James Torrentine to James Clardy 1818

This Indenture made this Twenty ninth day of June in year of Our Lord one Thousand Eight hundred thirteen between James Torrentine administrator for Alexander Torrentine Deceased in part the state of Tennessee & County of Bedford of the one part and James Clardy of the county state aforesaid of the other Witnesseth that for and in consideration of the sum of Two hundred fifty seven dollars to me in hand paid by the said James Clardy the receipt whereof is hereby acknowledged hath given granted bargained sold aliened Conveyed & confirmed unto the said James Clardy his heirs assigns executors etc a certain tract or parcel of land situate in the county of Bedford and in the second district sixth section & fourth range and on Falling Creek on the North side of Duck river

Beginning at a Large Hickory the north East corner of an entry in the name of Ephram Payton for 640 acres Sd tree standing on the North side of Falling Creek running from thence South with said Paytons line crossing creek one hundred & sixty poles to an Elm thence East one hundred poles to an Elm & Sugar tree thence North sixty poles to the creek in all one hundred sixty poles to an Ash hard bush thence West one hundred poles to the beginning surveyed the 3rd of March 1809 Geo Mitchell with the hereitaments & appurtunances to have and to hold the said tract or parcel of land to the said James Clardy with all and singular the rights profits entitlements heretiances appurtunances appertaining to the only proper use and benefit of him the said James Torrentine for himself his heirs assigns executors Etc warrant forever defend the aforesaid land bargained premises to him James Clardy his heirs etc from all and every person or persons whatsoever lawfully Claiming the same

Benjamin Clardy to George H. Allen 1824

This Indenture made this 16th day of October in the year of our Lord one Thousand eight hundred & twenty four Between Benjamin S. Clardy of the county of Maury & state of Tennessee of the one part & George H. Allen of the county of Bedford and state of Tennessee of the other part Witnesseth that the said Benj. S. Clardy for & in consideration of the sum of two hundred and Thirty five dollars to him in hand paid by the before named George H., Allen the receipt whereof is hereby acknowledged Have given granted bargained and sell unto the said George H. Allen his heirs Executors administrators or assigns a certain tract or parcel of land lying and being in the county of Bedford and state aforesaid on the North side of Duck River & bounded as follows

Beginning at the North East corner of Lot No 74 running thence East ninety four poles to two dogwoods ___ & Allens corner then South eighty six poles to a stake then West ninety four poles to the South East corner of Lot No Eighty seven then North to the Beginning containing by estimation fifty acres & a half.
To have and to hold the before mentioned land and bargained premises with all the appurtenances thereunto Belonging to him the said George H. Allen his heirs executors administrators or assigns and I the said Benjamin S. Clardy for myself my heirs Executors & do covenant and agree to and with the said George H. Allen his heirs Exe administrators or assigns to forever warrant and defend the before mentioned land form the lawful claiming the same either in Law or Equity.

James Clardy to Norman Clardy 1825

This Indenture made this 29th day of April in the year of our Lord one thousand eight hundred & twenty five Between James Clardy of the county of Bedford & state of Tennessee of the one part & Norman Clardy of the county and state aforesaid of the other part Witnesseth that the sd James Clardy for and in consideration of the sum of seven hundred dollars to him in hand paid by the sd Norman Clardy the receipt of the aforesaid sum is here by acknowledged by me hath given granted bargained & sold & by these presents doth give bargain & sell unto the sd N Clardy his heirs & assigns forever a certain tract or parcel of land situate in Bedford county & state aforesaid lying on the North side of Duck River on both sides of Huricane Creek being a part of four hundred & forty six acre tract grant by the aforesaid state to Joshua Hadley beginning on the South boundary line of the sd tract at two Cedar trees formerly made as corners to two hundred acres sold to Freeman Burrow running North crossing the sd creek one hundred and eight eight poles to a hickory on Ephriam Paytons south boundary line thence East with his line to the south east corner of the sd Peytons thence east with the south boundary line of Benj MCuistions? forty acre tract in all one hundred and fifty six poles to a hickory & Ironwood on the sd line thence south with the said line one hundred sixty one poles to an Ironwood Ash & white oak on the south boundary line of the said Hadleys tract thence west with the North boundary line of the school land and the same to the beginning containing by calculation one hundred & seventy acres be the same more or less

To have and to hold unto the said Norman Clardy his heirs & assigns forever all and singular the rights heriditaments and appurtenances unto the said land belonging or in any wise appertaining To have and to ___ to the Norman Clardy his heirs and assigns forever all and singular the above described premises & every appurtenances thence belonging to their own proper use and behalf and the sd James Clardy for himself his heirs & executors & Admin to the sd Norman Clardy his heirs ___ & doth by these presents warrant and defend the above described tract of land and the appurtenances thereto belonging against being the just or lawfull claim of any other person or person of any from or under him or them In witness whereof the said James Clardy hath hereunto set his hand & seal the day & year above written.

