189 I, John A. Head of the county of Franklin and state of Kentucky, do hereby make my last will and testament in manner of ___ following that is___, I desire that my executor herein after named, shall immediately upon my decease, take my ___ to pay off all my just debts and funeral expenses out of such means as are hereinafter designated and all of such other means as shall come when lands not particularly named. 2nd. After the payment of my debts, I give to my wife Polly Head the farm and tract of land on which I now live, a negro girl named Violet to have and to hold during her natural life also my household and kitchen furniture and farming utensils to have and hold forever to be disposed of as she pleases. 3rd. At the death of my said wife, I give to my friend Ben P. Duvall the said farm and tract of land on which I now live as aforesaid in trust for the use of my son Joseph Head. My said trustee hereby being empowered to sell, lease or rent the said tract of land as in his judgment may seem best and apply the proceeds thereof to the ___? of the said Joseph and I further desire that al the death of my wife the said Negro girl Violett and her increase if any be sold by my executor and the proceeds of the sale equally divided among all my children subject to exceptions that are made and to be hereafter made in relation to land devised to my sons Joseph and Benjamin. 4th. I have heretofore given and conveyed to my children William Head, Permelia Triplett and Nancy Story each fifty acres of land out to a tract by me in Davies County, Kentucky and I desire that the residue of said tract of land be divided as follows with on 50 acre lot to Sarah Wright one 50 acre lot to my son Frances Head and the residue of said tract of land supposed to contain about seventy acres, I wish my executor to sell and apply to the payment of my debts or to the support of my wife and family as he may under existing circumstances think proper. But, as there is still one fifty acre lot of land left on said tract and unappropriated I hereby give and bequeath the same to my said executor in trust for the use and benefit of my son Ben T. Head and his wife and children hereby clothing ? my executor with the same power of selling, leasing or renting the same as are conferred upon Ben P. Duvall as trustee for my son Joseph. 5th. I justly owe the heirs of Elijah Kendall, desc. the sum of one hundred dollars which I enjoin upon my children to pay who has had devised to them or conveyed to him but if by mutual agreement it is not made up promptly paid over I enjoin it on my executor to see its payments out of any means coming to his hands not otherwise appropriated and I further desire if there are any means left in unappropriated ___ my executor accruing out of the unappropriated land of the 70 acres above I desire that the same shall be equally divided among my children as follows: _____? Ben T. Head, William Head, Permelia Triplett, Sarah Wright, Henry H. Head and Joseph Head, Nancy Story and Frances Head and I have a young sorrel horse (colt?) usually called with name of my son Alfred, deceased. I desire that my wife, Polly Head have said colt when our benefit forever. And, lastly, I do ___ and appoint my brother Benjamin Head executor to my last will and testament hereby revoking all other or former wills or testaments by me made __ whereof ___ my hand and seal this 18th day of September 1847.
