GENERATION

48. RICHARD WOMACK was born between 1765 and 72 in Orange County, N.C. (later Caswell, Person). He died maybe (?) in St. Helena Parish, La. Richard settled in St. Helena Parish Louisiana, purchasing land adjoining his brother Col. Abner in 1809.

49. MARTHA _____ ? was born about 1775. She died in 1840. Martha Womack was granted land in Copiah Co. Ms. on 24 Dec. 1824, District of Choctaw E. Meridan

The following information has been taken from the Copiah County, MS records.

"This Indenture made this third day of January Eighteen hundred and thrity five between Abner P. Womack, Anastasia Womack his wife, and Martha Womack of Copiah County & State of Mississippi of the first part and Stephen H. Johnson of the County and State aforesaid of the second part Witnesseth, that the parties of the first part have this day for and in consideration of the sum of Two hundred & Fifty dollars to them in hand paid at and before the sealing and delivry of these presents the receipt whereof is hereby acknowledged Granted Bargained Sold and confirmed and by these presents do Grant Bragain Sell and confirm unto the said Stephen H. Johnson a certain track or parcel of Land lying and being in the County and State aforesaid Known and designated as follows ToWit, The East half of the North East quarter of Section 21 Township No. 10, Range No. 5 East containing Eighty acres be the same more or less to have and to hold the same together with all and singular the rights, preiliges, immunities and appurtenances unto the said Stephen H. Johnson his heirs and assigns in fee Simple forever and the Said Abner P. Womack; Anastasia Womack and Martha Womack a clear and indefeasible title in fee Simple in and to the said track or parcel of Land herin described and hereby conveyed unto the said Stephen H. Johnson his heirs and assigns will and do hereby for themselves their heirs and assigns against the claim or claims of all and every person claiming or to claim forever Warrent and defend In testimony hwereof the Party of the first part have hereunto Set their hands and Seals the day and Year first above written.

"The State of Mississippi ] Personally appeared before Copiah Co. ] the undersigned Justice of the Peace in and for said County Abner P. Womack Party to the foregoing Indenture who acknowledged that he Signed Sealed and delivered the same as their proper acts and deed for the purposees therein mention ed. Also appeared Anastasia Womack wife fo the said Abner P. Womack and party to the written Indenture who acknowledged that she Signed Sealed and delivered the same without any threats or compulsion on hte part of her husband as her proper act and deed for the purposes therin specified. Given under my hand this 6th day of January A. D. 1835.

Hohnson of the County and State afore said of the second part Witnesses That the said Abner P. Womack and Anastasia Womack his wife party of the first part have this day for and in Consideration of the Sum of Two Hundred and fifty dollars to them in hand paid at and before the Sealing a nd delivery of htese presents the receipt whereof is hereby acknowledged. Granted bargained Sold and confirmed and by htese presents do Grant bargain Sell and comfirm unto the said Stephen H. Hohnson party of hte Second part a certain track or parce l of Land lying and being in the County and State aforesaid Known and designated as follows Towit the west half of N. E. 1/4 of Section 21 Town Ship No. 10, Range No. 5 East containing Eighty acres be the same more or less To have and to hold the same to the said Stephen H. Johnson his heirs and assigns for their own proper use and behalf forever together with all and Singular and the right and title in fee Simple of hte track or parcel of Land herin before described and intended to be conveyed unto the said Stephen H. Johnson his heirs & assigns against the Claim or Claims of all and every person ofr persons Claiming or to Claim will and do hereby for themselves their heirs Executors Administrators and assigns forever warrent and defend.

Dancing Rabbit Creek Treaty of 1830) of Sept. 27, 1830 (7 Stat. 333), any Choctaw could remain in Miss. as a citizen of the United States and receive 160 acres of land by registering with the Indian Agent. The article further provided that persons claiming land in Ms. did not "lose the privilege of a Choctaw Citizen"

Copiah Co. Ms. Also 24 Dec. 1834 on 80.06 acres, next to her son Abner Pryor Womack.

child i. JACOB WOMACK was born about 1805.(32) He died in Sep 1857. A Jacob S. Womack mar: 14 Nov. 1826 Martha Lewis in Copiah Co. Miss. (?)
child ii. MALINDA MILDRED "MILLIE" WOMACK was born in 1805 in St. Helena Parish, La..(?) She died after 1870 in Texas. NOTE: Book by Carlos Womack, 1986, states that Mlldred mar: (1st) James Foster 20 April 1826 in Copiah Co. Miss. James died 1833. James Foster, half-Choctaw Indian- their children were eligible for benefits under the Choctaw Treaties, and are enrolled citizens of the Choctaw Nation in Ok.. "Millie" mar: (2nd) ca. 1835 Samuel McLendon. He died prior to 1870. She was living in Lamar Co., Tx, in 1870 with her Son-in-law Franklin. Marriage lic. signed by Abner Womack
child iii. ABNER PRYOR WOMACK was born on 5 May 1806 in GA.. (33) He died on 16 Jun 1893 in Morgan County, Tx..

child vi. WILLIAM M. WOMACK was born in 1815 in LA.. He died on 9 Dec 1878 in Jackson Parish, La..(34) He was buried in Womack Cemetery. NOTE: Book by Carlos Womack, 1986, states that William mar: Eleanor Goynes 3 Dec. 1836 in Copiah Co. Ms.

child viii. DANIEL WOMACK was born on 29 Mar 1823 in St. Helena Parish, La..
