book and again, it may not be correct, but may help someone.

  Yes, I've seen that. I have a hard time giving it any credibility. For
  one thing, it gives Christopher Burt's wife b. 1796 and yet their
  daughter Sarah Ann Burt b. 1799! Then there's a 41 year period of
  childbirth as well (1799 - 1840), a bit much (although this could be
  explained if there was a first wife, I guess).

  Also, if Christopher, son of John Burt, was born 1775, it would put
  John's birth ca 1755, much earlier (by ten years or so) than the oldest
  known child of Joseph Burt Sr.

  It has always looked to me as if the original contributor took various
  references to any John Burt and pieced them together however they would
  fit.

  On the hand, I wonder who was the John Burt listed in 1786 in Halifax Co.,
  NC with five children? My guess is that he was the son of Richard Burt
  (Joseph Burt Sr's brother).

Note to all...

I dearly respect Jeanette Austin's hard work, but it has proven to be wrong on
numerous occasions.  I am still trying to correct some of her mistakes on other lines
of mine.  It is excellent as a  possible source of information, but should NOT be
taken as fact.

I am taking the rest of the week off and plan to do research at the court houses and
library.  I will see if I can't find some legal records to straighten some of these
folks out.

Updating the time line with a deletion of what I sent earlier and also some
more entries.

The deletion is the following:

Reason for the deletion: I think this is better information on birth and
the marriage info is wrong. The incorrect info came from the Mathis book
and I have since found the will of Philip Moody, 1719, and he claims to be

This Elizabeth Burt who had the charges brought against her was the wife of
Richard Burt. (As a side line, if you want to read some "afternoon TV soap
operas, ala 1690s, you should read the other court actions involving her in
that same time frame.)  In a deed in 1737/8, a daughter of Richard Burt,
Jr. state that Richard Burt, Jr was the only heir to the marriage of
Richard the elder and Elizabeth Hansford. I think I sent that entry the
last time I forwarded entries to you. So, married in 1688, a young child
being laid on a bed in 1692 indicates Richard, Jr. This deed also proves
wrong the statement in the Mathis book that Richard Jr., married Elizabeth
Hansford.

I will prepare two. One for the marriage of Richard the elder to Elizabeth
Hansford. I have no idea as to what dissolved the marriage of Richard the
elder to Elizabeth Hansford, maybe death of Elizabeth, maybe Elizabeth was
killed, (and with a grin, by either Richard the elder, or another man whom
she accused of raping her.) maybe Richard divorced her. I have no proof of
anything, only one heir.

I will also prepare one for Richard the elder to Elizabeth Moody. This one
will have many fewer dates. I think we have the children of that marriage
fairly well sorted out, but dates, etc, no. The problem arises with the age
of Elizabeth Moody. If she was the daughter of Philip Moody, then when he
died in 1719, he named 8 children but four of them were under age, could
not at that time inherit property. But daughter Elizabeth could have been
of a first marriage. Just don't know. Smiling, if this be the correct
Elizabeth Moody, then Richard the elder and Richard the younger married
either sisters or half-sisters.  ??  But who knows.

Now as an alternative, there was an older brother to Philip Moody. Maybe he
had a daughter? Who knows. I am going to start searching wills when I go to
the LDS FHC tomorrow.

But, I think you can see that the ages can cause some real problems in
sorting all of these out properly. Will have them for you before this week
end.

Any comments or questions about the above? And, listen, I have absolutely
no reservations about you replying, questioning. It is only when such
evidence can stand up to scrutiny and cross examination that it then
becomes believable and reliable. So, please, please do not fail to question
any thing that I do that is not absolutely plain on its face. Okay?

Weather is supposed to turn cold again tonight, I believe. The weather in
Amarillo dropped 20 degrees early this morning, the noon time temp there
was cooler that early. So, it should get here early night.

  OK, that makes sense... I figured I had probably missed an earlier
  detail. Of course, it's always possible that "the young child" did not
  live to adulthood and Richard Burt Jr. was a later birth. Although I get
  the feeling from what you've said above (and below) that her husband may
  have not been feeling very amorous after all this!

You are so right about it possibly being another child, but, with no better
info, will carry this date as an "about" date.

  sounds like one of those embarrassing skeletons that some folks like to
  tuck away and leave out of the family history (which is unfortunate,
  because we lose a sense of our ancestors' humanity in the process).

I have no qualms about putting such in. With a grin, I am not from the line
which includes Elizabeth, so I have none of her genes. But, as you say, we
loose some of their humanity. See, her father was summarily executed for
participation in Bacon's rebellion. He has been identified as the first
Virginian born hanged in Virginia. Now he is classified as a martyr. I
think Bacon's rebellion was the absolute beginning of events culminating in
the American Revolution. Somebody had to start.

