W. H. Kilpatrick to H R Miller Deed 1837 This Indenture made and entered into the the[sic] 12th day of August A D 1837 between William H. Kilpatrick and Jane S. Kilpatrick his wife of the first part and Hugh R Miller of the second part Witnesseth that in consideration of the sum of Two hundred and _____ 80/100 dollars the said parties of the first part have granted bargained sold and by these presents do grant bargain sell convey and forever quit claim unto said party of the second part his heirs and assigns forever that parcel of land situate in the county of Pontotoc Mississippi known and designated as the North East quarter of Section Twenty two in Township Nine of Range One East of the bases meridian according to the public survey of the Chickasaw Cession to have and to hold to said party of the second part his heirs and assigns forever free from the claim or claims of all persons claiming by through or under us Given under our hands and seals the day and year above written.

Joseph Clardy to Matthew Price, Deed, 22 May 1841 Know all men by these presents that Joseph Clardy of the county and state above written and held and firmly bequeath unto Mathew Price of the county and state aforesaid in the penal sum of four hundred and fifty dollars the payment of said sum to be well and truly made unto the said Mathew Price. I bind myself my heirs executors and administrators jointly severalty and firmly by these presents. The condition of the above obligation is such that if the above bound Joseph Clardy doth make unto the above named Mathew Price his heirs executors administrations a good and sufficient title to the North West quarter of Section twenty Township 8 of Range 10 East to soon as he shall have completed the payment for the same then the above obligation to be void otherwise to remain in full force and effect in law. Witness my hands and seal this 22nd of May 1841

| Joseph Clardy to Matthew Price 8 July 1842 This Indenture made and entered into this 8th day of July 1842 between Joseph Clarady of Itawamba county of the first part and Matthew Price of the said county of the second part witnesseth that for and in consideration of the sum of two hundred and fifty dollars the receipt of which is hereby acknowledged the said Joseph Clardy has this day bargained and sold and by theses presents doth bargain and sell to Matthew Price the North West quarter of section No. twenty in Township Eight of Range No. Ten East containing one hundred and sixty acres with its appurtenances thereunto belonging situated in Itawamba county Miss and the said Clardy for himself his heirs and assigns hereby warrants and defends and will forever warrant and defend the title of the said quarter section of land to the said Price his heirs and assigns against the rights title claim or demands of any person or persons whatsoever. In Testimony whereof I have hereunto set my hand and affixed my seal this the day and year above written.
The State of Mississippi Itawamba County Personally appeared before me Lewis Collins an acting Justice of the Peace in and for said county. Joseph Clarady whose name is subscribed to the foregoing deed and acknowledged that he signed sealed and delivered the same to Matthew Price for the purposes therein mentioned as his act and deed and Epsey Clardy wife of the said Joseph Clardy whose name is also signed to the said deed bring by me privately examined separate and apart from her said husband acknowledged that she signed sealed and delivered the same freely without any fear threats or compulsion whatsoever of her said husband. Given under my hand and seal the 8th day fo July 1842.

Thomas J. Steele to Wm. H. Kilpatrick Know all men by these presents that I Thomas J. Steele of the
county of Pontotoc & state of Mississippi do hereby ordain constitute
and appoint William H. Kilpatrick my agent and attorney in fact
for me and in my name to endorse transfer and assign my land warrant or
the certificate for land which is or may be issued by the government of
the United States to sue for land under the provision of the act of congress
giving bounty lands to the soldiers and volunteers who served in the war
with Mexico And my said attorney, in fact is hereby authorized and empowered
to transfer and assign the said warrant or certificate or claim to any
person or persons in as full land ample a manner as I myself could or
would do myself transferring all my right, title, interest and claim therein
fully given under my hand & seal this 25th day of October 1848.

