The State of Mississippi agreeable to an act of the Legislature of Tishomingo County authorized Peter G. Rives, A. M. Cowan, James McMathews, and James Davis to hold an election in Tishomingo County to elect five members to serve as police officers for said county. The election was held on the sixth and seventh days of May and William Graham, John Swain, John N. Alstadt, John Duncan, and David Bruton were elected police officers of Tishomingo County. They took the oath as follows:

            "You and each of you do solemnly swear that you will support the Constitution of the United States and the Constitution of Mississippi so long as we continue citizens thereof and faithfully discharge the duties of police officers and do equal justice to all parts of the county without favors or affections to the best of our knowledge, so help you God.

 

William Graham was duly elected president of said board.

 

John Reeves was appointed to act as clerk of the said court until a clerk be elected.

 

Ordered that an election be held on May 27 and 28 to elect the following county officers: Judge of Probate Court, Clerk of Probate Court, Clerk of Circuit Court, sheriff, coroner, surveyor, ranger, treasurer, and assessor and tax collector.

 

The residences of the following citizens were designated as voting places: John Woodard, H. B. Mitchell, Hiram Autrey, Nathan Jobe,[1] Alexander Wadsworth, Samuel C. Jones,[2] William P. Powell, Joshua Lindsey,[3] and Christopher Skillman. [4]

 

On the date of May 30, the board of police met and canvassed the returns and announced the following parties as having been duly elected to serve the new county until the next general election:

Hezekiah B. Mitchell and John Reeves subscribed to the oath of office as Judge and Clerk of the Probate Court and announced the court as ready for business.

 

 

June 1836

 

            

            The county was divided into five districts, the boundaries being defined a s follows

            "All that territory lying within the following bounds to compose the first district: Commencing at the northeast corner of township 3 of range 9, thence west with the said township line between townships 2 and 3 to the range line dividing ranges 7 and 8: thence south with the same to the township line between 4 and 5; thence east with the same to the line dividing ranges 9 and 10: thence north with the line dividing ranges 9 and 10 to the beginning."

 

            "The following to constitute the second district: Beginning at the southeast corner of township 2 of range 8, thence north with the line dividing ranges 8 and 9 to the State line; thence west with the same to the line dividing the counties of Tishomingo and Tippah; thence south with the same to township line dividing townships 3 and 4: thence east with the same to the line dividing ranges 7 and 8: thence north with the same to the township line dividing townships 2 and 3; thence east with the same to the beginning." [8]

 

 

            "Ordered by the court that the following bounds shall, constitute the third district: Beginning at the northeast corner of township 4 and range 7; thence west to the line dividing the counties of Tishomingo and Tippah: thence south with the same to the southwest corner of Tishomingo County; thence east with the same to the line dividing ranges 8 and 9: thence north with the same to the line dividing townships 4 and 5: thence west with the same to the line dividing ranges 7 and 8: thence north to the beginning.''

 

            "The following shall constitute the fourth district: Beginning at the northeast corner of township 5 of range 9; thence south with the same to the county line; thence east to the southeast corner of Tishomingo County; thence north with the said State line to the line dividing townships 3 and 4: thence west with the same to the line dividing townships 4 and 5; thence west with the same to the beginning."

           

"The following shall constitute the fifth district: Beginning at the southwest corner of township 3 of range 10; thence east with the same to the Alabama line; thence north to the Tennessee River; down the same to the Tennessee line: thence with the same to the line dividing ranges 8 and 9: thence south with the same to the line dividing townships 2 and 3; thence east to the line dividing ranges 9 and 10; thence south to the beginning."[9]

 

The court ordered an election to be held June 24 and 25 for the purpose of electing two Justices of the Peace and one Constable for each police district, the following places designated for voting: First district - at the house of John Reeves: second district - at the house of Lyddal B. Estes; third district - at the house of Joshua Lindsey; no polling place was selected for the fourth district-. fifth district at the house of Hiram Autrey

Members assembled to examine a suitable place for the county site.

 

Ordered that they meet on August 3 for the purpose of making a contract for the land to locate the county site and mark out said land and survey the same and the public square.

 

Ordered by the court that they receive as a donation to the county sixty acres of land donated by Armistead Barton as follows:

            "Beginning on a point and pine and blackjack pointer, 60 poles north and 80 poles east of the southwest corner of section 2, township 4, range 8 east; thence north 98 poles to post oak, and post oak and red oak pointers: thence east 98 poles to a stake, and post oak and blackjack and pine pointers; thence south 98 poles to a maple, and maple and willow pointers; thence 98 poles to the beginning."

