Richard Dingle 13th December 1765

 

Know all Men by their Presents that We William Roberts, William Roberts the younger of the parish of Probus in the county of Cornwall, Gentlemen James Fox of Philleigh mason Wm Coppin of Cardinham yeoman are held and firmly bound unto the worshipful John Hench clerk master of Arts Archdeacon of Cornwall in the sum of two thousand pounds of good and lawfull money of Great Britain to be paid unto the said John Hench or to his certains attorney his Executors admnistrators or assigns to which Payment well and truly to be made We oblige ourselves and each of us by himself for the whole our and every of his Heirs Executors and Administrators firmly by these Presents Sealed with our Seals Dated the thirteenth Day of December in the Sixth year of the Reign of our Sovereign Lord George the third by the Grace of God of Great Britain, France and Ireland King Defender of the Faith and so forth and in the year of our Lord One Thousand Seven Hundred and Sixty Five.

 

The Condition of this Obligation is such that if the above bounden William Roberts & Wm Roberts the Younger being as Executors in Trust named in the last Will & Testament of Richard Dingle late of the parish of Ruan Lanihorne deceased …. Admitted … with his seal & mark

Do well and truly Perform the Contents of the said Will and Pay the Just Debts and legacies of the said deceased so far as his Goods, Chattels and Credits will Extend and the Law Charge them the said Wm Roberts & Wm Roberts Junior and do Exhibite or Cause to be exhibited into the Registry of the Archdeaconry Court of Cornwall a true and Perfect Inventory of all and singular the Goods Chattels and Credits of the said Deceased that have or shall come to the Hands Possession or Knowledge of them the said Wm Roberts & Wm Roberts Junior and Render a true and just account thereupon when thereunto lawfully Required Then this Obligation to be void or Else to Remain in full force and Virtue.

In the name of God Amen.  I Richard Dingle of the Parish of Ruan Lanihorne in the County of Cornwall Yeoman Being out of Order but of sound and Dispasing Mind and Memory Praised be God for the same and calling to mind the certainty of Death  and the uncertainty of its coming do firstly make my last Will and Testament in manner and form following That is to say

I bequeath my soul into the hands of almighty God who gave it me hoping through the Merritts of my Saviour and Redeemer Jesus Christ son In…. Mortall Life and my Body to the Earth to be d..fully Interred at the Charge of my Executors herein after mentioned.

I give unto my dearly beloved wife Margaret Dingle the sume of one hundred pounds to be paid her within one month after my decease And I also give her the lease of all my Household Goods as Beds Bedding Pewter Brass Linnen and the alls and implements of plowes of what nature or sort soever the same are for and during her .. of …. Trestayns in Ruanlanihorne aforesaid at the time of my death which said stock and cattle Implements of husbandry shall be valued and appraised by two independent persons soon after my death and my Will is that my said wife shall leave the value thereof on the said Tenement at the time of her death or her Executors or Administrators shall make up and pay the deficiently thereof to & for the use of my Excutors herein after Named.  

I give unto my sister Grace Haynes widow all that one house meadow and orchard in Treworgey within the said parish of Ruanlanihorne for and during her Natural life If  her lives thereon or either of them shall so long happen to live and my will is that my Executors herein after named shall during her life pay and discharge The Conventiory … and his Tythes due for the same out of the Incombes and profits of my Estates called Treworlass within the parish of Filley in the said County and If the lives or life now on the said Tenement in Treworgey shall happen to survive my said sister Grace Then I give the said Tenement to George Hayne son of George Hayne of Treworgey aforesaid for and during the remainder of the term which shall be then to come therein.

I give unto my cousin Richard May of St Austle in the said County all my evening apparell.

I give unto my servant John Nicholls one guinea and also unto my maid servant Elizabeth Canning one guinea and also I give unto the said Elizabeth Canning for and during her life If she continueth to live single forty shillings a year to be paid out of the Incombes and profits of Treworlass aforesaid by quarterly payments by my executors herein after named and I do hereby Charge Treworlas aforesaid with the payment of the above mentioned legacies of two guineas.

I give & bequeath to William Roberts of the parish of Probus in this said county yeoman and William Roberts his son and to his survivor of them his executors or administrators All my righttites and Interest that shall be to some and expire of all in all that my said Tenement called Trestayns  from and after the death of my said wife Margaret To hold the same unto the said William Roberts & William Roberts his son during his remainder of his term which shall be then therein to came and expire in trust nevertheless and to and for the use and behalf of my Nephew Richard Dingle grandson of my brother William Dingle.

Also I give unto my said trustees William Roberts & William Roberts his son and his survivor of them his executor or administrator All my three tenements in Treworlass aforesaid To hold the same unto my said Trustees and his survivor of them his executor or administrator for and during his remainder of his severall terms I have therein …. In trust nevertheless and to and for his use and behalf of my Nephew Alexander Dingle grandson of my brother Alexander Dingle subject nevertheless to the payment of the above legacies and payments and also subject to the payment of twenty pounds to and for his use of my said Nephew Richard Dingle for and during the life of my said wife Margaret and no longer.

I give & devise unto my said trustees William Roberts and William Roberts his son and his survivor of them his executor or administrator all other my messuages lands and tenements wheresoever the same are situate and being or which I shall be instituted unto at the time of my death Together with all my Ready Money sureritys for money goods and chattels to hold the same and and every part thereof to and for the use of my said Nephew Richard Dingle and Alexander Dingle share and share alike provided nevertheless and the true intent and meaning of this my will is that if either of my said Nephews Richard & Alexander shall happen to dye before their attainment of his age of twenty one years then the part of him dying shall goe to the survivor of them and in case they the said Richard & Alexander shall both happen to dye before their attainment of the age of twenty one  years then I give unto my said trustees William Roberts and William Roberts his son and his survivor of them the executor or administrator All my herein before mentioned messuages lands and tenements (Treworgey Ecopted) and also all my money sureritys settlement? Goods and chattels to hold the same unto my said Trustees and the survivor of them his executor or administrator to and for the use of my niece Mary the granddaughter of my said brother Alexander Dingle and in case my said niece Mary Dingle shall happen to dye before her attainment to the age of twenty one years Then I give the same to the two daughters of Peter Dingle Daddow of St Austle aforesaid Tinner term on the body of Mary his wife daughter of my said brother Alexander Dingle share and share alike And my further will is that if any life or lives shall hereafter be put on the said pre… or any part thereof in revertion that my said nephews Richard & Alexander Dingles life or one of them (of living) shall be the life or lives so put on the terms and the purchase money shall be paid out of his part of the profits  whatsoever the same and that my said trustees shall not be answerable for any lost which may happen in acting under the said trust and shall reimburse himself his reasonable charges for acting therein and I do during that the money owed to me on sureritys may for be …. Till twelve months after my decease unless danger or necessity require it And lastly I do hereby make and ordain the said William Roberts and William Roberts his son sole executors of this my will in trust as aforesaid in witness whereof I the said Richard Dingle make this my last will & testament sett my hand and seal this twenty seventh day of March in the year of our lord one thousand seven hundred and sixty five.
