Thomas Leedham - The elder

This is the last Will and Testament of me Thomas Leedham the elder of Rostleston in the County of Derby Yeoman. I will and order all my just Debts Funeral and Testamentary Expences to be fully paid and satisfied by the Ways and means hereinafter directed by me. 

I Give and Devise unto my eldest Son Thomas Leedham and his Heirs and Assigns for ever All those my three Closes or Pieces of Land with their Appurtenances lying and being in Rostleston aforesaid called Netherbottoms containing by Estimation Ten Acres or thereabouts be the same more or less and now in the occupation of my Son Stephen Leedham

I Give and Devise unto my said Son Thomas Leedham and his Assigns for and during the Term of his natural Life only without Impeachment of or for any manner of Waste All that Messuage Dwelling house or Tenement with the Outbuildings Yards Gardens, Closes or Pieces of Land and Appurtenances to the same belonging or appertaining situate and being in Rostleston aforesaid containing by Estimation Ten Acres or thereabouts be the same more or less now in the Occupation of my said Son Stephen Leedham and which I purchased of Martin Farnell (subject to the Life Estate of my Wife therein) And from and immediately after the Decease of my said Son Thomas Leedham then (Subject as aforesaid) I Give and Devise the same Premises with their Appurtenances unto Thomas Leedham, William Leedham, John Leedham, Stephen Leedham, Joseph Leedham, Elizabeth Leedham and Edward Leedham the Seven Children of my said Son Thomas Leedham equally to be divided between and amongst them Share and Share alike and to their respective Heirs and Assigns for ever to take the same as Tenants in Common. 

I Give and Devise unto my said Son Thomas Leedham and his Heirs and Assigns for ever All those my two Closes or Pieces of Land with the Barn standing and being in one of the said Closes and the appurtenances thereof lying and being in Rostleston aforesaid containing by Estimation Eight Acres or thereabouts be the same more or less now in the Occupation of my said Son Stephen Leedham and which I purchased of                  Clarke Esquire

I Give and bequeath unto my said Son Thomas Leedham for his own proper use and benefit all my Stock live and dead and Implements in Husbandry now in his possession being in upon or belonging to the Farm and Lands situate in Cauldwell and Linton both in the said County of Derby called Long Lands Farm now in his occupation Subject nevertheless and I do hereby make chargeable the said Freehold Estate so devised to my said Son Thomas Leedham in Fee as aforesaid and also the said Personal Estate hereinbefore bequeathed to him as aforesaid with the payment thereout of the Sum of Seven Hundred and Fifty Pounds of lawful Money of Great Britain which I give and bequeath unto Samuel Stretton of Glascott near Tamworth in the Counties of Stafford and Warwick or one of them and John Stretton of Clifton Campville in the County of Derby aforesaid Farmers to be paid to them or the Survivor of them his Executors or Administrators in manner following that is to say one half part thereof at the End of twelve Calendar Months next after my Decease and the other half part thereof at the End of Two Years next after my Decease with Interest after the Rate of Five Pounds per Centum per Annum for such part thereof as shall remain unpaid at the End of twelve Calendar Months next after my Decease Upon the Trusts hereinafter declared concerning the same 

I Give and Devise unto my Son John Leedham and his Heirs and Assigns for ever All those my three Closes or Pieces of Land with the Barn standing and being in one of the said Closes and the Appurtenances thereof lying and being in Rostleston aforesaid called the Norleys containing by Estimation Fifteen Acres or thereabouts be the same more or less now in the occupation of my said Son John Leedham and which I purchased of the said                     Clarke And also all those four Dwellinghouses or Tenements and Shop with the Outbuildings and Appurtenances thereto belonging adjoining or near to each other situate and being in Rostleston aforesaid the Tenements in the occupations of Charles Kinson, John Hollis, William Aldridge and Robert Fletcher and the Shop in the Occupation of my Son William Leedham 

