Inquest of Jury for Everett House for Mill - Deed Book C Pages 8-9

Commonwealth of Kentucky Hickman County Set:

To the Honorable County Court of said county in Session. We, Allen Dunlap, George Cottrell, John Bone, Michael Ward, Eli McGregor, William Thomas, Henry Dunlap, W.E. Bishop, J.M. Lockridge, Jas. Lockridge, L.T. Hardin now having been duly summoned charged and sworn by the Sheriff of said County at the mill seat of Everett House to Examine what land my be overflowed and say to what damager it will be of to the several proprietors and whether the mansion house of any such proprietor or the offices curtilages or gardens thereunto immediately belonging or orchards will be overflowed also whether and in what degree fish of passage and ordinary navigation will be obstructed thereby: whether by and by what means such obstruction may be prevented and whether in our opinion the health of the neighbors will be annoyed by the stagnation of waters in (?) we have examined the proposed mill seat both above and below and are of opinion that no damage will arise by the erection of a water mill at said site sent and that the health of the neighbors will not be annoyed by the stagnation of the water. We are also of opinion that the said E. House may build his dam ten feet high all of which we respectfully report. Given under our hands and seals this 9th day of June 1835.

The Commonwealth of Kentucky to the Sheriff of Hickman County, Greeting:

You are hereby commanded to summon and empanel twelve fit persons freeholders of the vianage to meet on the 9th day of June 1835 upon the Land of Everett House on the little Obion to examine what lands maybe overflowed by the erection of a dam for a water grist & saw mill & say to what damage at will be of to the several proprietors and whether the mansion house of said such proprietors or the offices curtilages or gardens thereunto immediately belonging or orchards will be overflowed. Also whether and in what degree fish of passage and ordinary navigation will be obstructed thereby whether by any and be what means such obstructions may be prevented, and whether in their opinions the health of the neighbors will be annoyed by the stagnation of the water and make deed return thereof to the next August term of our said County Court and in this fail not under the penalty of £100 & have then there this writ. Witness Henry L Edrington clerk of our said court at the courthouse aforesaid this 3rd day of June 1835 and in the 43 year of the Commonwealth.

Executed by summoning twelve legal jurors whose names are in impressed on this writ who met at the mill seat designated and was charged and sworn according to law & examined said seat and made report. This 9th day of June 1835.
