APPORTIONMENT of the RENT CHARGE in lieu of TITHES, in the Parish of SAINT JUST IN ROSELAND, in the County of Cornwall.

Whereas an Agreement for the COMMUTATION of TITHES, in the Parish of Saint Just in Roseland, in the County of Cornwall, was, on the Fourth Day of February, in the Year One Thousand Eight Hundred and Forty-one, confirmed by the Tithe Commissioners for England and Wales, of which Agreement, with the Schedule thereunto annexed, the following is a Copy:-

ARTICLES OF AGREEMENT for the Commutation of Tithes of the Parish of Saint Just in Roseland, in the County of Cornwall, in pursuance of the Act for the Commutation of Tithes in England and Wales, made and executed at a meeting duly called and holden in the said Parish, and adjourned, and holden by adjournment, on the Eighth Day of May, in the Year of our Lord One Thousand Eight Hundred and Thirty-nine, by and between the several Persons, Owners of Land within the said Parish, by whom, or by whose Agents duly authorized in that behalf, these Presents are executed, and the Interest of which Landowners, in the Lands of the said Parish, is not less than Two Thirds of the Lands therein subject to Tithes, -of the one part: and the Reverend CLEMENT WINSTANLEY CARLYON, Rector of the said Parish, and Owner of all the Tithes thereof, -of the other part.

IT IS HEREBY AGREED, that the Annual Sum of Five Hundred and Twenty-five Pounds, by way of Rent Charge, (subject to the provisions of the said Act), shall be paid to the said CLEMENT WINSTANLEY CARLYON, as Rector of the said Parish, and to his Successors, instead of all the Tithes of the Lands of the said Parish, subject to Tithes, (including the Tithe of Glebe, the Rent Charge in lieu of which is hereby agreed shall be fixed at the Sum of Two Pounds and Ten Shillings in respect of the Great Tithes of all the Glebe Lands of the said Parish, and Two Pounds Ten Shillings in respect of the Small Tithes of the Glebe of the said Parish; and which Items, it is hereby agreed, shall be apportioned exclusively upon the said Glebe lands:) and instead of all Moduses and Compositions real and prescriptive, and Customary Payments, payable in respect of all the Lands of the said Parish, or the produce thereof; a Summary Description of which Lands is contained in the Schedule hereunto annexed.

AND IT IS HERBY FURTHER AGREED, that the Lands included in the Agreement shall be discharged from the payment of Tithes, (except as excepted in the said Act) for the First Day of January following the confirmation of the Apportionment of the Rent Charge hereinbefore agreed on; and that the first payment of such Rent Charge shall be made or be recoverable, on the expiration of Six Calendar Months from the time from which the said Lands are discharged from the payment of Tithes.

IN TESTIMONY whereof the said Parties to these Presents, or their respective Agents thereunto duly authorized in their names and on their behalf, have to these Presents subscribed and set their respective Hands and Seals.

SCHEDULE TO THE ABOVE ARTICLES OF AGREEMENT

The whole Parish of Saint Just in Roseland aforesaid contains, by estimation, Two Thousand Three Hundred and Forty Acres of Land, Statute Measure.
The whole quantity of the Lands of the said parish, which are subject to the payment of any kind of Tithes, is, by estimation, Two Thousand Three Hundred Acres.
The whole quantity of Land subject to Tithes, within the said Parish, which is cultivated as Arable Land, is, by estimation, One Thousand Eight Hundred Acres, Statute Measure.
The whole quantity of Land subject to Tithes, within the said Parish, cultivated as Meadow or Pasture Land, is, by estimation, One Hundred Acres, Statute Measure.
The whole quantity of Land subject to Tithes, within the said Parish, now cultivated as Woodland, is, by estimation, about Ten Acres, Statute Measure.
The whole quantity of Common Land subject to Tithes, within the said parish, is, by estimation, Four Hundred Acres, Statute Measure.
The Glebe Lands of the said Parish, which when not in the hands of the Owner or Owners are subject to Tithes, amount to Ten Acres, Statute Measure; which Glebe belongs to the said CLEMENT WINSTANLEY CARLYON.
