James Chene married Katherine Rutherford.2

James Cheyne of Pennand and Katherine Rutherford were divorced.. They were mentioned in the biography of Alexander Rutherford of Rubislaw, Provost of Aberdeen. Alexander was her brother. The entry reads in part "... Katherine (Rutherford), who was married to James Cheyne, of Pennand, from whom she was divorced about the end of 1598. The cause of the divorce is not stated, but the Provost was a party to a deed of arrangement executed prior to the divorcement regarding the destination of the moneys secured under the marriage contract".3

James Chene married Elspet Gordon 1600. James Chene of Pennen (2268), Elspet Gordon (2336) and another James Chene (4123) were mentioned in, A. Y. Cheyne, The Cheyne Family in Scotland. The said entry reads as follows: "James Chene...in 1600 married as his second wife, Elspeth, daughter of William Gordon of Gight, a certain James Chene being charged by the Ellon presbytery in February of that year with having performed the ceremony, 'he having no function in the ministrie'".4

James Chene of Pennen (2268), William Chene of Orchartoun (2025) and his son Alexander (2027) were mentioned in, A. Y. Cheyne, The Cheyne Family in Scotland. The said entry reads as follows: "In 1601 James was still an outlaw and there was a suspension of letters charging a number of inhabitants of Aberdeen not to intercommune with certain persons at the horn, amongst whom were James Chene of Pennen and Alexander, son of William Chene of Orchartoun. This Alexander Chene, a kinsman of James was his constant abettor in crime and companion in disgrace". Among the inhabitants charged were John Cheyne of Petfichie (2390) and Patrick Cheyne of Ferriehill (2388). Though mentioned as a kinsman, the exact relationship is yet to be determined.5

James Cheyne of Pennan (2268) was made Tutor of Essilmont, 28 November 1608. His brother, Patrick, 9th of Essilmont, had died and Patrick, 10th of Essilmont (2303) was still a minor. The entry in Littlejohn, Records of the Sheriff Court of Aberdeenshire reads as follows:"28 Novr. (1608). Service--Tutory. Patrick Cheyne, eldest son of Patrick Cheyne of Essilmont. James Cheyne of Pennan, brother of the deceased, chosen as Tutor".6,7

John Cheyne of Petfichie (2390), Thomas Cheyne of Ranietoun (2432) and James Cheyne of Pennan (2268), were mentioned in an action in Littlejohn, Records of the Sheriff Court of Aberdeenshire. The entry reads in part as follows: "March 6 (1611). Curatory. Wm. Turing of Foweraine. The next of kin called were ... Mr. John Cheyne of Petfichie, Thomas Cheyne of Ranietoune ... James Cheyne of Pennan. The minor chose several of the other names".8

James Cheyne of Pennan (2268) was mentioned in an action in Littlejohn, Records of the Sheriff Court of Aberdeenshire. The entry for the said action reads as follows: "Novr. 13 (1611). Loosing of Arrestments. Thomas Sym in Maynes of Esslemonth v. Thomas Catto in Bourhills of Esslemonth. Cautioner James Cheyne of Pennan."9

Patrick, 10th of Essilmont, left no issue and was probably deceased before 1631, in which year his uncle, James Chene of Pennan, succeeded to the title "of Essilmont".4
