Following is the Last Will and Testament of Hon

  Following is the Last Will and Testament of Hon. George Hayward, 1792-1862, son of John and Chloe (Strange) Hayward.  He married Charlotte Upham Perley 27 Jan 1814. She was born about 1793 in Maugerville, Sunbury Co., daughter of Israel and Elizabeth (Moores) Perley. George and Charlotte lived in the Parish of Lincoln. He engaged in farming and lumbering. The Lower Lincoln Cemetery and the Fredericton Airport now occupy part of his farm. He took an active interest in the local militia and held the rank of Colonel. He was a Justice of the Peace; a Justice of the Inferior Court of Common Pleas for Sunbury County; a member of the New Brunswick Legislative Assembly for several years, and in Sept. 1852 was sworn in as a member of the Executive Council of N.B. and received the appointment of Minister Without Portfolio in the administration of Hon. J.R. Partelow; appointed a director of the Central Bank of New Brunswick, March 22, 1834; appointed a member of the Sunbury Steam Factory Company, a company formed for the purpose of erecting Steam Mills and necessary works for the manufacture of agricultural and other implements, May 1, 1854; and he had other interests.

  In the Name of God, Amen. I George Hayward of Lincoln in the County of Sunbury and Province of New Brunswick Esquire, being of sound mind memory and understanding Praise be to God for it and considering the certainty of Death and the uncertainty of the time thereof and to the end that I may be better prepared to leave this World whenever it shall please God to call me hence do make and declare this my last Will and Testament in manner following that is to say:

  First and principally I commend my soul into the hands of Almighty God my Creator hoping for free pardon and remifsion of all my sins and to enjoy Everlasting happinefs in His Heavenly Kingdom through the sole merits of Jesus Christ my Saviour; My body I commit to the earth to be decently buried at the discretion of my Executors hereinafter named. And as to such Worldly Estate wherewith it hath pleased God to intrust me I dispose of the same in the following manner, that is to say:

  Imprimus, My Farm in Monticello, State of Maine in the United States of America, I give and bequeath to my Brother John Hayward (being the Farm on which he now resides) to be held and enjoyed by him during his natural life and after the death of the said John Hayward to his wife Martha Hayward during her natural life should she survive him and after the death of both the said John Hayward and Martha his wife, I give and bequeath the said Farm to Bradford Davis Hayward the son of the Said John and Martha Hayward his Heirs and afsigns forever on condition that the said Bradford Davis Hayward do pay to his three sisters the sum of Two hundred dollars ($200) in manner following, that is to say to Charlotte Hayward Fowler wife of Gabriel Fowler the sum of seventy dollars, to Mary Ann Hayward and Cordelia Hayward Sixty five dollars each payable in three years after the death of the said John and Martha Hayward in three equal payments with Interest from the death of the said John and Martha and I do hereby charge the payment of the said sum of Two hundred dollars upon the said Farm.

  Item, I give and bequeath to my nieces Charlotte True Isabella True and Annie True the land I bought from my Father off the lower part of the farm lately owned and occupied by him fronting on the River Saint John twenty Rods in width from the river back to the present Highway and Fifteen Rods in width from the said Highway to the rear to have and to hold to them the said Charlotte, Isabella and Annie True their Heirs and assigns forever.

  Item, I give and bequeath all that part of the farm on which I now reside lying between the upper line of land conveyed by me to Edward Long and a small white maple tree standing between my upper Gate and the house I formerly lived in together with all Buildings and Improvements thereon unto George H. Perley (son of Moses H. and Jane Perley) his heirs and afsigns forever, saving and excepting out of this devise one acre and a half of land where the Burial Ground now is which I reserve as a Burial Ground for the River District in the Parish of Lincoln: I also give and bequeath unto the said George H. Perley his Heirs and afsigns a Lot of land on the Oromocto Island adjoining the eleven acres together with one half the Barn on the adjoining Lot.

