husband112. JOHN MYERS (60) was born on 8 Sep 1775. He died in December of 1840 in LAWRENCE CO. MISS.. He was buried in JOHN MYERS CEM. E. OF NEW HEBRON MISS..

JOHN MYERS WILL:
In the name of God Amen, I John Myers of Lawrence County and state of Mississippi of sound mind and memory do make and ordain this my last will and testament in manner and form as followeth.

Item 1st: I give unto my son John Myers all the family of negrows known as Georges family, to wit, George and his wife Betsey and their children, namely Mary, Willis, Daniel, Ephraim, Alford, Freeman, and Elizor. I also give to him all the lands I own lying in the County of Lawrence and Simpson 2nd state of Mississippi lying on the waters of Silver Creek and known as my Mill Place and the land where I now live, containing five hundred and eighty acres of patented land and three hundred and twenty acres of the sixteenth section which I have on lease, be the same more or less, also fourteen eights of land lying in Scot County and state of Mississippi in Township five and Range six and seven lying on the waters of Strong river and entered at the Augustay (?) land office, known as My Plantation in Scot County on the Reed Brake tract of land containing eleven hundred and twenty acres of land, the same more or less. Also all the stock of cattle and hogs and provisions on or belonging to my said Scot Plantation, and it is my wish that none of the property that I have given to my son John Myers shall not be subject to a divisheon (?) amongst the balance of my heirs hereafter.

Item 2nd: I give unto my son Massey Myers four and one eights of land lying in Township five and Range ten and eleven east and entered at Augustay land office, containing three hundred and sixty acres of land, be the same more or less known as the Halford tract of land lying in the county of Newton and State of Mississippi.

Item 3rd: I give into my daughter Patsy Dow ten dollars in addition to a negrow woman and her two childring, to wit, Lucy and her childring Mary and Amamda, which negrows I now give to her during her natural life with there further increase and after her death to be equally divided amongst all her surviving childring or their legal representatives to them and there heirs forever, which said negrows are now in her possession.

Item 4th: I give into my son-in-law Silas Steene one negrow to wit, a woman named Viney which negrow is now in his possession.

Item 5th: I give unto my son-in-law Rece Davis one negrow to wit a woman named Anna which negrow is now in his possession. Said goods chattels and credits (?) which shall be found remaining on the accounts of said administrator, the same being first examined and allowed by the said court shall deliver and pay unto such persons respectively as are entitled to the same by law then this obligation to be void, otherwise to be and _________ in full.

Item 6th: I give unto my son James Myers ten dollars in addition to three eights of land which land I have heretofore deeded to him also four hundred and fifty dollars which I have already give him in cash.

Item 7th: I give unto my well beloved wife Frances Myers all the rest, remainder and residue of my property both real and personal, all money and effects whatsoever after paying all my just debts, all of which I give to her during her natural life and widowhood, then to be equally divided amongst my lawful heirs and it is my will and desire that my after named executor and executrix shall pay out of my effects the amount of money bequeathed to my son James Myers and my daughter Patsey Dow as soon as practicable after my death. And it is my wish and desire that my beloved wife shall live at the place where I now live and have the use and benefit of the property I have give to her during her natural life and widowhood, and it is my desire that my son John Myers shall have control of her affairs and protect her interest.

And lastly I constitute and appoint my son John Myers and my beloved wife Frances Myers executor and executrix of this my last will and testament.

In testimony whereof I hereunto set my hand and affixed my seal this the sixth day of December in the year of our Lord One Thousand Eight Hundred and Forty.

You do solemnly swear that you did see John Myers now deceased, sign seal and declare this writing to be his last will and testament, that you signed the same as witnesses in his presence and in the presence of each other and at his request and that you believed him to be of sound disposing mind and memory at the time of signing the same, so help you God.

Cemetery- John Myers

Location- Lawrence County, Mississippi, east of New Hebron, on Lonas Buckley's place, near Old Hebron Church, at Choctaw Boundary Line, south, Sec. 10, T 9, R 19.

NOTE: The following interesting information was obtained from an article on the old John Myers cemetery, written by Gerald Lord, which was in the August 20th, 1967 issue of the Clarion Ledger, a newspaper published in Jackson, Mississippi.

Buried in a deep, dark, secluded pine thicket in the rolling cattle country of south Mississippi, is an old family cemetery. Its weather-worn tombstones, mute reminders of days long forgotten, are scarcely discernable in the underbrush. Buried there, too, is the story of the glorious past of a big plantation hewed out of an unsettled wilderness by a well-to-do planter and his slave colony. Hannah Myers (b. 1740) was the mother of John Myers Sr. (b. 1775), who was one of two original settlers in what is now the New Hebron area, near the Jeff Davis-Lawrence County Line.

Three Myers brothers came in and settled the place right after it was opened up. One of the brothers died soon afterwards, and another one left, so that left only John Myers, Sr. The site of the Myers settlement was right in the heart of the Choctaw Indian Territory. The tribe must have been the Myers earliest neighbors, since the last Indian didn't leave until a century after the first white settlers moved in. There is supposedly an old Indian mound in the vicinity, but most of what is known about it is legendary. The great grandfather of Albert Slater (age 88 in 1967), now living in the area, was Thomas Bill Slater, the other original settler with John Myers Sr. He helped John Myers build the old Hebron Church back in 1822.

PETITION TO CONGRESS BY CITIZENS OF THE MISSISSIPPI TERRIROTY
25 August 1802
"We the undersigned, Citizens of the Mississippi Territory pray your Honorable Body that the Land Office to be Opened for this Country may be held within the Bounds of the same, and that the Actual Settlers on the Vacant lands of the United States, may have a pre-emption right Secured to them.

We further pray for the following alterations in the Ordinance of 1787, (To Wit) that the right of Suffrage may be extended to every male person, of full Age, being a Citizen of the United States, and who has had his residence within the Territory for the last Six Months preceding the election.

That all Officers of the Territorial Government shall be appointed by the Governor of the Territory, by and with the Advice and Consent of the Council.

That the Offices of Territorial Judges be Ablolished: And that the Appointment of all our Judicial Officers shall be Made by the Government, by and with the Advice and Consent of the Council: and that they shall be removable only by impeachment.

That the Members of the Legislative Council shall henceforth be Chosen at the same time, in the same manner and for the same Term, as the Members of the House of Representatives of this Territory.

These proposed Alterations in the Ordinance would remove some needless and inconvenient encroachments on our rights as American Citizens. They are suited to our local situation, far distant from our parent Government; and wou'd Obviate many serious evils under which we now Labor. We on our part therefore pray for thse Alterations, and we trust to the Justice and Goodness of the Government of the United States, for a Compliance on their part.