And I believe a reference by Mrs. Peters to such was what started this
encounter. Here is a brief extract of the deposition, in their way of
spelling and as transcribed by the compiler: "Elizabeth Burt angrily spoke
to Mary Peeters saying, Hoe now Mrs. impudence or what made you tell me of
my father and withall struck Mary in the face. . . . " Yes, I doubled
checked my typing. The spelling is accurate of the book transcription.

This where I would like a little guidance. I had planned to scan the
information about this encounter with Mrs. Peters into the record of
Elizabeth Hansford for inclusion in the posting.  Should I put the rest,
the rape and another incident, into the info for you to post? I will have
it in my records regardless, because it does tell about the living
conditions, ?social life?, etc.

  Stay warm! (Just think, less than five weeks until March, which I
  consider spring no matter what the weather!).

Yes, all of this has started me thinking. I am going to do a garden again.
Will have the most expensive tomatos ever, I guess. With my bum knee, I
can't do the tilling. Will have to rent a tiller and hire a man to do it.

Hi all,

I'm on the KIMBALL (various spellings) mailing list because -- researching a
name like Kimbrough -- I need all the help I can get.  The Kimball list has
an on-line newsletter (which can be retrieved via the Kimball home page --
www.geocities.com/SiliconValley/2926 ) and the latest issue had the article
below.  

If a John Burt was killed in 1814, it must have been another attack, since
the article below refers to an attack in August 1813.  However, with a
reported Burt - Kimball connection, I thought it was interesting.  Perhaps
some of the Burt and Kimball families travelled together to Alabama.

                      The Story of the Kimball Massacre

By Ruth Kimbell Charles

Isham Kimbell is a son of Ransom Kimbell and Jane Harris. The parents of
Ransom are: Mary (Ransom) Kimbell and Benjamin Kimbell, Sr. The parents of
Jane are: Isham and Jane (George) Harris.

This account of the Kimbell-James Massacre comes from the book by Halbert
and Ball entitled The Creek War of 1813 and 1814. Originally published in
the 1880's, it was reprinted by the University of Alabama Press in 1969. In
the introduction is stated that author Ball was well acquainted with Isham
Kimbell, a survior of the Kimbell-James Massacre. The following taken from
page 177-183 of the reprint.

Ransom Kimbell with his family came from South Carolina to the Tombigbee
River, settling near McGrew's Reserve about 1807, but in 1812 the family
removed into the Bassett's Creek Valley into the Bassett's Creek Valley,
near to the home of a settler whose name was Sinquefield. when the stockade
was built bearing this pioneer's name, as a protection from the dreaded
Muscogee incursions, the Kimbell family with the others in that neighborhood
left their plantation home for a residence in the stockade. After a time, no
Indians appearing East of the Alabama, and the small stockade being crowded,
the Kimbell family and the family of Abner James retired to the cooler and
more roomy plantation cabin. They were spending their days of that last week
in August, 1813, knowing indeed that there was danger, but not thinking how
unexpectedly Indians fro the eastward might come upon them.

On Tuesday evening August 31st, quite late in fact into, the night, as young
Isham Kimbell and a daughter of Abner James were sitting up with a sick
member of the household, the dogs ran out furiously and barked violently
while sounds of running human feet were distinctly and alarmingly heard,
that Miss James with admirable presence of mind, blew out the candle. Yet
when morning came the families neglected to return to the stockade. It was
their last opportunity. It seems to be deeply imbedded in human nature not
to heed warnings. On Wednesday, September 1, 1813, at about three o'clock in
the afternoon, suddenly from the creek bottom, Francis called The Prophet,
and his warriors appeared. Ransom was was away from home. Isham, a youth of
sixteen, with a little brother was at the blacksmith shop, distant from the
house one hundred and fifty yards. Hearing guns and immediatley after seeing
the Indians in his father's dooryard killing the inmates of his home he also
started at once with his brother for the stockade. The distance was more
than a mile. The brothers avoided the roadway. The Indians saw them and
fired a gun, the shot cutting the chincapin bushes near them but harming
neither. Crossing a little stream that flows between the two localities, the
elder brother fell. Regaining his feet and looking around, to his surprise
his little brother was not in sight. He was with him when the gun fired, and
was not hurt, and that seeems to be the last certainly know of this child.
Of his death or of his captivity among the Indians nothing was ever heard.
Like the disappearance of Gineva of Modena, all that was ever known was the
brief record that he was not. On the first day of September, 1813, that
young boy passed strangely out from the knowledge of all white dwellers in
Clarke County. The young Kimbell, finding himself alone, hurried on towards
the stockade.

