Commonwealth of Kentucky vs AA Calhoun

Charges:

The Commonwealth of Kentucky Hickman County and Circuit, Set:

The GRAND JURORS, duly empanelled, sworn, and charged to enquire for said Commonwealth, and the body of the County aforesaid at the July term of the Hickman Circuit Court in the year 1839 upon their oaths present that oath AA Calhoun of said County yeoman on the 10th day of October in the year 1839 towit at the county and Circuit aforesaid did then and there as a surveyor then & there fail to keep clear of obstruction and in good repair that part of the public roads leading from Mills Point to Dresden beginning at John Shaw’s on the road leading from Mills Point to Dresden, contrary to the form of the statute in that case made and provided, and against the peace and dignity of said Commonwealth.

To the Sheriff of Hickman County, Greeting:

We command you that you attach John Hanna and David Moods so that you have their bodies before the Judge of our Hickman Circuit Court, at the court-house in Clinton, on the 2nd  day of their next June term, to answer us of and concerning those things which may be then and there objected against him; and further to do and receive what our said court shall then and there consider; and this he shall in no wise omit, under penalty £100. And have then there this writ.

Witness WHH Taylor, clerk of our said court, at the court-house aforesaid, this 8th  day of May 1839 and in the 48 year of the Commonwealth.

The Commonwealth of Kentucky:

To the Sheriff of Hickman County, Greeting:

We command you to summon AA Calhoun to appear before the Judge of Hickman Circuit Court, at the Court-House in the town of Clinton on the first day of the April term, to answer a certain Presentment of the Grand Jury, against him at the October term, 1839 for fail to keep clear of obstruction and in good repair that part of the public roads leading from Mills Point to Dresden beginning at John Shaw’s against the peace and dignity of the Commonwealth of Kentucky; and have then and there this writ. Witness WHH Taylor Clerk of our said Court, at the Court-House aforesaid this 21 day of November 1839 and in the 48 year of the Commonwealth. WHH Taylor.

You are likewise commanded to summon John Hanna and David Moods to appear at the time and place aforesaid, as witness on behalf of the Commonwealth in said case. WHH Taylor

This is for not attending as witness in behalf of the Commonwealth against AA Calhoun after having been duly summoned and the Sheriff will permit each of the defendants to give bail in the sum of $50.

Know all men by these presents that we John Hanna and WE Brinkley are held and firmly bound unto the Commonwealth in the just and full sum of fifty dollars to which payment will and truly to be made, we bond ourselves, our heirs, executors and administrators jointly and firmly by these presents filed and dated this 20th day of May 1840.

The condition of the above obligation is such that whereas the above bound Hanna is attached by order of the Circuit Court to appear as a witness in a certain case now pending and undetermined in the Hickman Circuit Court wherein the Commonwealth is plaintiff and AA Calhoun is defendant. Now should the above bound Hanna will and truly appear on the 2nd day of the next June term and not to depart therefrom without cause of the court or otherwise discharged then and there to give evidence then this obligation to be void else to remain in full force & virtue.

Hickman County, May Term 1839

Ordained that A Calhoun be appointed Surveyor of that part of the road from Mills Point to Dresden, The beginning at the first precinct and ending at John Shaw’s daily who with all the Lands within 2 miles and each side of the said road so as to include L Farmer, A Moody, Robert and George Harris and AA Calhouns lands; shall keep said road in repair 15 feet wide according to law.
