Petition for Divorce

To the Superior Court of said County.  The petition of Sarah J. Satterfield of said County respectfully showeth that on the 13th day of September 1877, your petitioner then a single woman and Harrison W. Satterfield were married in due form of law, to wit-in said County.  The good name of the said Harrison W. Satterfield and the respectability of his family and connections were consideration of themselves which forbade the remotest suspicion of his recent wicked & unlawful conduct as hereinafter mentioned, and his present fallen and depraved condition.  Your petitioner and her said husband Harrison W. Satterfield have lived together from the time of their marriage aforesaid until about the 15th day of Feb. 1878.  When a separation took place, One child was born, Thomas Aaron by name at the filing of this libel nearly eleven months ago - Your petitioner avers that she was ever affectionate and kind to her said husband during the time aforesaid and he never had the least cause to complain of your petitioner.  And your petitioner during all the time aforesaid hoped and believed that she would have the comfort & encouragement in the undivided affection of her said husband, but so it is that said Harrison W. Satterfield forgetful of his obligation and duty to your petitioner during the month of September and October 1878 committed the infamous crime of adultry.

 

Wherefore your petitioner prays that citation may issue directing & requiring said Harrison W. Satterfield husband of your petitioner to be and appear personally or by attorney at the next Superior Court to be held in and for said County then & there to show cause if any he can why said marriage entered into aforesaid and should not be annulled and set aside & made void for the cause aforesaid and a divorce a vinculo matrimonii be pronounced between your petitioner and her said husband and your petitioner will ever pray  ?

Amendment

And your petitioner further avers that defendant's cruel treatment towards petitioner was such that she could not live in peace and safety with him, he beaten wounding and throwing dangerous missels at your petitioner. 

And your petitioner avers that said defendant failed & refused to support maintain & protect petitioner as husband should for an affectionate wife, refusing to furnish proper food, and necessary clothing for petitioner this cruel treatment occurring just prior to the separation and divers other times.

The defendant in the above stated case is hereby required personally or by attorney to be and appear at the next Superior Court to held in and for said County on the first Monday in September next term & there to answer the plaintiffs complaint in an action for Divorce as in default hereof the Court will proceed as to justice shall appertain witness the Honorable Geo. And now comes the defendant Harrison W. Satterfield at this term of this Court by his attorneys Price & Baker and defends the wrongs and impunes complained of by his said wife:  and for plea and answer says that it is true that he was married to plaintiff perhaps at the time mentioned and further says that he was always a true and dutiful husband to his said wife until she became degraded by her frequent association with lude woman & men and defendant further says that he at all times loved and respected his said wife until she became attracted to other men and frequently kept company with them away from home and at diverse times other places unknown to said Defendant and Defendant further says that his said wife the plaintiff in the above action did wilfully and maliciously leave him and without his consent or approval and travel with other men from Georgia to North Carolina and was guilty of heinous crimes, and adultrous crimes with other men unknown to defendant while there and at divers other times –

 

From these facts other like causes Defendant prays that he may have a decree of Divorce from his said wife that he may forever be free from the evil association into which he has been druged by his unfortunate marriage and living with the woman who he once thought loved him and esteemed him as a husband, but who forgetful of all his kindness and love left him for and took up with other men of immoral character and of these charges and statements Defendant puts himself upon the County.

And now comes the plaintiff & after being sworn says that the infamous crime of adultry as charged against her by her said husband in his sworn plea is wholly false and malicious and made to cover up his great and repeated cruelties to this deponent.  This deponant further swears that the affidavit of Washington Satterfield is wholly false and untrue.  She now positively denies that truth of any and all assaults on her character or unchaste conduct in any particular.

 

That she went to North Carolina with her sister a married woman on a visit to relations a boy about 16 years old was hired to drive the wagon and she swears that it is utterly false that she ever had sexual intercourse with any man save my husband.  She further swears that she has a child by her said husband, which he has also abandoned while admitting that he is the father of said child.

To the Honorable Geo. N. Lester, Judge of said Court and now presiding now in.  The petition of Sarah J. Satterfield plaintiff in said case respectfully shows that she is the lawful wife of Harrison W. Satterfield, Deft. in said case that on the 21st. day of June 1879 she commenced said action against defendant for divorce on the grounds of adultry and cruel treatment, returnable to the September term 1879 of said Court & that said action is now pending in said Court on or about 15th day of Feby. 1878 a separation took place between her and her said husband and she desires and intends in good faith to prosecute said action your petitioner prays leave to refer to the petition and amendment in said case on the hearing of the application.  Your petitioner is about 20 years old has no separate estate nor money, nor means of subsistance and it is necessary that your petitioner should have temporary alimony and money with which to pay couscel fee and other expenses of litigation pending said case.  Your petitioner therefore prays your Honor for an order in said case, granting to your petitioner temporary alimony including councel fees and other expenses of litigation in said case in term of law in such case made and provided and in duly bound your petitioner will ever pray.  This 12th April 1880.

Upon hearing the evidence upon the questions made in plantiffs petition.  It is ordered and adjudged by the court that the Defendant Harrison W. Satterfield pay to the Clerk of this court for plaintiff on the 17th day of each month the sum of three dollars as a monthly allowance out of the estate of the said defendant H. W. Satterfield. 

 

And it is further ordered and adjudged that said defendant pay to C. D. Phillips & B. A. Martin attorney's of record for said plaintiff the sum of twenty-five dollars as counsel fees, one half of said sum to be paid now, and the balance on or before the next first day of the next Term of this court.

We the jury find that sufficent proof has been submitted to our consideration to warrent a total divorce that is to say a divorce a vinculo matrimonii upon legal principles between the petition in this case and award the custody of the child to the mother

Whereupon it is ordered decreed and adjuded that a divorce a vinculo matrimonii in this case be granted to Sarah J. Satterfield the libelant and that the marriage be forever dissolved, and it be further decreed that the said Sarah J. Satterfield, have and retain the custody of the child the fruit of said marriage.   And that the defendant pay the cost of this case.  April Term 1881