Of the onslaught at the Kimbell home, in the dooryard, quick, savage, and
merciless as it must have been there were not witnesses, except the helpless
victims and the Muscogees. There was not much scattering of the families
after the two men (Abner James and a visitor named Walker and the four
children (James's children Thomas and Mary, Isham Kimbell and the missing
child, themselves making a hasty retreat. (Note: Abner James was not near
the house; he fled when the Indians first showed themselves, without aiding
those at the house.) Scaps were removed, the domestic animals were killed,
the house pillaged, and in a short time the Muscogees were out of sight in
the densely wooded region that bordored on the creek, leaving of women and
children, all supposed to be dead, fourteen bodies in the house and
dooryard. It is said above, in a short time, and short it must have been,
perhaps not more than twenty minutes, for Ransom Kimbell, away on
hourseback, hearing the guns, started for home. He reached it in time only
to find the work of death completed. He then went to the fort. (As it turned
out) Sarah Merrill, daughter of Abner James was not dead and neither was her
one-year old boy.

The remaining bodies of the dead were bought up the next day and buried near
the stockade. Ransom Kimbell did not long survive. He died at Fort Madision.

Isham grew up to be an influential citizen on Clark County. My g,g,g,
grandfather Benjamin Kimbell, Jr. was brother to Ransom Kimbell. Teresa's
line, David Kimbell, was a brother also (all sons of Benjamin Kimbell, Sr.
of Warren Co., N. C.) Isham Kimbell was born in Waren County, March 31,
1797.

Have you done any research on the family of Jarrott Vincent, son-in-law of
Joseph Burt, Jr.?  I have a list of his children from Alma McClurkin which
includes few dates. I found a Wilcox county book at the Autauga Heritage
Museum monday and found a few more names and dates. In addition to the
Vincents, I find some other family names, i.e.-- Timothy Walton Mathews,
Orren D. Carstarphen, William R. Marshall, and some Burt names I did not
recognize. I will send more when I have more time to research.

What is the status on the Burt list? Should we put out some general queries
on the lists to see how many others would be interested?

and also time to digest the spelling of those days, and some phrases that I
really don't understand.

Richard Burt's first wife, this Elizabeth, was the daughter of Thomas
Hansford, summarily executeed in the Bacon's rebellion in 1676. Elizabeth
was not of legal age, probably only about 6 years of age or so at the time.
This is of that Elizabeth. This is nice and tame.

body in the house. Elizabeth Burt angerly spoke to Mary
Peeters saying, Hoe now Mrs. impudence or what made you tell
me of my father and withall struck Mary in the face. Your 
deponent desireing them to be quiett, but soe continued 
strikeing, fighting, and scratching and by reson of lameness 
your deponent was incapable of parting them, soe Mary being
bigg with Child and not able to defend herselfe, Elizabeth 
violently threw Mary against the corner post of the bedstead 
and a stoole which Mary complained did doe her great injury,
shee being in that condition with child as aforesaid, soone 
after which fall against the bedstead your deponent's mother 
did gett Mary and Eliz: out of the house into the yard and soe 
parted them.  Your deponent then went from the house but 
presently returning did there hear Mary make sad complaint 
of the wrong and injury which she had received and did suffer

Hi everyone,

I think I can shed some light on this matter. I found this information in
"The Federal Road through Georgia, the Creek Nation, and Alabama,
1806-1836" by Henry DeLeon Southerland, Jr. and Jerry Elijah Brown, 1989.

A little background.  The Creek Indian War took place 1813-1814. At that
time the Creek Indian nation covered the Eastern half of the present state
of Alabama and much of the Western part of Georgia. The only road through
this territory was the Federal Road which ran from Washington, DC down
through the Carolinas and into Georgia at Athens, then on through
Milledgeville and into Alabama.  It curved up to about Montgomery, and then
followed the Alabama River down to Mobile and on to New Orleans. Most of
the Indian trouble was centered around this road.

On 30 August 1813 the Creek "Red Sticks", lead by William Weatherford, aka
"Red Eagle", and Paddy Welsh, massacred 247 white men, women and children
at Ft. Mims on the Alabama River, above Mobile. The massacre of the Kimball
family was two days later you may notice.

News of the Indian uprising, and Ft. Mims in particular, frightened the
citizens of Georgia and in August 1813 the Georgia militia was called out
and place under the command of Gen. John Floyd. On 24 November 1813 they
crossed the Chattahoochie River and established Ft. Mitchell, 12 miles
below present day Columbus, GA.

On 29 November 1813 Floyd's 950 miltiamen and 300-400 friendly Indians
attacked the village of Autossee, an important center of the Red Stick
faction. About 200 hostile Creeks were killed, along with many friendly
Creeks.  The militia lost only 11 men.