I also give and bequeath unto my said Son John Leedham All my Stock live and dead and Implements in Husbandry now in his possession being in upon or belonging to the Farm and Lands situate in Rostleston aforesaid called Long Furlongs Farm now in his Occupation Subject nevertheless and I do hereby make chargeable my said Freehold and Personal Estates so devised and bequeathed to my said Son John Leedham with the payment thereout of the Sum of Four Hundred and Fifty Pounds of like lawful Money of Great Britain which I give and bequeath unto the said Samuel Stretton and John Stretton to be paid to them or the Survivor of them his Executors or Administrators in manner following (that is to say) one half part thereof at the End of twelve Calendar Months next after my Decease and the other half part thereof at the End of two Years next after my Decease with Interest for the same after the Rate aforesaid or such part thereof as shall remain unpaid at the End of twelve Calendar Months next after my Decease Upon the Trusts hereinafter declared concerning the same 

I Give and Devise unto my Son Stephen Leedham and his Heirs and Assigns for ever All that Messuage Farm or Tenement with the several Closes or Pieces of Land and Appurtenances thereto belonging situate and being in Rostleston aforesaid containing by Estimation Ten Acres or thereabouts be the same more or less and now in the Occupation of myself and my said Son Stephen Leedham and which I purchased of John Radford deceased And also all those two Closes or Pieces of Land lying and being in Rostleston aforesaid called Dale Closes containing by Estimation Seven Acres or thereabouts be the same more or less now in the Occupation of my said Son Stephen Leedham and which I purchased of Jeffery Gilbert  

I also give and bequeath unto my said Son Stephen Leedham for his own proper Use and Benefit All my Stock live and dead and Implements in Husbandry now in his possession being in upon or belonging to the Farm and Lands now in his Occupation situate in Rostleston aforesaid Subject nevertheless and I do hereby make chargeable my said Freehold and Personal Estates so devised and bequeathed to my said Son Stephen Leedham with the payment thereout of the Sum of Two Hundred Pounds of like lawful Money of Great Britain which I Give and bequeath unto the said Samuel Stretton and John Stretton to be paid to them or the Survivor of them his Executors or Administrators in manner following (that is to say) one half part thereof at the End of twelve Calendar Months next after my Decease with Interest for the same after the Rate aforesaid or such part thereof as shall remain unpaid at the End of twelve Calendar Months next after my Decease Upon the Trusts hereinafter declared concerning the same 

And I do hereby will and declare that they the said Samuel Stretton and John Stretton or the Survivor of them his Executors or Administrators shall stand possessed of the aforesaid Trust Monies and Personal Estate hereinbefore bequeathed to them as aforesaid upon the following Trusts that is to say  

Upon Trust to pay to my Son William Leedham his Executors or Administrators the Sum of One Hundred and Fifty Pounds (having already given him the Sum of Two Hundred Pounds) to be paid to him in manner following that is to say one half part thereof at the End of twelve Calendar Months next after my Decease and the other half part thereof at the End of two Years next after my Death with Interest after the Rate aforesaid from the End of twelve Calendar Months next after my Decease for such part thereof as shall then remain unpaid 

And upon further Trust to pay to my said Son William Leedham from the End of twelve Calendar Months next after my Decease Interest after the Rate aforesaid for the Sum of One Hundred Pounds during his natural Life And after his Decease then Upon Trust to pay the said Principal Sum of One Hundred Pounds and all Interest due thereon unto and amongst all and every the Child and Children of my said Son William Leedham now born or that shall or may be born in due Time after his Decease equally to be divided between or amongst them Share and Share alike to be paid to them at their respective ages of twenty one Years provided the same shall happen after the Decease of my said Son William Leedham and to be vested Legacies at Twenty one 

