138 I, Thomas Foster of Franklin county and state of Kentucky do make this my last will and testament ~ I bequeath to my wife Lucy Foster my whole estate real and personal for and during the time of her natural life ~ After the death of my I desire and bequeath my estate both real and personal to be equally divided amongst my children hereafter named forth to Eliza W. Mitchell, John Thomas Foster, Frances Elizabeth Foster, William Henry Foster, Susan Foster, and to my three grandchildren Joseph Thomas Jones, Lucy Marshall Jones, and Ann Cruse Jones are to have one share of my estate which would have been given to their mother Judith Jones had she been alive upon an equal division of my estate. In the division to be had at the death of my wife the three grandchildren are to be charged with the sum of Seven hundred and thirty seven dollars that sum being the value of the property which I advanced to their mother Judith Ann Jones during her life and in said division my daughter Eliza W. Mitchell is to be charged with the sum of six hundred and fifty one dollars the value of the property which I have heretofore advanced to her and I give to my son-in-law John J Jones the sum of one dollar to be had at the death of my wife likewise to my son-in-law Walter Ayres the sum of one dollar to be had at the death of my wife. I do hereby constitute and appoint my wife sole executive of this last will and testament, and it is my desire and direction that in her qualification as such that the county court should not require of her to give security in testimony whereof I have hereto set my hand and seal this 22d day of July 1842