Gen. Floyd launched another campaign in January 1814 before the 6 month
enlistment of his militia cound expire. A surprise attack before dawn on 27
January 1814 on Calabee Creek, about 40 miles west of Ft. Mitchell, by 1300
warriors under Weatherford resulted in 169 casualties for Floyd's
militiamen, forcing their return to Georgia.

This date and location corresponds to the information Sandy gave on the
John Burt who was killed. On page 81 of "Records of Baldwin County, GA" by
Delwyn Associates, 1975, John Bert in listed on the 1814-1815 muster roll
of 2nd Class of 33d Regt. Georgia Militia. The return was dated 9 Nov 1814.
This date would imply that John Bert was not among those killed, but that
is not certain.  What is the source of the information on his death? I did
not see Sandy's orginal e-mail. Also, can anyone identify this John Burt?

I had earlier listed several Marshalls mentioned in the "Federal Road...",
but I found another that I had missed. On p. 116, Joseph Marshall is listed
as the postmaster at Coweta, GA 1 April 1815.  Has anyone been able to
identify these Marshalls?

My Elijah BURT was born on 10 March 1808 in Georgia, I believe in the
1810s his parents moved to Tennessee. They lived in Franklin County I
believe until about 1831. He married Elizabeth ________ in about 1829 in
Franklin County, TN. Elizabeth was born on 15 June 1812 in North
Carolina. They had 12 children, only the first was born in TN, the rest
were born in AL. They moved to Alabama in 1831 probably Jackson County
they were in DeKalb County before 1840. The Following are their
children:

Sorry, but I am deleting all of the other stuff as I am sure that you have read it
before.  In the History of Columbus, GA, I could not find this Burt family.  Perhaps
I will have better luck across the river in Alabama.

However, there was a paragraph on a Benjamin Marshall.  He supposedly owned the first
piece of Indian Land on the west side of the Chattahoochee River.  It was called
Marshall's Reserve.  He later sold the land and seemed to have traveled elsewhere.

If anyone is interested in this, please let me know and I will type the whole thing
out.

company:  Patrick Ward, Alexander D. McFarlin; Joseph Selvy, mortally
wounded.  In Capt. King's company:  Leonard H. Harris, John Burt, Eli Smith.
In Capt. Lee's company Walter T. Brockman.  In Capt. Henry's company:
Joseph Thompson.  In Capt. Owen's company: William Dillon.  In the 1st

County to Warren county. Zacheus Burt was  the son of Joseph and Elizabeth
Burt, my gggg grandparents. Sally Burt, their daughter, married Taylor
Flewellen.

The Zacheus Burt who married your gg grandparents is very interesting. I
don't believe I have heard of any Burts in Arkansas. He could be the son of
John Burt, son of Joseph and Elizabeth. I have lost track of his children.

of John Burt and his first wife, Sarah Marshall. JOhn was the son of Joseph
Burt and Elizabeth Walton of Halifax Co., NC.  Sarah Marshall was the

Thanks for your interest in the Burt mail list. I will keep you informed as
to its status. I think this will be a great way for all Burt researchers to
share infomation.

I did not find Mary Jane Burt in my database and I do not recall seeing
Clarke county, GA mentioned. However, that is not far removed from Putnam,
Jasper, Warren, Hancockand Baldwin counties where the Burts and Marshalls
migrated to from North Carolina. I know that there were Burts in Oglethorpe
county which adjoins Clarke. She might also be from the Richard Burt/South
Carlolina line which I am not as familiar with. I am passing your query
along to some other Burt researchers who might be able to help.

I lied!  It wasn't Z. BURT that married Mary C BUSTIN and Joseph R JACKSON,
rather it was some of the JACKSON siblings that he married.

I thought I had a list of all marriages performed by BURT but I can't
find it.  I do have a note that at least one of the other ones gave his
first name as "Zachrus" which I assumed to be Zacheus.  Maybe yes, maybe no.

No idea if Zachariah BURT is identical to "Zachrus" BURT is identical to
Zacheus BURT.

The JACKSONs shown above were also from Warren Co GA.

I vaguely recall having once looked for any BURTs in the Union Co AR
census without success.  Could be wrong.

I'm really interested in what seems to have been a major migration from
Halifax Co NC to Warren Co GA around 1795.  Who all was involved?  Who
led it?  When exactly did it take place?  Was it just one big bunch of
folks moving at the same time or did the families just drift down at their
own convenience?  Why did they move?  I'm I making too much of this?

I have finished, maybe; depending on whether or not you want me to modify
or edit it some.

It is attached as burtfgs.txt, about 36 kb.

Now, the real textual part of the fgs fits on four (4) pages. That includes
references too.

I added seven (7) footnotes. That includes that court case against
Elizabeth Hansford and the full texts of the other main references, wills,
deeds, etc. Using my printrer, all of this takes 13 pages.

