Will of Aaron Deviny, recorded with the Rutherford, North Carolina Spring Court 1842: Book E, page 345. In the Name of God, Amen. I Aaron Deviny of the county of Rutherford and State of North Carolina Being of sound mind and memory Blessed be God for his mercies toward me Do this fifteenth day of February in the year of our Lord eighteen hundred and thirty-two make and publish this my last Will and Testament in the manner following viz 1st I recommend my soul to God who gave it and my body to be intered in a Christian like manner knowing that it is appointed for all men once to depart this life hoping still that at last day I shall be raised up with Him in Glory who is King of Kings and Lord of Lords, 2 I give and bequeath to my beloved wife Sarath the plantation I now live on together with a choice of all my household and kitchen furniture farming utentials sufficient for her to carry on business and live in decency the amount of which I allow herself and my Executors to judge and one horse creature her choice of my stock two cows and calves eight head of hogs her choice all my books and Fifty Dollars in money and one bed and furniture during her natural life at the Expiration of I want all of the above named land and property sold and equally divided among my Daughters except the books which I wish to be divided among my daughters 3 I give and bequeath to my Daughter Elizabeth Stuart and the heirs of her body the plantation on which she lives if she will take it at four hundred and fifty dollars and if not my will is that two good freeholders value it one to be taken by her and the other by my executors and if they cant agree to choose a third land to go in her part with the others 4th I give and bequeath to my son Robert Deviny one dollar to be paid him by my Executors. 4th I give and bequeath to my daughter Ann Deviny one horse creture worth sixty dollars or that much money over above her part with the rest of my daughters. 5 I give and bequeath to my son Robert Children hereafter named one child part to be equally divided among that is Jane Brackett, Wm Deviny, Joseph Deviny, Jenkins Deviny, Benjamin Deviny, Aaron J Deviny, Sarah Pruet, Robert Deviny. 5 I give and bequeath to my grandson Aaron D McFarland twenty-five dollars and also to my grandson Aaron D. Waters twenty-five dollars and also to Aaron Love twenty-five dollars also Aaron D. McFarland jun twenty-five dollars also Aaron D. Stuart twenty five dollars also Aaron T. Dunlap twenty five dollars to be paid them out of any moneys arising out of the sale of my estate as they come the age of 21 years. 6 My will is for my Executors to save money out of my estate to procure head stone for me and my wife Sarath Deviny. 6 My will is that all of my just debts be paid and all the rest of my land and other property I may die possessed of to be sold at reasonable credits and the money to be divided among my daughters equal after paying the above bequest one by one childs part to go to my son Robert children above named my understanding is the land I gave to Elizabeth Stuart is to go in her part if it runs over she is to pay back to the rest and if it dont amount to her share to be made equal with the rest my understanding is if any of my daughters die before me their part goes to their heirs now I ordain James McFarland and Aaron D McFarland hereto execute theis my last will and testament set my hand and seal this day and date above written signed and sealed and published and declared by the said Aaron Deviny the testator as his last will and testament in the presence of Wm.