 

Ordered that the land be surveyed on August 20 by Benjamin Sanders.

 

Court adjoined until August.

 

 

August 1836

 

 

Ordered that the county site be named Cincinnati, and that sale of lots of said town commence on October 11, 1836, until all lots are sold or sale stopped. A credit of one and two years to be given to all purchasers.

 

Ordered by the court that James Mackey, Caleb Lindsey, Abner Garner, Hiram Baker, Simon B. Knight, David Walker, and Francis Kizer a mark and review a road from the county seat west to the County line to connect with the road from Ripley to Memphis.

 

Ordered that Francis, Kizer be appointed overseer to open and cut a road from Roden's Creek as far as where a road leading from James Mackey's to Pontotoc crosses said review.

 

James Mackey appointed overseer to cut a road from near his residence to the county line with the following hands: James Hodges, Hiram Baker, Abner Garner, John Robertson, James Baker, Hezekiah Sims, Caleb Lindsey, John Nevels, Hubbart Robertson, and Henry Winters.

 

Conrad Rinehart appointed overseer to cut a road from Roden's Creek to Cincinnati, the county seat, with the following hands: John D. Roden, James Harris, Edward Kemp, William Prichett, Leroy Farmer, John A. Johnson, Samuel B. Reed, [11]Sherod White, John Jobe, [12]William Stephens, and John Payne.

 

Juries were appointed to locate roads from Cincinnati to the Tennessee River, from the southwestern corner of the county to the county seat, and from Cincinnati to the Alabama line.

 

Ordered that William B. Owens, sheriff of said county, be fined $5.00 per day for two days, for not attending on said board.

 

 

October 1836

 

 

Sale of lots of the county seat began.

 

Ordered that the name of the county seat be changed to Jacinto.

 

Ordered that a bridge be built across Tuscumbia River by H. H. Morris for $70.00.

 

Ordered that a courthouse be erected by Caleb Lindsey for $199.00, with the understanding that there will be no extras.

 

James Hamlin, deputy sheriff, appeared before the board and took the oath of office.

 

Stephen O. Gibbs was appointed as auctioneer to sell the lots in Jacinto to the highest bidders. The following people acquired property at the county seat:

John Fitch made application for a license to run and inn or tavern, which was granted upon the payment of $15, and the filing of an acceptable bond.

 

John and William Payne, with John Reeves as surety, were granted license to open an inn or tavern in Jacinto.

 

Benjamin J. Kizer and James Harris, with Terrill B. Phillips as surety, were granted a license to open an inn or tavern in Jacinto.

 

Samuel Morrow was appointed overseer to open and work a public road from the southwest corner of the county to Twenty‑Mile Creek.

 

William Lesley appointed overseer from Jacinto to the residence of Samuel Flake,[15] and Mr. Flake from there to Twenty-Mile Creek. The following hands were assigned to the new road: Thomas Lindsey, Alfred Lindsey, Benjamin J. Hampton,[16] Aaron Kennedy, Amos Hampton, William Lindsey, John Latham, William Latham, William Smith, Foster O'Neal, John A. Johnson, Jesse Williams, and James Latham.

 

Ordered that the remaining lots unsold in Jacinto be placed on sale January 18, 1837, and that the sale be advertised for two weeks in the PONTOTOC REGISTER, COLOMBUS REGISTER, and the JACKSON TRUTH TELLER.

 

William B. Owens, sheriff, released from the fines assessed at August meeting of the board.

Thomas Lindsay granted license to keep an inn or tavern at or near the place where he lives, his bond being signed by Caleb Lindsay [17] and James Hodges.

 

Samuel Duncan had his stock mark registered in the register office of said county.

Benjamin J. Kizer was awarded the contract to build a county astray perms in the, town of Jacinto for the sum of $14

 

 John Duncan appointed to go to Jackson and draw all the money coming to the county, or the three per cent fund. The board ordered that Duncan Be allowed‑the sum of one dollar per day while thus engaged.

 

M. B. Coble appointed overseer to open and keep in repair a road from Jacinto to the ferry on the Tennessee River with these hands:

Ordered that James Mickey be appointed overseer of the Ripley road and have the same bounds and the same hands as he had before in opening the said road and keep said road in good order for one year.