You may well want to cut out the foot notes, at least those after the first
one concerning Elizabeth. And that is your choice.

One other thing. I did not make a direct reference to the Mathis book. I
made reference indirectly. But his work just has errors that cannot be
explained. That is why I put so much of those documents in here. Also I
have seen it in print that Richard and Elizabeth Hansford had not only
Richard Jr. but also his three daughters. And, remember that Mathis has
Richard Jr. married to Elizabeth Hansford and has the three daughters, but,
two pages further in his text, he says that Richard Sr. is married to her.

Family of Richard BURT The Elder

Richard BURT The Elder was born about 1665, presumbly in Virginia. He died=
 1745 in York Co., VA.

No records have been found concerning the parents of Richard Burt the elder.=
 There are records that a Richard Burt was living in Charles River County,=
 Colonial Virginia in 1642 and 1649. This person was in that portion of=
 Charles River County that later became Gloucester County. Similarly, no=
 marriage records for Richard the elder have been found. However there is=
 evidence of two marriages and several children, as discussed below.

There are three different records which provide the primary and vital=
 information concerning his marriages and descendants. First is an indenture=
 made in January 1737/8 [1] and extracted below.

"the one Third part of a Certain Tract or parcell of Land Situate Lying and=
 being in York County and York hampton parish containing two hundred acres=
 more or less and is now in the possession and occupation of Richard Burt=
 the Elder which Said Land was Given by the Last will and Testament of=
 Elizabeth Hansford the Sole heir of Richard Jones to Elizabeth her Daughter=
 who Intermarried with the above named Richard Burt the Elder by which=
 marriage She the Said Eliz had Richard Burtt the younger (her Sole and only=
 heir Richard the younger Intermarried with Catherine By whom he had three=
 Daughters VIZ. Martha Eliz and the above named Judith the wife of the Said=
 John Cosby So that the said Land (after the Death of Richard the Elder)=
 Doth Descend to the three Daughters of Rich. the Younger as Coheirs and all=

This deed clearly identifies Richard the younger as the only and sole heir=
 of Richard the elder Burt and his wife Elizabeth. Further, this deed=
 clearly identifies Elizabeth, wife of Richard the elder, as a daughter of=
 Thomas and Elizabeth Jones Hansford. See Footnote 1 for information=
 concerning an incident in her life.=20


Thus Richard the elder Burt married Elizabeth Hansford, daughter of Thomas=
 and Elizabeth Jones Hansford. This union produced only one heir, Richard=
 the younger Burt.

The relationship identified above of Elizabeth Hansford to Elizabeth Jones=
 Hansford and to Richard Jones is also confirmed in the will of Elizabeth=
 Hansford, widow and relict of Thomas Hansford deceased, recorded in [2]=
 York County, VA Record Book 6, Deeds, Orders, Wills, 1677-1689, page 39.

The second record of vital importance is the will of Philip Moody [3].  It=
 is extracted below.

"I Philip Moody of York Hampton Parish in the county of York being sick &=
 weak of body but thankful to Almighty God of Perfect Sence & Memory do make=
 this my last will & Testament in manner & form as followeth; ...=20
. . .
Item I give to my daughter Elizb Burt two pounds ten shillings to be paid=
 her twelve months after my decease.
. . .=20
Item I give to my three granddaughters (viz) Martha Burt, Elizb Burt &=
 Judith Burt Each of them twelve pence sterling. =20
. . .=20

It is Likewise my will that my Exec-rs take care of my three grand children=
 Martha Elizb & Judith Bart that is to bring them up to read & other=
 learning fiting for women out of the profits of the Estate that belongs to=
 them=20
. . .

By naming his three granddaughters, Martha, Elizabeth and Judith Burt,=
 Philip Moody confirms that the mother of these grandchildren was Catherine=
 Moody, named in the deed first cited above. Thus Richard the younger Burt=
 married Catherine Moody and they had three daughters, namely Martha,=
 Elizabeth and Judith.

In as much as daughter Catherine was not named in his will and because=
 Philip made such special provisions for his granddaughters, it is assumed=
 that Catherine was deceased by this time. Her husband Richard the younger=
 Burt was deceased earlier in the year of 1719, thus leaving the children as=
 true orphans.

In addition, his daughter Elizabeth had married a Burt. But, which BURT?

The third vital document is the will of Richard the elder Burt [4],=
 extracted below.


" In the Name of God Amen I Richard Burt of York Hampton Parish in York=
 County being in perfect Sence and Memory do make this my last Will and=
 Testament in Manner and form as followeth. . .

