that the said James Nisbet her husband died upon the 23rd day of October 1853. That the Deponent has entered upon the prossession and management of the deceased's personal estate as the sole Executrix and universal legatory nominated and appointed to the deceased by his Holograph Deed of Settlement dated the 28th September 1853. and codicil there to dated 7th October 1853 which is now exhibited and signed by the Deponent and the said Archibald Smith as relative hereto. That the Deponent does not know of any Settlement or writing relative to the disposal of the deceased personal estate or effects or any part thereof other than that now exhibited. That the foregoing Inventory which is signed by the Deponent and the said Archibald Smith as relative hereto is a full and complete Inventory of the personal estate and effects of the said deceased James Nisbet wheresoever situated belonging or due to him beneficially at the time of his death so far as the same has come to the Deponents knowledge and that the Value of the said estate situated in Scotland is of the Value of �450 and upwards and under the value of Six Hundred pounds Sterling. All which is truth as the Deponent shall answer to God (signed) Sarah Nisbet Archd Smith C.D.

I James Nisbet House Factor in Glasgow being desirous to settle my affairs so as to prevent any question after my death. Do hereby nominate Constitute and appoint Sarah Napier Blackie or Nisbet my wife late my sole Executrix and universal Legatory under the burden of the provisions after mentioned. Leaving and bequeathing later the whole goods gear debts sum of money household furniture Bed and table linen together with all Jewellery gold and silver plate watches chains otherwise and all other moveables whatsoever that may pertain to be resting owing to me at the time of my death, with the whole vouchers and instructions there of and all that has followed or may be competent to follow thereon. And I farther do her by make constitute and appoint the said Sarah n Blackie or Nisbet late my sole Executrix and admininstrator giving granting assigning and disponing to and in favor of the said Sarah Napier Blackie or Nisbet as I hereby do with and under the provisions burdens reservations & stipulations aftermentioned Give Grant assign and dispone to and in favor of the said Sarah N Blackie or Nisbet All my sundry lands heritages goods and gears and in general my whole heritable and movable Estate and particularly and and without prejusdice to the said generality I do hereby specially assign convey and make over to my said Executix my whole right and interest in and to the Life Policy or Policy of Life Insurance upon my life or the contingency thereof for Four hundred and ninety nine pounds nineteen shillings All Insured in the Licensed Victuallars Company office being No. 2802 and dated second January eighteen hundred and forty nine. But this appointment and conveyance is made alwys with and under the burden of all my past and lawful debts, sick bed & funeral charges and the legacies herein after appointed to be paid or provided with full power to my said Executric and administrator to intromit with the whole of my said heritable & movable estate to give up Inventories there of confirm the same and generally everything in the premices to do competent town? Executor And I ordain my said Executrix shall after the liqidation of all debts out of the first and readiest of my means and estate depostit and secure in any safe Banking Coup? Office in Glasgow (for the time being) the sum of two hundred pounds sterling for and on behalf of my only daughter Sarah Nisbet which shall bye at interest for her behalf Alt she arrive at the age of seventeen years or should my said Executrix think proper she may loan the same out on sufficient heretable security as well as to advance the one half of the above sum to my said daughter (if needful) when or after she arrives at over fourteen years of age. (she was 4 at the time of his death 582 -200=382)
Secondly I appoint my said Executrix to secure and depostit in like manner the sum of one hundred pounds Sterling for and on behalf of my second son John Nisbet to lye at interest either in Bank or heritable security as above provided and to be paid over & accounted to him either on his attaining eighteen years of age or at his reaching majority as my said Executrix shall consider proper and who shall also exercise the same liberty of advancing to him on half of said sum after he attains the age of sixteen years; (he was almost 8 at the time of his death 382-100=282) Thirdly I ordain my said Executrix to secure and deposit in same manner and to lye at in all as above stated the sum of one hundred pounds Sterling for and on behalf of my eldest son James Nisbet Jun. and to be paid over to him when he reaches the age of majority. (he was almost 12 at the time of his death 282-100=182) But providing and in the case of the decease of either of these children before arriving at the age when they shall receive their respective shares above provided, then the same or what may be resting due branch? deceuser? shall be divided equally between the other has remaining children, or in the event of the previous death of any two of the children then the shares of both shall be added to that of the remaining child. But providing also farther that in the event of the death of these three children then the whole shares shall revert and belong to my said Executrix. Fourth & lastly I ordain and appoint my said Executrix to employ appropriate and apply the whole residue of my heritable and movable estate for and on her behalf and account together with the support and upbringing of the children ( 282� left after trust for children of which 75� would have been household goods) But especially Declaring that in the event of my said Wifes future marriage this ordination & appointment will then become void and null And in that case I appoint her Eldest Daughter Agnes Blackie and my sister Ann Nisbet to be executors and administrators here of in her room & stead. Conveying as i do hereby make over and convey (in such case) (or in case of the death of my said Executrix) to and in favor of the said Agnes Blackie & Ann Nisbet my whole Herstable? and movable Estate with all the powers priviledges ---? and under the whole burdens provisions and appointments as before expressed And to whom or either of them my said Executrix shall in that case be bound instantly to account, she being in that case of her marriage entitled and to receive only her Widows share or ??ice of my movable Estate reserving to myself and only my own liferent of the whole Estate and Effects heritable and movable real and personal above conveyed but slaso full power at any time of my life and even in death bed to alter innovate or remake these presents in whole or in part. Declaring that the same in so far as not revoked or altered by me shall be a valid and effectual Deed tho found lying in my own repositories or in the custody of any other person to whom i may intrust the same undelivered at the time of my death With the delivery where of i have dispensed and hereby do for ever dispense And I consent to the Registration hereof in the Banks of Council and Session or others competent for preservation and thereto Constitute
