Commonwealth of Kentucky vs Jackson Menuse

Charges:

The Commonwealth of Kentucky Hickman County and Circuit, Set:

The GRAND JURORS, duly empanelled, sworn, and charged to enquire for said Commonwealth, and the body of the County aforesaid at the July term of the Hickman Circuit Court in the year 1839 upon their oaths present that Jackson Menese of said County yeoman on the 10th day of July in the year 1839 in the county of Hickman and Circuit aforesaid then and there with force and arms did make an assault opon one J.M. Gore and did then and there beat, bruise, wound and all treat the said J.M. Gore in so much that his life was then and there  greatly despaired of and other (?) to the said Gore then and there did against the form of the statute in that case made and provided, and against the peace and dignity of said Commonwealth.

Information given by Benjamin Menese and J.M. Gore farmers of said County not of this Grand Jury and J.M. Gore a citizen of Hickman County, farmer ins the prosecution hereof.

We command you to summon Elium Roper to appear before the Judge of our Circuit Court for the Hickman Circuit, at the court house in the town of Clinton, on the 21 of our April Term to testify and the truth to say, in behalf of Jackson Menese in a certain matter of controversy now in our Court depending wherein the Commonwealth of KY is plaintiff and said Menese is defendant, and you shall in no wise omit under penalty of £100; and have then there this writ; Witness WHH Taylor Clerk of our said Court, at the Court House aforesaid, the 28 day of February 1840 and in the 48 year of the Commonwealth.

We command you to summon Jackson Menuse to appear before the Judge of Hickman Circuit Court, at the Court-House in the town of Clinton on the first day of the next October term, to answer a certain Indictment of the Grand Jury, against him at the July term, 1839 for a trespass, assault and battery on the person of JM Gore against the peace and dignity of the Commonwealth of Kentucky; and have then and there this writ. We command you that you attach Benjamin Manuse so that you have his body before the Judge of our Hickman Circuit Court, at the court-house in Clinton, on the 2 day of their April term, to answer us of and concerning those things which may be then and there objected against him; and further to do and receive what our said court shall then and there consider; and this he shall in no wise omit, under penalty £100. And have then there this writ.

This is for not attending as a witness on behalf of the Commonwealth against Jackson Menuse for an assault when duly summoned and the said Manuse is permitted to give bail in the sum of $100.

Know all men by these present that we, Benjamin Menus and AJ Caldwell are held and firmly bound unto the Commonwealth in the sum of one hundred dollars each to which payment will & truly to be made. We bind ourselves, our heirs Jointly and severely & firmly by these presents sealed and dated this 1st day of February 1840. The condition of the above obligation is such that whereas the above bound Benjamin Menuse is attached by order of the circuit court to appear as a witness in a certain case now pending and undetermined in the Hickman Circuit Court wherein the Commonwealth is plaintiff and Jackson Menase Defendant. Now should the above bound Benjamin Menuse will and truly appear on the 2nd day of the April term of the Hickman and Circuit Court then and there to give evidence and the truth to speak then this obligation to be void else to remain in full force and virtue.
