Probate Court – Will Book I p. 283, 1839-1845

I Sarah Mary Hort of the City of Charleston in the State of So Carolina being of sound mind, doth make this my last will & Testament. First I direct that my Funeral Expences, and debts which I may have Contracted be Satisfied as early as Possible after my demise Second I direct that as early as practicable Tomb Stones be placed over the remains of my husband and of my child, with the consent of the Proprietor Mr Peter Frazier at the True Blue burial ground on Waccamaw River, and that a plan marble slab with an appropriate inscription shall be placed over the Spot, where I may be interred – Third I bequeath to St Philip’s, the church in which I have so long worshipped, five hundred Dollars in absolute right, and desire that amount be paid, to the proper authorities of the church, without delay – Fourth – as Testamonials of regard, and friendship I leave to Sarah R Hort, my watch and Silver, and Silver Spoons having the name of Hort, & other valuables which may be found packed in a trunk among my papers which has been deposited in Bank; and to Sarah R Hort, and Susan J. Gadsden I leave jointly my Furniture & Books, cloathing & Jewelry together with the contents of sundry Trunks and Boxes deposited for safe keeping with Mr Alexander Robinson – To Francis Delesline Hort I give in absolute right Three hundred Dollars, and to Col. James Gadsden, and to Alexander Robinson Esq to each, I bequeath a handsome gold repeater – to my cousin Ann Petigrew, I desire should be presented as a token of my remembrance a handsome Mourning Broach – Fifth To the Children of my niece Martha Prior, who may be living on my demise, I bequeath in absolute right, Two thousand Dollars, and direct that the same be paid over to my nephew Percival Vaux, to be invested by him, and to be held by him in trust of said children, until they become of age, the interest accruing from said sum to be paid annually to said children and in Case of the demise of any of the said children, that this bequest revert to the surviver or survivors – Sixth, my old and faithful Servant Kate, now residing in Georgetown So. Carolina, I leave and recommend to the kindness of my nephew Percival Vaux, desiring that she be permitted to enjoy her own time as perfectly as if she was free, and that in consideration of the Legacy Otherwise made him, that he will support her during her natural life – Seventh The rest of my slaves Ten in number my shares in the different Banks of the City of Charleston My Bonds including one of my Brothers Estate; Together with all the Property personal and real, remaining after the foregoing legacies are satisfied, of which I may be possessed, I leave in absolute right and to be divided equally between my niece Elizabeth Ford and my nephew Percival & Robert Vaux, the Negroes, bank shares and other property so remaining and so devised, to be sold for division, and to be divided between the aforesaid legatees share and share alike, as they on agreement may prefer, and direct and lastly I do hereby Constitute and appoint – James Gadsden and Alx Robinson Esqr my lawful Executors to carry into full & faithful effect all the promises of this my last will & Testament.

Mr Grays report being read, ordered on motion of Petigru and Lesesne.  That the same be confirmed, and that the Petitioner Dr. W.R. T. Prior be appointed Trustee under the will of the Testatrix Mrs Sarah M Hort in the place of Mr Percival Vaux named therein, who declines acting and that a certificate of this appointment and substitution be annexed to the original will of the said Testatrix and lodged therewith.
