1810 Middletown, Rutland Co, VT census: three males under 10, one male 10-16, one male 26-45, two females under 10, one female 26-45, one female 45+ (may be Abigail’s mother or could be Bathsheba, Johnson’s mother)

Was a Private in Capt. William Hutchin's Company, Colonel Herrick's Regiment of Militia, 1780. He served as a Sergeant of the Company of Militia commanded by Capt. Isaac Tichenor, August 1784 and as Sergeant Colonel in Ebeneezer Wallbridge's Regiment of Militia, October 1781.

Johnson may have died unexpectedly as no will has ever been found. He left 8 children, the last one a child of less than 2 years. His estate was declared insolven; his brother, Barak was the administrator. Barak gave David, the son, a personal note ($200) for the farm. John Brown of Poultney purchased the farm from Barak. No mention of wife, Abigail nor any of the children.

Document #1] KNOW ALL MEN by these presents, That I, Barak Rudd of Middletown in the county of Rutland and state of Vermont, as principal, and Erastus Hill of Tinmouth in the county of Rutland aforesaid, are holden and stand firmly bound and obliged until Obadiah Noble, Jr., Esq., judge of the court of probate for the district of Rutland in the penal sum of three hundred dollars current money of the United States, to be paid unto the said judge, his successor in office, or assigns, to the which payment well and truly to be made and done, we bind ourselves and each of us, our and each of our heirs, executors and administrators, jointly and severally, each and every of them, for and in the whole, firmly by these presents, signed with our hands and sealed with our seals, Dated at Tinmouty the 24 day of Decr 1817.

The condition of the above obligation is such That if the above bounden Barak Rudd Administrator of all and singular the goods, chattels, rights, credits and estate of Johnson Rudd late of Middletown in the county of Rutland and state of Vermont deceased, do make or cause to be made a true and perfect inventory of all and singular the goods, chattels, rights, credits, and estate of the said deceased, which have or shall come to the hands, possession, or knowledge of the said Barak or into the hands or possession of any other person or persons for him, and the same do exhibit, or cause to be exhibited into the registry of the said court of probate, in the district of Rutland at or before the 2d Monday of March next ensuing, and the same goods, chattels, rights, credits and estate, and all other of the goods, chattels, rights, credits, and estate of the said deceased at the time of his death, which at any time after shall come into the hands or possession of the said Barak or into the hands or possession of any person or persons for him, do well and truly administer according to law And further, do make or cause to be made, a true and just account of his administration; at or before the 2d Monay of Jany 1819 and all the rest and residue of the said goods, chattels, rights, credits, and estate which shall be found remaining upon the said administrator’s account (the same being first examined and allowed by the said court of probate) shall deliver or pay unto such person, or persons, respectively, as the said court of probate, by their decree or sentence, pursuant to the true intent and meaning of the law, shall limit and appoint, and if it shall hereafter appear that any last will and testament was made by the said deceased, and the same shall be exhibited in court, with request to have it allowed and approved, if the said Barak being thereunto required, do render and deliver the said letters of administration (approbation of such testament dbeing first had and made) into the said court, then this obligation to be void and of none effect, or else to remain in full force and virture.

Wheras[sic] Barak Rudd Administrator on the estate of Johnson Rudd late of Middletown in the County of Rutland deceased, hath represented to me that the said Estate is insolvent, and insufficient to pay all the just debts which the deceased owed; I do therefore hereby nominate and appoint you to be Commissioners, with full power to receive and examine all the claims of the several creditors to the said Estate having first caused the times when, and places where you will meet to attend the business of your appointment, to be made known by advertising the same three weeks successively, in the Rutland Herald and by notifications posted up in some public place in the town of Middletown for thirty days.

And Six month are allowed unto the said creditors for bringing in and proving their claims, at the end of which time you are to make report, and prsent unto me upon oath, a list of all the claims that shall have been laid before you, with the sums you shall allow on each claim, to the end that distribution may be made of the said Estate, to and among the creditors, agreeably to law.

IN TESTIMONY whereof, I have caused the seal of the said Court of Probate to be hereunto affixed.

You are further notified that a further divident of the amt. in sd. adm. hands will then be made among the Creditors of sd estate.

Abigail in 1860 Will County, IL census, living in home of Michael Conlisk and wife, Marie. The will of Michael states he married Maria DePue. Maria was the granddaughter of Abigail.

From Marie Hogle's notes: “I have not been able to follow her - John Brown of Poultney, married Olive Rudd, sister of Johnson. I believe he is a brother to Abigail. When the Rudd family, including Abigail and her children, moved to Onondaga County, NY after the death of Johnson in Middletown, VT, I find that Abigail married again. I have not found the record of the marriage. But, by him she had one child - Mariah, who married in Ohio, Michael Conlisk. She may have married Benjamin, the father of Sarah DePuy who married Leonard Rudd, but if so, the gravestone of Arena must have the wrong death date.” [Celia’s note: I believe Marie is incorrect here - that Abigail never remarried as she is listed as Abigail Rudd in the 1860 Will county census. In another note Marie says Maria
(DePuy) Conlisk was her granddaughter, possibly the daughter of Vincent. This assumption carries more weight when viewed with the fact that the Conlisks were living next door to Benjamin Rudd (son of Vincent).]
