Flour Creek Ky July 20, 1864

Judge Hauser

            Sir The bearer Dr JWN Mears is located at Butler & is practicing medicine in this community.  Mrs Eliza Gelaspy living in the neighborhood of Butler is a poor person & I am informed deserted by her husband & has a large family of children & the Dr tells me one of the children is very sick & stands in need of medical aid it is not right that the family should suffer for medical aid when it can be furnished.  She has as much to doo these hard times as she can do to get enough for her family to eaat let alone Dr bills to pay medicine is verry high & the Drs circumstances is such that it will not allow him to spend his time & medicine without some assureance that he will be paid.

            I write to ask you if consistant with your feelings to authorize the Dr to render such professional assistance as she & her family may need this summer.

That Geo. L. Abernathy executed bond as Tax Collector for town of Falmouth on May 1, 1871; that Abernathy collected taxes and pd part to the Trustees, but withholds $415.20 of taxes collected by him.  The Collector’s Bond was attested by CA Wandelohr, Clerk, BTT of Falmouth and Treasurer.  Collector of Taxes recd Comm of 7 per cent for collecting.

The Deft [defendant] did wickedly, falsely &C utter & spoke of Plff [plaintiff] to wit:  “You stole my plank” referring to some plank which had been stolen from Deft’s house, and when speaking of some plank which had been removed & taken & stolen from Plffs. House, in a loud voice uttered these false &c words “You and your brother Bayles (meaning Bayles Green) stole my property”, meaning that Plff. & others had stolen Deft’s plank…damage $500.

Green, I said you stole my plank.  If I did charge Green with stealing, I do not recollect it, being much enraged at the time, but did not intend to impute sd [said] crime to sd Green…

            Up to the time of separation, they lived all the time at the house of plffs. parents, and plff refused to provide deft a home elsewhere; the mother of plff was very unkind to deft & treated her so harshly.  Asks that the prayer of plff be granted.

Eliza J. Hitch,  Age 63; reside in Pend. Co.  Have known deft 3 yrs.

            Plff & deft married at Dec. 1, 70.  When deft. left, she went to Catawba first.  I don’t know where else.  Since then plff has lived part of the time at our house & part of the time at Fal.  Plff is my son.  When deft left she said she was coming to Fal. to see the corner stone of the Presbyterian Church laid.  She rode horseback to Catawba and went to Fal. on the train.  She liked to stay away from home too much.

G.J. Hitch.  Plff & deft lived at my house, in Pend. Co.  They lived together from Dec 1. 70 to Sept 14, 72.  Plff is my son.

Nettie Hitch, Age 17, reside in Pend. Co.  I have known deft 6 yrs.  Have known plff all my life.  I lived with them most all the time when they lived together.  I was there when she left.  I received a note from deft since she left (filed)

            “Nettie

Will you please be so kind as to get the over skirt of my new calico dress and the body and sleeves and all the scrap like it and give them to Crozer and Nettie please get every thing of mine and put them in the trunk for me and I will send for the trunk as soon as I can.  You will oblige me very much.

Please send that sack that Annie Thompson loaned me the night of the festival.

The trunk was sent to her father’s house in Catawba.

Beginning on the bank of the South Fork of Licking at the mouth of Fork Lick Creek cornering on two beeches thence down the river as it meanders 30 paces  when reduced to a straight line to two Sycamores and Red Haw another corner thence N 48 W 420 paces to the head of the hollow and cornering on a white Oak in Hunt's line thence S 19 W with said line 54 paces to Ewings Corner on Fork Lick thence down the Creek as it meanders to a beach another of Ewings Corners thence S 71 E 94 paces to the beginning containing 60 acres.

That on or about July 14, 1824 John Ammerman made his last will and departed this life. The testator devised the whole of his estate real and personal including about 194 acres of land situated on the waters of South Licking in Pendleton County to his wife Elizabeth Ammerman during her life for the support of herself and Idiot daughter of said testator and at his death directed directed that his estate real and personal including so tract of land should be sold and the money be put on interest during the life of so said Idiot daughter Elanor so that she might be supported out of the interest thereof and at her death that the balance might be equally divided among all the testators children and appointed James Rose and John Caldwell his Executors.
That after the death of said testator, administration of his estate with the will annexed was granted by the Pendleton County Court to Elizabeth Ammerman the widow of said testator. The testator at the time of his death had the following children namely:

That Charles Dauce sold and conveyed the several interest he had thus acquired to Richard and Gustavus Stowers who because entitled to 4/5 of said land subject to the support of said Idiot during her life. The widow Elizabeth died and in 1836 Joseph Braun and John Ammerman caused themselves to be appointed administrators with the will annexed of said testator John Ammerman. That James Rose has removed out of this court. That John Caldwell the other executor named in the will has given notice that he intends to apply to Pendleton County Court for probate of said will and have the order granting administration to Joseph Braun and John Ammerman be set aside.
Joseph Braun and John Ammerman have advertised that they will sell said land on the courthouse door in town of Falmouth on Monday February 6 1837 before it can be determined whether said Caldwell or Braun and Ammerman has the right to execution of said will. That John Ammerman has given notice to Joseph Braun that he would not consent to a sale of said land until the right to the execution of said will should be determined but said Braun swore that he did not care whether said Ammerman agreed or not he would sell any how.
Your Orators further charge that said Braun is extremely hostile to them ........ and have been informed that said Braun has exultinglt remarked that he had your Orator in his power now and he would work them from which they infer that he will fraudulantly and covinously cause such sale of said land to be made as will be prejudical to their interest.
That a sale of said land by persons acting under a questionable authority will cloud the title and greatly injure the sale of said land, all of wich actings and doings are coutrary to equity acts for injunction

John Ammerman says that his father John Ammerman decd departed this life, prior to which time he made his last will. Among other things he willed all his estates to his wife Elizabeth during her natural life for her support and that of his daughter Elanor who was at the time and now is an Idiot; and also appointed John Caldwell and James Rose to carry into effect this will.
That said Caldwell and Rose refused to act, and Elizabeth wife of John Ammerman decd administered upon the estate and kept in her possesion all the real and personal estate of decedent......; she also kept with her and supported said Idiot out of the profits of the estate...... during her lifetime which terminated on the 31st day of Oct 1836. After her death your Orator John Ammerman administered upon said estate and sold same in persuance of the will for supporting said Idiot during her life time out of the interest from the proceeds of the sale of the real and personal estate.
Isaac Owens has forcibly taken in to his care and keeping said Idiot and is about removing her from this state to the state of Missouri contrary to the will and wish of your Orator who is made her Committee by the provisions of the will of the testator as well as the Idiot.
It would be distracting in the extreme to said Elanor to carry her from her native home and from her friends and relatives to a distant land among strangers there to linger out a miserable and wretched existence.
Prays injunction...... and directing the sherriff to take said Idiot fortheith and deliver her to your Orator