From this will, we know that Richard the elder was married a second time and=
 had children other than Richard Burt the younger. The names of Josias and=
 Moody Burt most likely come from the Moody family. Captain Philip Moody had=
 an older brother namesd Josias as well as naming one of his own sons=
 Josias.

Richard married (1) Elizabeth HANSFORD, daughter of Thomas HANSFORD and=
 Elizabeth JONES [2], about 1687 in VA. Elizabeth was born about 1670 in VA.=
 She died after 1692 in York Co., VA.

Richard the elder and Elizabeth Hansford BURT had the following child:
Richard BURT The Younger was born about 1687 and died 1719.

Richard also married (2) Elizabeth MOODY, daughter of Philip MOODY, Captain,=
 and Elizabeth after 1692 in VA. Elizabeth was born about 1677 in VA and=
 died before 1745.

They had the following children:
Josias BURT was born about 1696 and died about 1758.
Moody BURT was born about 1698 and died about 1735.
William BURT was born about 1700.
Lucinda BURT was born about 1702 and died before 1745.


Second Generation

2. Richard BURT The Younger was born about 1687. He died 1719 in York Co.,=
 VA. Richard married (1) Catherine MOODY [1], daughter of Philip MOODY=
 Captain and Elizabeth. Catherine was born about 1691 in VA.


 3. Josias BURT was born about 1696 in York Co., VA. He died about 1758 in=
 York Co., VA. [5]


4. Moody BURT was born about 1698 in York Co., VA. He died about 1735 in=
 York Co., VA. [6] Other researchers have concluded that Moody married (1)=
 Elizabeth HEWITT about 1712. This researcher has not discovered such=
 evidence. Elizabeth was born about 1690 in York Co., VA.


5. William BURT was born about 1700 in York, VA.
One researcher has stated that the Will of William Burt is recorded in Book=
 1, Page 32, Greenville Co., NC, and dated October 15,  1783 and that the=
 Executors were William Burt, Jr. and Harwood Burt. The problem with this is=
 that there is no Greenville County, NC. There is a Granville County, NC and=
 no such will is recorded in that county. Further research is underway now,=
 February, 1997, to find if such a will might exist in Greensville County,=
 Virginia or in Greenville County, SC.


6. Lucinda BURT was born about 1702 in York, VA. She died before 1745 in VA.=
 The given name "Lucinda" has not been verified by this researcher. However,=
 Richard the elder Burt undoubtedly was the father of a daughter. Lucinda=
 was not listed in her father's will of 1744/5. This researcher assumes she=
 was deceased before the writing of the will.=20

Barbara, I found it. Thanks. I am adding the info to my wife's
ancestors.  I have quite a bit on Rebecca Burt and John Marshall's
descendants starting with Pendleton Jones Marshall.  I had not been able
to go back beyond John Marshall and John Burt "late of Alabama."

I wonder if there is a connection between the John Marshall who married
Rebecca Burt and the Sarah Marshall who was probably Rebecca's mother
and Stephen Marshall who married Elizabeth Burt.

Pendleton is also a name which facinates me.  My wife's grandfather was
James Pendleton Mangham. He had two grandfathers names James Pendleton
Mangham and Pendleton Jones Marshall.  The parents of the first James
Pendleton Mangham were married by Cpleman Pendleton VDM.  One of the
footnotes in your data states "....the Burt/Coleman family history
mentions Stephen Burt, son of John......."  Maybe I should check out the
Coleman family.

Hi Billy Adams gave me your email when I noticed he said you doing a 
Burt webpage. My name is Valerie Wood and I lived in Gainesville Ga. 
My grandmother was Eva Bethina Burt md a Pethel. Her father was David 
James a Baptist minister second marriage to Americus White. They were 
lived in Dawsonville. I am trying to do my genealogy but my job and m 
y daughters two of em keep me busy in sports and I will retire from 
Univ system of Ga next spring.  I did put my email in the list about 
a year or two ago with no success til I saw Billy in the list. I told 
him about a Charles Burt during a resesarch but I havent been in to 
uch but he had. There are so many Burts around here especially in 
Dawsonville that the town of famous racing driver Bill Elliott. I 
noticed that there some Burts in North Carolina and my gramdother was 
md to a Pethel and there are several of them in Kannaspolis North 
Carolina. I have her old trunk  and I remember she said it had been 
everywhere and oversea. She lived to be 98 until her death about 7 
years ago. She did have a sister Blanche and Farish that all I know.

Hi Barbara,

I am working on compiling Confederate units for Autauga Co. for an article
in the Ancestry, and during my research I looked up records for Elias
Bainbridge Goodson in Confederate Service Records, 1861-1865 microfilm. I
wanted to see if he was in the Autauga Guards before he was in the 8th
Cavalry. No luck there, but here is want I found in case you don't already
have it:  He served as a private in T. L. Faulkner's detached cavalry
company which later became Co. A Livingston's 8th Alabama Cavalry.  He
enlisted 30 Sept 1863 at Pollard, AL by Capt. Thomas L. Faulkner.

