Will #1163 - Peter Hush - Filed 27 May 1822, Westmoreland Co.,
PA - Proved 10 Dec 1834
In the name of God Amen. I, Peter Hush, of Rostraver Township
in the County of Westmoreland and state of Pennsylvania being
in a declining state of health of body but of sound and disposing
mind, memory and understanding, considering the certainty of death
and the uncertainty of the time thereof and being desirous of
settling my worldly affairs and then may be the better prepared
to leave this world when it shall please Almighty God to call
me thence. I do therefore make and publish this my last will and
testament in manner and form following that is to say. First and
principally, I commit my soul into the hands of Almighty God who
gave it and my body to the earth to be decently buried by my Executors
hereafter mentioned or named and after my just debts and funeral
expenses are paid. I devise and bequeath as follows: ITEM. I give
and bequeath unto my beloved wife, Margaret Hush, the one
third of my estate agreeable to the laws of Pennsylvania in such
case provided, that I may die possessed (?) of -- I will and devise
to my son, Valentine G. Hush, all my real and personal estate
except my wife's (?) as mentioned above and he paying the following
(?) or bequeath as shall hereafter be mentioned -- I give and
bequeath unto my daughter, Juliana Shreave(?) wife of William
Shreave(?) the following property during her natural life that
my will and desire is that my Executors buy a quarter section
of land in the state of Ohio if the same can be bought for three
hundred and twenty dollars agreeable to the customary way of entering
land in the said State of Ohio, and? the said Juliana Shreave(?)
wife of William Shreave(?) have all the benefit coming from said
quarter section of land during her natural life and after the
death of the said land to be sold by my executors and the amount
equally divided among surviving children if personally demanded
with three years after her decease. The above land to be purchased
within two years after my decease; but if such land cannot be
purchased in the state of Ohio, my will is that a piece of land
of like quantity to bought up to the amount of three hundred and
twenty dollars in four equal yearly fragments either in the state
of Ohio or near there to within two years after my decease and
gave her and her children as above. ITEM. I give and bequeath
unto Catharine Neely(?), wife of the Joseph Neely, the two hundred
dollars which Valentine G. Hush has paid them in full of his (?)
P. Catharine Neely's legacy. And my wish and desire is that if
any of the above ligature bring any suit of law against any Executors
by wishing to break this my will that such legatee be paid in
full their legacy with one dollar only --- and my will and desire
if that my wearing apparel be given to my son Valentine G. Hush
with being appraised or sold and lastly I do hereby constitute
and appoint my son Valentine G. Hush and my friend William Baldwin
of the township, county and state aforesaid my executors of this
my last will and testament revoking all former wills by me made
before ratifying this and no other to be my last will and testament.
In testimony whereof I have hereunto set my hand and affixed my
seal this twenty-seventh day of May A.D. One Thousand Eight Hundred
and Twenty Two (1822).
Signed, sealed, published and declared by Peter Hush the above
named testator as his last will and testament in the presence
of he who at his request in his presence and in the presence of
each other have subscribed our names thereunto as witnesses --
Bela B. Smith (?), Robert Armstrong.

Legally proved and approved the 10th day of December A.D. 1834.
Same day letters Testamentary issued to Valentine G. Hush, one
of the Executors in the above will mentioned. William Baldwin
the other Executor having left the county returned to (?) and
has filed his declaration. Enc. sworn by A. Johnston
