Charges:
The Commonwealth of Kentucky Hickman County and Circuit, Set:
The GRAND JURORS, duly empanelled, sworn, and charged to enquire for said Commonwealth, and the body of the County aforesaid at the July term of the Hickman Circuit Court in the year 1839 upon their oaths present that oath Hopson Binford late of said County yeoman on the first day of July in the year 1839 at the county and Circuit aforesaid did feloniously, willfully & maliciously and of his malice aforethought make an assault on and upon one Thomas James of the County of Hickman and Circuit aforesaid and that the said Hopson Binford willfully & maliciously & of his malice aforethought did then and there shoot and discharge in and against & upon the said Thomas James a certain double barreled shotgun shot, which he the said Hopson Binford then and there held in his hands and that the said Hopson Binford with the said leaden bullet & shot discharged by the four of the gun powder out of the said double barreled shot gun, did then and there willfully and maliciously and with intent to kill with malice aforethought as aforesaid then & there did strike penetrate and wound the said Thomas James giving him the said Thomas James with the leaden bullets shot aforesaid shot and discharged one wound in and upon his left should & breast and also one other wound in and upon his left leg and also one other wound in and upon his left arm of which several wounds in and upon the shoulder and breast, the leg and arm of the said James, he the said Thomas James then and there (?) and languishingly lived, against the form of the statute in that case made and provided, and against the peace and dignity of said Commonwealth.

We command you to take Hopson Binford if he be found in your bailiwick and him safely keep, so that you have his body before the Judge of our Hickman Circuit Court at the court house in Clinton on the 1st day of our next March term, to answer an Indictment of the Grand Jury against him found at for shooting Thomas James with intent to kill. And have then there this writ.

And have then there this writ.