I would like to get E B Goodson's date and place of Birth and Death and
burial site for my Hunt line.  I would appreciate it if you would e-mail me
those. Also, do you know where he was living when he enlisted?

When I was at the Archives yesterday, I looked up Burt in the surname files
microfilm and found something of interest. I jotted this down for later
reference, not really thinking it important at the time, and failed to list
the source. I believe I saw this in some Burt notes, mostly on the Conecuh
Co. Burts, that listed marriages. Anyway, I noted the following marriages
in Autauga Co.:  William Burt and Wesley Mellard, and William Burt and
Caroline Walton. The later interests me. Could it refer to Dr. William
Washington Burt who married Caroline W. Mathews?  Could she be Caroline
WALTON Mathews?  Mary "Polly" Burt and John Mathews gave two of their
children the middle name of Walton. They had a daughter that we list as
Caroline Harriet Byrd Mathews. Could she be Caroline Walton Mathews?  Just
wanted to see what you thought.

I'm writing because (at some point or another) we have corresponded about the
Alston and / or Williams family of NC.  Currently, I'm part of a small group
of researchers who are digging into the BURT family of VA, NC, GA, AL.  One
of the many things we're trying to determine is the maiden name of the second
wife of Richard BURT, d.  1805, Halifax Co., NC.  She may be Elizabeth
ALSTON, dau. of John ALSTON & Mary CLARK.

What's making this a little iffy is that the Abington Parish (VA) records
show that Richard BURT was baptized in 1724...so IF he married Elizabeth
ALSTON WILLIAMS and IF Groves is correct on the ALSTON - WILLIAMS marriage
date and IF we have the correct Richard marrying Elizabeth WILLIAMS,
Elizabeth would have been somewhat older than Richard BURT.  Which is not to
say she couldn't have been -- just that it was somewhat unusual for the time.

The reason I'm writing is that I'm wondering if any of you have determined a
birthdate for Elizabeth ALSTON or a marriage date to Samuel WILLIAMS that is
different from that given by Groves -- or if anyone has determined that it
was not Elizabeth ALSTON who m. Samuel WILLIAMS.

Genealogical Society under "Warren County Wills with References to Halifax
County", abstracted by David Gammon:

MARY ALSTON EXUM- 400 acres of land for her lifetime with reversion to her

HARRIS- 400 acres of land, but if she leaves no issue, this land will

The above were all the abstracts related to the Burts taken from wills of
Warren County 1779-1902.  An "O" after the date of probate indicates the
original will exists and is found at the North Carolina State Archives.
The numbers indicate Will Book and page numbers.

Does anyone recognise any of these people? I can't keep up with all the
William Burts without a scorecard. :-)

Alabama book that was printed in 1983 (I believe that is when it was printed,

cds on marraiges and other things.

My husband keeps asking me if I'm going back to work now that I've finished
going back to school and the baby starts school next year.  I laughed and
told him that for a while this is going to be the only work that I'm going to
do.  I love it and love finding family connections.  Just yesterday, I got a
big envelope full of information from a distant cousin!  Related by my third
great grandfather (his second), by another wife.  I found him the the World
Family Tree project.  He only lives about 45 miles from me! He even had a
picture of my third great grandmother's grave.  I'm going to return the favor
by sending him a copy of his GG-Grandfather's grave.  My stepdaughter and I
found it down in Lee County two weeks ago and took pictures of all but four
grave stones in the little cemetery.  They were all on my list of family.

I really think that this is an addiction!  But you know what?  This is better
than any drug that they could ever come up with!  With this you get the
satisfaction of knowing that you are honoring your ancestors by showing such
interest in them.

I'll be glad to help any way I can to see if I can help anyone find any
information on family members, or any connections, by trying to join the
family trees.

  Here's another Burt researcher to add to your distribution lists - her
  address is [email protected]; her Burt family is from Russell County,
  Alabama and we don't know how she is connected to the Halifax County, NC
  Burts but I am certain they were related - probably through James or
  Jesse Burt of Putnam County, GA... the early Russell County families
  descend from William Washington Burt and William Marshall Burt, both
  born in GA in the first quarter of the 19th century. They were allegedly
  first cousins once removed, William Marshall Burt being the older one.

It is a cold, damp, rainy, dreary day here.

I have the file finished for the other case involving Elizabeth Hansford,
the first wife of Richard Burt the elder. I for one am perfectly willing
for it to be posted, but the choice is yours completely. The file,
e-hans2.txt, is attached.