James Walker to Sally Kilpatrick 1852 This indenture made this the twelfth day of May A.D. 1852 between James
Walker widower of the County of Davidson and state of Tennessee of
the one part and Sally Kilpatrick of the county of Pontotoc & state
of Mississippi of the other part Witnesseth that the said James Walker
for and in consideration of the sum of Twelve hundred & eighty dollars
in hand paid the receipt whereof is hereby acknowledge has granted bargained
sold aliened confirm and convey and by these presents does grant bargain
sell alien convey and confirm unto the said Sally Kilpatrick her
heirs and assigns forever all that tract or parcel of land lying and being
in the County of Pontotoc and state of Mississippi and known and designated
according to the plan of surveys of the Chickasaw Cession as the North
West quarter (NW1/4) of section No. twenty seven (S27) and the south west
quarter (SW1/4) of section No. twenty two (S22) of Township No. eleven
(T11) in Range No five (R5E) East of the base meridian containing three
hundred & twenty acres with all rights tenements hereditments and appurtenances
and all the estate right title interest property and claim of him the
said James Walker of in and to the same. To have and to hold the
lands hereby conveyed with all and singular the premises and every part
and parcel thereof with the appurtenances unto the said Sally Kilpatrick
her heirs and assigns forever And the said James Walker for
his heirs executors and administrators doth covenant promise and agree
to and with her the said Sally Kilpatrick her heirs and assigns
by these presents that the premises before mentioned now and forever hereafter
shall remain free from all former and other gifts granted bargained sale
charges and imcumbrances whatsoever from him the said James Walker
his heirs executors and administrators all and singular the premises hereby
bargained and sold with the appurtenances with the said Sally Kilpatrick
her heirs and assigns against the said James Walker and his heirs
and all and every other person or persons whatsoever doth and will warrant

William W. Bell & Wife to Wm. H. Kilpatrick 4 Oct 1854 This Indenture made and entered into on this the 4th day of October
A D 1854 between William W. Bell and Mary A. his wife of
the first part and William H. Kilpatrick of the second part, all
of Pontotoc County, State of Mississippi: Witnesseth that for and in consideration
of the sum of one hundred and thirty dollars in hand paid to the parties
of the first part by the party of the second part the receipt of which
is hereby acknowledged, the said parties of the first part have granted
bargained, sold, and conveyed, and by these presents do grant bargain,
sell, and convey unto the party of the second part his heirs and assigns
in fee simple forever, that certain lot or parcel of land know and designated
on the connected plat of the Survey of the Public Section at Pontotoc
Miss " as lot No. Fifteen of the South East quarter of section No Thirty
Two [32] in Township No. Nine [9] of Range No. Three [3] East of the Basis
Meridian according to the plan of survey of the Chickasaw Cession lying
and being in the County and State aforesaid and containing five and 19/100
acres more or less. Together with all and singular the rights, tenements,
hereditaments and appurtenances thereunto belonging or in anywise appertaining.
And the said parties of the first part hereby covenant and agree with
the party of the second part, that they will forever Warrant and Defend
the title of the above described lot or parcel of land and the hereby
granted premises in and to the said party of the second part his heirs
and assigns free from the claim or claims of all and every person whatsoever.
In Testimony, whereof the said parties of the first part have hereunto
set their hands and affixed their seals this day and year first above
written, the word "defend" being first interlined on the thirty first
line of the first page of deed of conveyance.
The State of Mississippi Personally appeared before me Drury J. Pitts, Clerk of the Probate
Court of said county the above named W. W. Bell, and Mary A.
Bell, his wife, who severally acknowledged that they signed, sealed,
and delivered the foregoing deed as their act and deed on the day and
year therein mentioned. The said Mary A. on a private examination
separate and apart from her said husband acknowledged that she signed,
sealed and delivered said deed as her voluntary act and deed freely without
any fear, threats or compulsion of her said husband. Given under my hand
and the seal of said court at office the 1st November 1854.

