Deed from Stephen N. Middleton

 to Edwin Worley

 


This Indenture made this twenty eighth day of December in the Year of Our Lord one thousand eight hundred and forty four between Stephen N. Middleton and Martha his wife of the County of Franklin State of Mississippi of the first part and Edwin Worley of the County and State aforesaid of the second part. Wenceforth that the said party of the first part for and in consideration of the sum of two hundred dollars to them in hand paid by the said party of the second part at and before the scaling and delivery of these present the receipt where of is hereby acknowledged have bargained sold aliened conveyed and confirmed and by these present do bargain sell alien convey and confirm unto the said party of the second part his heirs and assigns forever all of the following described tract or parcel of land to wit the North West quarter of the South East quarter of section thirty four in Township five Range two Fast containing thirty nine acres and fifty hundredths of an acre together with all and singular the improvements appurtenances and herditaments thereunto belonging or any wise appertaining to have and to hold the above described tract of land with the improvements and appurtenances, unto the said party of the second part his heirs and assigns forever and the said parties of the first part hereby covenant grant promise and agree that they will forever warrant and defend the letter to the law lands from the claim or claims of all and every person lawfully or equitably making claim thereto.

In testimony whereof the said Stephen N. Middleton and Martha his wife have hereunto set their hands and seals the day and year above written.

Know all Men by them Presents that J. Ransom Bunckley of the County of  Franklin State of Mississippi for a valuable consideration hereby assign all my right claim and interest both in law and equity in the land mentioned in the within and foregoing deed to Edwin Worley his heirs and assigns.

Franklin County

Personally appeared before me Wm. C.  Chamberlin, a Justice of the Peace of said County the within named Stephen N. Middleton & Martha his wife who each acknowledge that they Signed Sealed and delivered the within deed of their own free will and accord and for the purposes wherein mentioned and the said Martha Middleton being examined separately and apart Saith that she sign the same of her free will and accord without any threats or compulsion from her said husband the day and date within mentioned.

Personally appeared before me John P Stewart - Clerk of the Probate Court in and for said County the foregoing mentioned Ransom Bunckley and acknowledged that he signed scaled and delivered the foregoing assignment to Edwin Worley on the day and year within mentioned as his act and deed.
