THOMAS TODD, chief justice of Kentucky and associate justice of the supreme court of the United States, was born in King and Queen county, Virginia, January 23, 1765, and died February 7, 1826. His parents were Richard and Elizabeth (Richards) Todd, and his ancestors were early emigrants from England. Judge Todd was liberally educated and obtained a good knowledge of surveying. In 1786 he came to Kentucky and resided for some time in the family of his old friend, Judge Harry Innes, where he pursued the study of law and also acted as tutor in the family. His first effort as a lawyer was made in the Madison court-house, and from that time he rapidly rose to prominence at the Kentucky bar. He was appointed clerk of the United States courts in Kentucky December 15, 1789, and resigned December 18, 1792; then he was appointed clerk of the court of appeals of Kentucky, serving until December 19, 1801, when Governor James Garrard appointed him the fourth judge of the court of appeals; Governor Christopher Greenup appointed him chief justice of Kentucky in 1806; in 1807 he was appointed associate justice of the supreme court of the United States for the new circuit established by congress and composed of Kentucky, Tennessee and Ohio. In that high position, to which he was appointed without his solicitation or knowledge and under the most flattering circumstances, he continued until his death. Judge Todd was married, in 1788, to a niece of William Stewart, one of the pioneers of Kentucky who fell in the disastrous battle of Blue Licks. Only a son and a daughter survived Judge Todd. In 1811 Mrs. Todd died, and the following year the Judge married the widow of Major George Washington, nephew of General George Washington and sister-in-law of President Madison. A daughter and two sons of this union survived the father. Judge Todd possessed to an eminent degree the esteem of his friends and the confidence of the people; and his deportment and ability on the bench, as well as his great benevolence and many social virtues, gained him universal admiration.