Richard Clardy to Samuel Clay 11 ¾ acres 1825

This Indenture made this 25th day of August in the year of our Lord Eighteen Hundred & Twenty five Between Richard Clardy of the county of Bedford and state of Tennessee of the one part and Saml Clay of the same county and state aforesaid of the other part Witnesseth, that for and in consideration of sixty four dollars and sixteen cents to me in hand paid by the said Samuel Clay the receipt whereof is hererby acknowledged hath granted bargained sold conveyed and confirmed and by these presents do grant bargain sell convey & confirm unto the sd Saml Clay his heirs and assigns forever a certain tract or parcel of land lying in the said county of Bedford and on the waters of the Wartrace fork of Duck River it being a part of a 6000 acre tract granted by the state of North Carolina to John Gray & Thomas Blount No 219

Beginning on a beech about one pole No West of the spring now used by sd Clay thence North 28° East fifteen & one half poles to a large black Ash thence North 79° East four poles to a stake & Cherry tree thence North 23° East fourteen poles to a stake thence North 75° West seven poles to a stake thence North thirty nine poles to a stake thence South 75° east thence thirty three poles to a stake pointed by a beech in the West boundary line of the tract on which sd Clay now lives thence South with sd line forty nine poles to a Hickory thence South 69° West thirty four poles to a stake thence to the beginning containing eleven acres and three quarters be the same more or less Together with all ways, woos, waters, watercourses, hereitements and appurtenances thereunto belonging or any wise appertaining unto the said Samuel Clay his heirs and assigns

To have and to hold the aforesaid land and premises and I the said Clardy do bind myself my heirs & assigns & unto the sd Clay his hers & assigns & by these presents do warrant & forever defend the aforsd land and premises unto the said Samuel Clay his heirs and assigns & against the claim or claims of any person or persons whatsoever whereby the same may or might be effected contrary to the true intent and meaning of these presents In Witness whereof I have hereunto set my hand and affixed my seal Day and date first above written. Nathan H. Schoolar to Johnson Clardy 1825

This Indenture maid this seventh day of November in the year of our Lord one thousand eight hundred and twenty five between Nathan H. Schoollar of Bedford County and state of Tennessee of the one part and Jonston Clardy of county & state aforesaid of the other part Witnesseth that the said Nathan Schoolar for and in consideration of the sum of one hundred dollars in hand paid by the said Clardy the receipt whereof the said Nathan H. Schoolor doth hereby acknowledge hath given granted bargained and sold and by these presents doth give grant bargain and sell to the said Johnston Clardy his heirs and assigns for ever a certain peace or parcel of land in the county of Bedford & state aforesaid on the waters of hurricane creek it being a part of a six hundred and fourty acre trat of land granted John & Wm Paytons six hundred & fourty tract

running thance Eastwardly with the old line of said grant two hundred and fifty six poles to a black oak and Elm the South East corner of said Entry & grant runing thance North twenty seven and one half poles with the East boundary line of said grant to Tilmans line thance West with Tilmans line to the beginning containing twenty two acer and seventeen poles be the same more or less together with all woods ways and waters and mines minerals heridtiments and appertaines unto the same ____ going us In any wise appertaining to have and to hole to the said Johnston Clardy his heirs and assigns forever all and singular the above described property and every appirtainance thar unto belonging to the only proper use & behaof & the said Nathan H. Schooler for himself his heirs executors and administrators to the said Johnston Clardy his heirs and assigns will and doth by these present warrant and defend the above described tract of land and the appertainances therein to belonging against being the just & lawful claim of any person or persons what soever of by from as under him or them in Witness whereof the said Nathan H. This Indenture made this 18th day of January in the year of our Lord one thousand eight hundred and twenty six between Johnson B. Clardy of the county of Bedford and state of Tennessee of the one part and James Winsett of the county and state aforesaid of the other part Witnesseth that the said Johnston B Clardy for & in consideration of the sum of one hundred dollars to him in hand paid the receipt wharof the said Johnson B Clardy doth hereby acknowledge hath given granted bargained and sold and by these presents doth give grant bargain and sell to the said Jerman Winsett his heirs and assigns forever a certain piece parcel of land in the county of Bedford & state aforesaid on the water of Harrican Creek being a part of a six hundred and forty acre tract of land granted by the state of Tennessee to John and William

Beginning at Two lines the South West corner of said tract of John & William Paytons 640 Runing thence Eastwardly with the old line of said tract two hundred and fifty six poles to a black oak and Elm the So East line of sd Entry & granted running thence No 279 poles with the East boundary line of sd grant to ____ and line thence West with Tilmans line to the beginning containing twenty two acres and 17 poles be the same more or less. Together with all woods ways, waters mines minerals herditaments and appurtenances unto the same belonging or any wise appertaining To Have and to hold the sd Jarman Winsett his heirs & assigns forever all & singular the aboe described tract of land and the appurtenances therto belonging to the own proper use & behoof & the sd Johnston B Clardy for himself his heirs execr & admin to the sd Jarman Winsett his heirs & assigns _____ and doth by these presents warrant & defend the above described tract of land & the appertenances therto belonging _____ being the just an lawfull claim of all persons whatsoever of by from or under him or them In Witness wharof the sd Johnston B Clardy hath hereunto set his hand and seal the day & year above written Signed Sealed and Delivered In presents of

