Will of Nicholas Adams 16th April 1746

 

In the Name of God Amen I Nicholas Adams of the parish of Ruan Lanihorne in the County of Cornwall Taylor being Sick and Weak in Body but of sound and perfect mind and memory thanks be to Almighty God for the same Do make my last Will and Testament in Manner and form following (That is to say) First I bequeath my Soul into the hands of Almighty God that gave it me And recommend my Body to Christian Burial to be decently Interred at the Expense of my Executor hereinafter named or Executors in Trust for him Also I give unto the Poor of the parish of Ruan Lanihorne aforesaid Ten Shillings to be paid them within One month after my Decease by my Executor hereinafter named or his trustees, Also I Give unto my Kinsman John Burn my second best Suit of Apparell and One Shilling to be paid and Delivered him immediately after my Decease by my Executor hereafter named or his trustees Also I give unto my Kinsman Nicholas Burn of Veryan my best suite of Apparell and One Shilling to be likewise paid and Delivered Immediately after my Decease by my Executor hereafter named or his Trustees, Also I Give unto my relation Bryant Walters my two best Peruwiggs and my large Bible Also I Give unto Jane Nankivell my Deced Wife’s Wearing Apparell, Also I Give Devise and Bequeath unto Nicholas Adams the son of Jane Nankivell of Ruan Lanihorne aforesaid all that my Dwelling House and Gardens Adjoining Situate lying and being in the Church Towne aforesaid of Ruan Lanihorne Together also with Household Furniture thereunto belonging and also all my Bills Bonds Notes and all other Goods Chattells and Effects whatsoever and whom of I make and Appoint whole and sole executor of this my last Will and Testament To have and to hold the same unto the said Nicholas Adams the son of the said Jane Nankivell his Heirs Executors Adm. & Assigns forever Under and Subject nevertheless to the Trust and Uses hereinafter mentioned (Thatis to say) my Will and meaning is that John Pearce of the parish of Ruan Lanihorne in the County of Cornwall Gentleman Richard Symons of the said Parish of Ruan Lanihorne Yeoman and Jane Nankivell aforesaid are and shall be Trustees or Guardians of this my last Will and Testament over the said Nicholas Adams Nankivell my said Executor and my further Will is that my said Executor shall not pay or receive any Debts without the Liberty or Consent of Two of the said Trustees untill he shall Attain at the Age of Twenty One Years or be marryed and in case my said Executor shall happen to Dye before he Attain the Age of Twenty One Years or be Marryed my Will and meaning is that my said Trustees named in this my last Will their Executors or Admrs shall and will permit and Suffer my Estate and Effects as aforesaid to come unto my Right Heir and that if the Trustees named in this Will shall be at any Expense in Manageing the Affair of this my last Will the same shall be paid by my Executor or given out of the said Effects by them to satifye the same In Witness whereof I have to this my last Will and Testament Sett my hand and Seal this Sixteenth Day of April in the year of our Lord one Thousand Seven Hundred and Forty Six

The before written Will was proved in Common Forme the 11th May 1747 Before the Revd Mt Wm Waddon Clerk Master of Arts Official etc And Admion of the Goods etc of the said Deced and of all things howsoever concerning the said Will was Granted to the Trustees and Guardians named in the said Will dureing the Minority of the Exectr therein named (being first Sworn etc / Saveing etc I.