   Item, I give and bequeath unto John H. True his heirs and afsigns all the remainder of the Farm on which I now reside Extending from the White Maple Tree above named to the Elm Tree on the front upon the following conditions, namely upon condition that the said John H. True do convey by deed of Bargain and Sale unto his Father Amos Perley True and his two Brothers George True and Charles True all his right and title to the Farm of the late John Hayward and do pay unto his three sisters Charlotte, Isabella and Annie True the sum of Fifty pounds each in four years after my decease by equal annual Installments of Twenty five percent each year.

  Item, I give and devise to Albert True his Heirs and assigns my upper Farm in Lincoln lying between Lands owned by John Mitchell and the Farm of the late John Hayward upon condition that he do convey by deed of Bargain and Sale unto his Father Amos Perley True and his two Brothers George True and Charles True all his right and title to the Farm of the late John Hayward and do pay to his sisters Charlotte, Isabella and Annie True the sum of Fifty pounds each in four years after my decease by four equal annual payments.

  Item, I give and bequeath unto my Sister in Law Sarah Perley the sum of Twenty pounds per annum during her natural life the same to be paid her by my Executors hereafter named and my will is that all the expenses attending the funeral of the said Sarah Perley after her decease be paid out of my Estate by my said Executors.

  Item, I give and bequeath unto the following persons namely George H. (son of Moses H. and Hepzibah Coburn), George H. (son of Thomas O. and Nancy Miles), Charlotte H. (daughter of George A. and Hannah Perley) and Charlotte H. (daughter of John and Martha Hayward), the sum of seventy five pounds each payable in equal annual Installments in one two three and four years after my decease or sooner if possible.

  To Sophia Helen and Alice Perley (daughters of George A. and Hannah Perley), the sum of fifty pounds each payable as above.

  To Clarifsa O'Leary (daughter of Daniel and Augusta O'Leary) ten pounds per annum for Five years.

  To Annie Taylor (Daughter of my late esteemed friend James Taylor Esquire) the sum of Twenty five pounds.

  To Augusta and Isabella (Daughters of Daniel and Amy Hayward) Twenty pounds each payable in four years by Equal annual Installments.

  To Mary wife of Robert Johnston, To Mary wife of Edward Long, To Augusta wife of Daniel O'Leary and to Fanny Banks widow of the late George Banks, the sum of Fifteen pounds Each payable in Two years after my decease.

  To Julia and Adiana daughters of Thomas O. and Nancy Miles the sum of fifty pounds each payable in four years by equal annual Installments.

  To Elizabeth McSheffery a faithful Servant Girl now living with me the sum of ten pounds, a Cow and a feather bed.

  I also give and bequeath unto Sarah Ann Nevers Widow of the late Charles Nevers during the term of her natural life the Lot of Land with the buildings thereon situate on the corner of Brunswick and Northumberland Streets in the City of Fredericton now held by me under Lease from the Corporation of Christ Church Fredericton.

  I further give and devise unto George Hayward Perley of the City of Saint John and Amos Perley True of Lincoln aforesaid my Executors hereinafter appointed their Heirs and afsigns all the rest residue and remainder of my Estate both Real and Personal to be by them sold and disposed of for the purpose of paying the Legacies and Bequests hereinbefore mentioned and also for the purpose of raising and investing in some secure manner the sum of one hundred pounds (100) in the name of Trustees to be for that purpose nominated by the said Executors, the interest of which said sum shall be applied and Expended annually in the Education of poor children in the river District of the said Parish of Lincoln and also for paying to a Resident Minister in the said River District of the Parish of Lincoln the sum of Ten pounds a year for five years.

  I also give and bequeath unto Francis A.H. Straton of Fredericton Esquire the sum of Ten pounds to be paid out of the proceeds of the said property by my said Executors.

  And I do hereby nominate and appoint the said George Hayward Perley and Amos Perley True the Executors of this my Will hereby revoking all former Wills by me made and I declare this to be my last Will and Testament.

  I make and publish this Codicil to my foregoing Will Namely - I give and bequeath unto George C. Nevers whatever Balance may be due on his Mortgage which I now hold. I also give and bequeath unto Samuel A. Nevers whatever Balance may be due on his Bond dated this Twelfth day of April A.D. one thousand eight hundred and sixty one.