 

Ordered that David Walker be appointed overseer of that part of the Ripley road that Francis Kizer was overseer of and have the same hands and the same bonds and work two days every three months for the term of one year.

 

John Fitch, coroner, refused to give bond and security as required by law for his performance as sheriff. Stephen O. Gibbs was appointed deputy coroner, and after subscribing to the oath of office, filed his bond as sheriff until such time as the position could be filled by election.

 

Ordered the sheriff to hold an election on February 15 to elect a sheriff and one Constable and one Justice of the Peace for said county.

 

Ordered that Chisley D. Key, G. W. Harrison, and Thomas Pate be appointed Inspectors of Elections in Jacinto. Also, James Stafford, Allen H. Kemp, and James Hamlin at the house of John Duncan; Also, L. B. Estes, W. P. Powell, and Jacob Walker at the house of said Estes; At the house of H. Wiley, David W. Hyneman, William Marcumb, and Jesse Barnes; Also, at the house of Hiram Autreys, Benjamin Ballard, Samuel Dancer, and Mopes Johnson: Also, at the house of Nathan Jobe, John Thompson, William Cowen, and Mr. Moser; At the house of Joshua Lindsay, Samuel Flake, H. Lindsay, and Samuel Morrows.

 

The Board ordered that it did not think the courthouse built agreeable to contract, and, therefore, will not receive it.

 

 

February 1837

 

 

James H. Morgan registered his stock mark as a swallow fork on the right ear and a half cross in the left ear.

 

Moses Johnson elected sheriff; Mathew Gage, Justice of the Peace; and Valsane G. Latham, Constable.

 

After taking the oath of office, Moses Johnson filed a $4,000 bond, with the following named citizens as sureties: William Graham, James B. Merchant, George Williams, Sebern Jones, Peter Johnson, Moses Armor, John Duncan, David Bruton, John N. Alstadt, Elias Rinehart, and Wilson Winn.

 

William Hair granted authority to located a gristmill on Bridge Creek.

May 1837

 

 

Joseph Phillips registered his stock mark as a crop and split in the right ear and under the bit in the left ear.

 

Acknowledged the receipt of $2,000 paid by Joseph Carter to David Carter for his business and the following slaves, One woman by the name of Rachel, age 50; one man named Abraham, age 25; one man named Peter, age 23; and one girl named Violet, age 19.

 

James A. Knight elected Constable for the county of Tishomingo by the qualified electors of the first district.

 

William B. Payne elected Constable for the county of Tishomingo by the qualified electors of the third district.

Samuel Dancer contracted to build a bridge across Yellow Creek, on the Jacinto and Ripley road, and a committee was appointed to contract for the causewaying of the road across Tuscumbia bottom.

 

John Duncan, John Swain, David Bruton, and William Graham given county notes in full payment for their services as members of the board at $3 per day. John N. Alstadt was allowed the amount due him for like services as a credit on his notes for lots purchased in Jacinto.

 

John C. Carter, Wylie Belsher, James Harris, David Ross, and Lyddal B. Estes were elected members of the board for the next term. John C. Carter was elected president.

At the regular November election in 1839, John C. Carter, James H. Robertson, Wright Bonds, John Langley, and Robert H. Hicks were elected members of the board for the next two years. John C. Carter was chosen president.

 

 

January 1840

 

 

William Rushing, treasurer, gave a report showing unpaid notes in his hands for town lots in Jacinto amounting to $3,868.41: cash, $28.60; delinquent land tax, $172.80. In the three per cent fund, there were notes amounting to $5,268.13, and cash, $21.40.

 

Ordered that a county tax of 50% on the State tax, and a special tax equal to the county tax be levied on all the taxable property within the county of Tishomingo for the year 1840, and a poor tax of one‑fourth on the State tax.

 

Samuel Wiley, Stephen O. Gibbs, and William Bowens were appointed overseers of the poor for the year 1840.

 

Ordered that Samuel B. Reed, John Richardson, and Martin Savage be appointed commissioners to receive the causeway constructed in the Tuscumbia bottom on the Ripley road by Conrad Rinehart, and that they report to the next session of the Board.

 

Ordered that all those having notes in the county treasury for the 3% fund renew them for six months and pay the interest and 10% of the principal.