And upon further Trust to pay to my Daughters Elizabeth the Wife of John Lee, Sarah the Wife of William Insley and Jane the Wife of John Holden the Sum of One Hundred and Fifty Pounds each having already given them the Sum of Fifty Pounds apiece  And upon further Trust to pay to my Daughter Ann the Wife of William Tilley the Sum of Fifty Pounds having already given her  One hundred and Fifty Pounds.  All which said Legacies I direct shall be paid in manner following that is to say one half part thereof at the End of twelve Calendar Months next after my Decease and the other half part thereof respectively at the End of two Years next after my Death with Interest after the Rate aforesaid from the End of twelve Calendar Months from my Death for such part thereof as shall then remain unpaid 

And upon further Trust in the next place to pay and discharge all my just Debts Funeral and Testamentary Expences  And upon further Trust to place out the Sum of Two Hundred Pounds in case the Residue of my said Personal Estate shall be sufficient for that purpose and to pay the Interest thereof unto my said Wife for her Life as the same shall become due and payable   And from and immediately after her Decease then upon Trust to pay the said principal Sum of Two Hundred Pounds or such part thereof as my said Trust Monies and Personal Estate shall be sufficient for that purpose and all the unapplied Interest thereof unto and amongst all my nine Children equally Share and Share alike and to their respective Executors and Administrators 

And I direct that my said Sons Thomas, John and Stephen Leedham shall pay to my said Wife in equal Proportions after the Rate of Ten pounds per Annum to commence from my Death and to be paid half yearly during such Time and until the said Sum of Two Hundred Pounds shall carry Interest for her Benefit but no longer   And upon further Trust to pay all the Residue of the said Trust Monies to my said Wife for her own use and Benefit  

I give to my said Wife all my Household Furniture Plate Linen and China and all the Residue and Remainder of my Personal Estate and Effects of what nature or kind whatsoever and wheresoever for her own proper Use and Benefit 

I give and Devise All that Close or Piece of Land with the Appurtenances thereto belonging situate and being in Rostleston aforesaid called the Up Ditch containing by Estimation five Acres or thereabouts be the same more or less and now in the Occupation of Stephen Leedham and which I purchased of the aforesaid Clarke unto my Daughter Mary Leedham Whittingham widow and her assigns for and during the Term of her natural Life without Impeachment of Waste  And from and immediately after her Decease then I Give and Devise the same Premises unto her four Children William, Thomas, John and Elizabeth Whittingham equally to be divided between and amongst them Share and Share alike and to their respective Heirs and Assigns for ever 

I nominate and appoint the said Samuel Stretton and John Stretton Executors of this my last Will and Testament hereby revoking all other Wills by me heretofore made and declaring this only to be my last Will and Testament In Witness thereof I have to this my last Will and Testament set my Hand and Seal this Third Day of March in the Year of our Lord One thousand eight hundred and seven

 


 

Signed sealed published and declared by the said Thomas Leedham the Testator as and for his last Will and Testament in the presence of us who at his Request in his Presence and in the Presence of each other have subscribed our Names as Witnesses to the same an Interlineation having been first made in the Second Sheet and four Interlineations having been first made in this Sheet

I the within named Thomas Leedham the Testator do declare this to be a Codicil to my Will and direct the same to be taken as part thereof   I do hereby will and declare that in Case the Residue of the Trust Monies within mentioned to be given to my Trustees Samuel Stretton and John Stretton  shall not be sufficient to make a Fund to pay my Wife a clear Annuity of Ten pounds for her Life then I do hereby will and direct that my three Sons Thomas, John and Stephen Leedham shall pay her in equal Proportions as much money as together with the Interest of the Residue of the said Trust Monies will be sufficient to pay her a clear Annuity of Ten pounds during her Life and I charge my Real and Personal Estates devised and bequeathed to my said three Sons Thomas, John and Stephen Leedham with the payment thereof accordingly  In Witness whereof I have (after signing and publishing my said Will) set my Hand and Seal this Third Day of March One Thousand eight hundred and seven