John J. Moore to Wm. H. Kilpatrick 27 Feb 1856 This Indenture made and entered into this 27th day of February
A D 1856 between John T? Moore and K A his wife of the first
part, William H. Kilpatrick of the second part and Stephen Daggot
of the third part, Witnesseth that the said party of the first part
in order to secure and provide for the fractional percentage of a certain
promisary note given by the said party of the first part, to the said
party of the third part, for the sum of Six Hundred dollars, bearing even
date herewith and payable twelve months after date, and also for and in
consideration of one dollar to him paid by the said party of the second
part, has this day bargained sold and conveyed unto the said party of
the second part, his heirs and assigns a certain lot of land known and
designated as follows, to wit, Lot number thirty four [34] of the South
West quarter of Section No. Thirty three [33] in Township No. nine [9]
of Range No three [3] East of the base meridian according to the plan
of surveys of the Chickasaw Cession lying and being in the county of Pontotoc
and State of Mississippi and containing seven and twenty three o/100 acres
more or less to have and to hold the said Lot with all the appurtenances
thereto belonging forever, but in trust now. Unless that is the said party
of the first part shall fail to pay the sum of money above mentioned together
with the interest there on by the 27th day of February next, then the
said party of the second part at the instance and request of the party
of the third part shall proceed to sell at auction to the highest bidder,
for cash at the Court house door in the town of Pontotoc by giving thirty
days notice of the time and place of such sale by posting up advertisements
as the law requires, and with the proceeds of such sale he shall first
pay all legal fees and necessary expenses in executing this trust and
then to pay off the note above described and the balance if any he shall
pay to the party of the first part, but should the said party of the first
part pay off and satisfy said debt and the expense of executing this instrument
previous to such sale, then this deed shall become null and void and the
title shall revert to the said party of the first part. In Testimony whereof
we have hereunto set our hands and affixed our seals this day and date
first above written.

By her attorney in fact Hugh R. Miller of the first part and William H. Kilpatrick of Pontotoc County Mississippi of the second part witnesseth that for and in consideration of the sum of Two hundred and twelve 50/100 dollars paid by the said party of the second part Said party of the first part doth give grant bargain sell convey and forever quit claim unto the said party of the second part all the right title claim and interest in dower or otherwise of said party of the first part in and to that parcel of land situate in Pontotoc County Mississippi known and designated as the North East quarter (NE1/4) of Section Twenty two (S22) in Township Nine (9) pf Range one East (R1E) according to the public survey of the Chickasaw Cession To have and to hold said parcel of land to said party of the second part his heirs and assigns forever free from the claim of said party of the first part and of any person claiming under his In testimony whereof said party of the first part has hereunto set her hand and seal the day and year above written.

of which I hereby acknowledge. I George S. Seatherburg by theses

his heirs and assigns forever all my rights title claims interest and
demand of in and to the following lots parcels of land to wit in lots
Nos. 15, 22, 23, 26, 29, & 34 of the South East quarter of Section No.

Sally Kilpatrick to J. W. Pride, Treas. 1860 This Indenture made and entered into this the 13th day of April A D 1860 between Sally Kilpatrick by J. S. Kilpatrick agt. Of Pontotoc County and state of Mississippi of the first part and Jesse W. Pride Treasurer of the School Fund of said County of Pontotoc of 2nd part Witnesseth That whereas the said party of the first part, is justly indebted to the said party of the second part and his successor in office in the sum of two hundred & fifty Dollars borrowed from said School Fund as evidenced by a Note-bearing even date herewith and payable twelve months after date- to said Jesse W. Pride Treasurer or his successors in office, and whereas the said party of the first part is willing and desires to secure the payment of said note therefore this Indenture witnesseth that in consideration of the premises and the further consideration of Five Dollars the receipt of which is hereby acknowledged the said party of the first part has granted bargained and sold to the party of the second part and his successors in office the following described property- to wit- The South West quarter of Section twenty two Township Eleven Range Five East of the Based Meridian Chickasaw cession Mississippi to have and to hold in fee simple the title to which said Sally Kilpatrick the said party of the second(sic) first part will warrant and forever defend to the said party of the second part and his successors in office In trust nevertheless that of the said party of the first part shall fail neglect or refuse to pay said note in the interest thereon at Maturity the said Jesse W. Pride Treasurer or his successors in office is authorized, empowered and directed to sell to the highest bidder for cash at the court house door in the term of Pontotoc after giving thirty days notice of the time and place of sale posted at three public places in the county the whole or a sufficient amount of said Land to pay said Note with interest and all expenses and the balance should there be any shall be paid and delivered to the party - of the first part, and should there be a balance of said land unsold it shall be reconveyed to said party of the first part by a quit claim Deed but should the party of the first part pay all of said note and interest- and all expenses before any such sale then the said Jesse W Pride Treasurer or his successors in office shall reconvey by quit claim deed all of said Land to the party of the first part- In Testimony where of the parties of the first and second part have hereunto set their hands and seals the day and year first above written.