This Indenture made this the 11 day October one thousand eight hundred and twenty seven between Richd Clardy of the county of Bedford and state of Tennessee of the one part and John B Hamilton of the county and state aforesaid of the other part Witnesseth that the said Richard Clardy for and in consideration of the sum of six hundred and ten dollars to him in hand paid by the said John B Hamilton the receipt whereof is hereby acknowledged hath given granted bargained sold aliened & conveyed and confirmed unto the said John B Hamilton his heirs and assigns forever a certain tract or parcel of land situated lying and being in the county of Bedford and state of Tennessee and on the water of the Wartrace part of Duck River

David Burton to James Clardy 1832

This Indenture made and entered into this 5th day June 1832 between David Burton of the county of Bedford and State of Tennessee of the one part and James Clardy of the county and State aforesaid of the other part. Witnesseth that for and in consideration of eight five dollars to him in hand paid the receipt whereof is hereby acknowledged hath given granted bargained and sold unto the said James Clardy a certain tract or parcel of land situate lying and being in the county of Bedford and on the waters of Fall Creek of Duck River and bounded as follows

Viz beginning at a Chery____n Oak James McCeland north west corner running thence with his line sixteen poles an ash Fifers Corner thence with his line North one hundred and sixty poles to an Ash John Burnets corner thence with his line to an Ash twenty eight poles the corner of a survey in the name of Alexander Turrentine Thence with his line South one hundred and fifty seven poles to an Elm his other corner Thence with his other line west sixteen poles to a Hackberry the corner of Rueben Nance, Thence with a line of the same South fifty eight poles to a Poplar Thence East twenty eight poles to a stake in McClelan line Thence with the same to the beginning containing agreeable to grant thirty eight acres with the hereditennits and appertenances to have and the aforesaid tract or parcel of land and its appertenances to the same James Clardy his heirs and assigns forever, and I the said David Burton For myself my heirs executors and administrators doth and will warrant and forever defend the above described premises to the said James Clardy and his heirs forever against the lawful claim or claims of all and every person or persons whatsoever.

James Clardy to John Shofner- slaves 1832

Know all men by these presents that I James Clardy of the county of Bedford and state of Tennessee hath this day bargained sold and delivered unto John Shofner Of said county and state one negro woman slave for life named Mariah and her child named Caroline aged twenty seven years her child Caroline aged two years for an in consideration of the sum of five hundred dollars to me in hand paid by the said John Shofner and I do warrant said negro woman Mariah and her child Caroline to be healthy sensible and sound and for the true performance I bind myself my heirs and assigns unto John Shofner his heirs and assigns against any other claims for ever -

Mary Ann Clardy to Mich [sic] Jacob Fisher & Michael Parsons - 1838

This Indenture made and concluded, the third day of December in the year of our Lord one thousand eight hundred & thirty eight, By and between Mary Ann Clardy of the county of Bedford and state of Tennessee of the one part and Jacob Fisher of the other part and Michael F. Parsons of the third part, Witnesseth that whereas the said Mary Ann Clardy , being indebted to the said Jacob Fisher in two notes of hand which I have paid for the said Mary Clardy as security one note payable to Rosanna Sentz for fifty six dollars due the 25th Dec. 1838. One other note for nineteen dollars the 19th November 1838. Making in all seventy five dollars. Now therefore and in consideration of the premises and in the further sum of one dollar to me in hand paid by the said Jacob Fisher the receipt whereof is hereby acknowledged the said Mary Clardy has this day bargained sold delivered conveyed and consigned unto the said Jacob Fisher his heirs and assigns forever the following property- to wit, One horse colt, two cows and calves, one sow and five shoats, twelve geese, four beds and furniture, one cupboard, six chairs three chests, one table, two pots & one kittle, ten barrels of corn. To have and to hold the aforesaid described property with the appurtenance, thereto belonging to the said Jacob Fisher or assigns forever, from deed.

Nevertheless and upon the following conditions- Viz, that if the said Mary Clardy or her heirs do not pau said Jacob Fisher on or before the first day of October next with lawfull interest, then or as soon thereafter as the sadi Jacob Fisher will request the said Michael F. Parsons in writing, the said M. F. Parsons as Trustee is authorized to sell said property at public auction for cash in hand, the said Michael F. Parsons first giving twenty days notice of the time and place of sale, and the said M. F. Parsons is authorized to deliver and make title to said property as Trustee aforesaid and the proceeds of sale or as much as will pay the abpve named debts, and the balance if any after paying the expense of executing this deed of Trust to be paid to the use of the Mary Clardy and it is further understood that the said Mary Clardy to keep the possession of said property till the day of sale by Trustee aforesaid In Testimony whereof the said Mary Ann Clardy hath hereunto set his hand and affixed her seal the day and date above written
