Richard James (d. ca. 1685 Herring Creek Hundred, Anne Arundel Co.), Father of Mary James


Teague Tracy married Mary James 5 Nov 1694 in St. James Parish of Anne Arundel Co. Mary obtained this land from her father Richard James for an extract of his will is in Vol 2 of the Maryland Calendar of Wills and the will itself is in liber 4/folio 95 & 96 The will indicates that none of the five named daughters had obtained the age of 16 when the will was written. Therefore it appears, that Mary, the eldest, must have been born between 1669 and 1674. Thus she was like betwen 20 and 25 when she married Teague.


Richard James' will from the MSA reads:

"In Nomine Dei the Twelvth day of Janry An Dom 1684/5 I Richard James of Annarundall County in ye province of Maryland Plant. being sick and weak in body,but of perfect mind & memory (praise be to ye Almighty God do make this my last Will & Testament in manner and forme following-Simple I give and bequeath unto Elenor my beloved wife all the plantation I dwell on being Land for one hundred acres be it more or less during her natural life and after my said wifes decease it is my mind & will that my eldest daughter Mary, and to her heirs Execs and assigns for ever but if it shall my said eldest daughter Mary shall depart this natural life before she shall attaine to ye age of sixteene years or dye without heirs lawfully begotten of her body, that then it is my will and mind yt my said land and houses shall redowne unto my second daughter Sarah and her heirs for evr but if it shall that my second daughter decease be she attaine to age of sixteene years or without issue lawfully begotten of her body, thus it shall redowne unto my third daughter Martha and her heirs for ever, but if she shall dye before she shall attaine to ye full age of Sixteene years or without issue lawfully begotten of her body, for want of such issue it shall redowne and fall to my fourth daughter Rachel and her heirs, but for want of issue lawfully begotten of her body, then it shall fall and be right of my fifth daughter Deborah and her heirs for evr but for want of issue lawfully begotten of her body then to redowne unto my sixth daughter- Item I give and bequeath unto my eldest daughter Mary, one cow called by the name of whiteface with her increase of such cow calves as she shall bring during the time of her minority but all ye increase of ye male cowes shall be for maintainance of her & ye family untill she attaine to the age of sixteene years then they and their female increase to be delivered to her. Item I give and bequeath unto my second daughter Sarah my brown cow called by the name of Stagg and her female increase to be delivered unto her at ye age of Sixteene years but the increase in male calves to be for ye maintainance of my wife and children Item I give and bequeath unto my third daughter Martha my cow called by the name of beauty and her female increase to be delivered unto her att ye age of sixteene years buy ye male increase to be for ye maintainance of ye family. Item I give and bequeath unto my fourth daughter Rachell mt two cows cally Cherry and the other called Tandy and their increase of cow calves to be delivered unto her att ye age of sixteene years but their male increase to be for ye maintainance of ye family- Item I give and bequeath unto my fifth daughter Deborah my cow called pye and her female increase to be delivered unto her at ye age of Sixteene years, but ye male increase to be for ye maintainance of ye family - Item I give unto Mary Symons one browne heifer called by ye name of Dow Item I give unto Robert Orme one young Horse called Rock to be delivered unto them within three months after my decease. Item I desire yt all debts which of right I owe to any person be truly and honestly satisfied and paid by my Exec* hereafter named. I desire that Nehemiah Brickhead and Robert Orme to be vz overseers of this my will desiring heartily to take care to see my Legacies pformed according to this my last will and Testamt Item I give and bequeath unto my loving wife Elinor all ye rest and residue of my Estate psonall andtemporall Goods Chattles, Chattetts, household stuff and Implemts of household stuff wheresoevr they shall be found to belong of right to me and I make Exec* of this my last wi;; and Testamt In Witness my hand and Seale this day and year first above written

This will indicates that Richard James and Ellinor had 6 daughters:
i. Mary married 5 Nov 1694 St. James Parish AA Co. to Tego Tracey.
ii. Sarah believed to have married (1) ? Pingstone and (2) 23 April 1710 John Barber
iii. Martha.
iv. Rachel
v. Deborah
vi. (unknown)

Robert Orme, Thomas Knighton, and Wm Simons all witnessed a deed of Jno Wilson the elder to his son John abt 1689 included tract "Burridge in AA Co., 1000a. "Friendship" in Baltimore Co. and a lot and house in Herring Town.

The inventory of Richard James' estate is apparently found in l.I&A/f8.___found after 8.523. It was dated 18 April 1685 with appraisers: William Sinick & Charles Bevan. This William Sinick is apparently also the William Smick/Sivick who was the father of John Smick/Sivick who is discussed in regard to Thomas Tracey. Richard James's estate account filed 2 Aug 1687 extr. relict (unnamed) wife of John Turner {I&A 9.362}. Also in Richard Jame's estate: #1518 3 April 1688 Payments to Mor. Moore, Thomas Tench, Nehemiah Burkett, James Heath, Extrx. Ellinor Turner, wife of John Turner {A&I 9.474}

The land records show that the parents of Mary James were Richard and Ellinor. While at first it appeared that Mary's mother had died by 1704 to allow her daughter to sell land that appears to be Elinor's life estate (based on the will of Richard James). This was not the case as, Elinor James is apparently still listed on a 100 Acres part of the tract of Dan with her second husband John Turner in the 1707 rent roles for Anne Arundel Co.

There were in Anne Arundel Co at least one other Richard James, who was a witness to deeds in the early 1700s. Skordas book lists 4 Richard James immigrants to MD:

Apparently our Richard James must be one of the first two or another individual

Robert and Sarah Orme were also of Herring Creek.

A deed lists Grantor: Thomas Knighton AA Co Gent.
Grantee: Robert Orme and Robert Wood AA Co Planters.

That parcel called Kinghtons Purchase contained in patent dated 26 July 1680, in the woods, about 3 miles west of Herring Creek and Bay, by land called Bell Park, by land formerly laid out for Humphrey Emerton. 197 acres. release of dower: Dianh Knighton.

On 11 June 1694 Robert Orme, Calvert Co. Planter. & Sarah Orme conveyed Robert Gover, Bricklayer, AA Co. for Orme's half of the parcel described above, having been partitioned with Robert Wood.

The land rents for Anne Arundel County in 1707 Herring Creek Hundred, show that Elinor James the widow of Richard married John Turner. It further substaniates the inference from the land records that Richard Taylor owned two tracts of 100 acres, the Tract "James his Chance" which Richard purchased from Robert Paca and was sold by Teage and Mary Tracey, and another tract "Thorton Parke" which is refered to as Richard James's land in the tract description of 90 acres that was sold to Richard Bedsworth by Robert Paca 10 June 1672 and then conveyed by Richard Bedsworth to Nathan Smith, AA Co. merchant on 16 Nov 1682.

The land rent for 1707 reads: Dan; 490 Acres surveyed 3 July 1663 for Robert Paca between the branches of Herring Creek and Lyons Creek. rent...9...10..

The 100 Acres in possession of Abraham Symons is obviously the 100 Acres "James his Chance" that was sold to Symons by Teague and Mary Tracy. The 100 Acres held by John Turner must be the tract "Thorton Parke" of which there apparently is no record of old deeds (They being destroyed in the 1704 courthouse fire in Annapolis). The existant old deeds also only account for 90 of the 290 acres held by Tho Tench for the orphans of James Rigby.