This does get a little "raunchy" and might be offensive to some people. You
might not want to read it even. Of the individual words themselves, there
is only one that I would not use in mixed company. But the actions, etc., I
would not tell to just anyone. However, as you say, it does depict life in
those times (as well as today, too), it does depict idioms of the day; such
as "drunke behinde acomeing." It also depicts the spelling of the era. And,
quit frankly, in some areas, get rather laughable.

Now, if you do read it, I recommend that you keep four things in mind. 

First, these events occurred the night after the first trial, the trial in
which Elizabeth Hansford Burt was charged with and found guilty of
assaulting Mary Peters. However, she was fined only 100 pounds of tobacco
instead of the 5000 pounds sought in the indictment.

Second, this charge was brought by John Eaton _AGAINST_ Elizabeth.

Thirdly, John Eaton was a member of the jury of earlier that day, the one
that found Elizabeth guilty.

And last, Captain John Hansford was an uncle of Elizabeth. He was the
administrator of the estate of Elizabeth's mother.

We seem to be picking up other Burt researchers at a fast clip, don't we?
Good.

As I say now, I will support whichever way you decide to go. I would not,
however, tend to highlight this court case.

replyed, Fy Betty, as soon as you are out of one troublesum 
busines to goe into an other, what is the matter with you and 
John Eaton.  Shee then made a replye that I could not well 
hear haveing a could and somthing thick of hearing, but as near 
as your deponent could apprehend she spoke to that purpose 
that John Eaton would have 1aine with her a coming from Court.

tould her he thought itt did not lye under the servumstances 
of a rape and would not grant a warrant and bid her be sure 
to say noe more of itt. Your deponent went the next day to 
John Eaton's house and tould him I was sorry to hear what I 
did hear of him.  He askt me what itt was.  I askt him what 
he did to Betty Burt acoming from Court. He tould me nothing.
Then I tould him that Betty Burt would swear a rape against
him. He replyed, by God shee will undoe me then. I doe
confess I put my hand up her coates as high as her knees but 
I know not whether she be man or woman.

Eliz: Buce, aged about 49 years, deposeth that upon 24
August last past Eliz: the wife of Richard Burt came to your
deponent's house where your deponent did hear your deponent's 
husband aske Eliz: where her husband was, whoe said he is drunke
behinde acomeing, shee thought within hollow.  Your deponent 
did further aske Eliz: whoe came home with her, whoe said her 
neighbor Eaton brought her and her child home as farr as the
three roads. She thanked him and your deponent did see
Richard Burt soon after come into your deponent's house but
said nothing to him, Richard goeing immediately away againe.
About the Friday or Saterday following, your denonent did goe 
to Richard Burt's house where Eliz: did tell your deponent 
that John Eaton had ravished her upon the road the other night 
acomeing from Court and further tould your depcnent that upon 
Court day att night she, her husband and Eaton were together 
in the ordinary and Eliz: said shee complained by reson itt 
was late that shee knew not well how to goe home with her 
child, and Eaton did answere I will carry you and your child
home behinde me, at which Eliz: tould your deponent shee 
thanked him and drank to him and that soon after Eaton tooke up
Eliz: att the stocks behinde him upon his maire. And from 
thence rideing along the road homeward, Eaton did often put 
his hand under Eliz: coates and soe carrying her some what 
past the two pathes, Eliz: did jumpe downe from behinde Eaton 
and Eaton did alsoe alight and laid his two hands upon Eliz: 
shoulders, saying, now I must have to doe with you. And Eliz: 
replyed he shoulde not, saying what have not I a husband and 
you a wife. What think you would they say if they should know
itt.  And Eaton did reply, 0 doe not you tell vour husband and
my wife shall never know itt.  And Eliz: further tould your 
deponent that Eaton swore that if shee would not lett him he 
would whether shee would or noe and thereupon clapy one of 
his hands about the small of her back and with the other hand 
held up her cloaths and brought her as near as he could to 
his bare body, which shee tould your dedonent did hert her 
back, att which Eaton did much importune her to lye downe, 
but Eliz: would not, but cryed out and called to her husband 
twice saying help for the Lord's sake, in all which time 
John Eaton kept as close within Eliz: as he could, wrenching 
her thighes asunder with his knees.  Shee strugling had 
almost threw the child over her shoulder and cryed out the 
third time when Eaton stopt her mouth and Eliz: further tould 
your deponent that Eaton did take his mare and rode a little 
way as he said to meet her husband and asked her if he should 
call him, whoe answered Yes, must I be served thus and my 
husband not know itt, whereatt Eaton returned againe and 
would have had to doe with Eliz: the second time but she 
tould him he had done enough.  And Eliz: further tould your 
deponent that when Eaton went away saying if I doe not now, 
I will it the next opportunity.
